advanceDNA: If u knew what u were saying....u will know It's not in all cases u can enforce claim of oral contract.....
I said it to u before...no judge can force a seller to sell his goods....however, other technicalities can be argued and compensation can be awarded for inconvenience ....if u can't get that still then ur IQ is not even up to a 10 year old....
Yee...buyer can bring his arguement...thats not a crime ...virtually any arguement can be brought before court... But if u are not daft ...u should also know it's not everything that can win in court....
Werey wants to teach and doesn't even know what he's saying.....I asked u to show me the law that says a seller must sell or a buyer must buyer becos a price agreement was reached.... ..
....exchange has not happened here.....no one can force anything.....go and teach ur family members at home..or u carry ur useless research and shove it up ur ass You should first of all, learn how to use punctuation. It's makes it easy to read. Secondly, it is really costly trying to educate someone like you. I'm going to leave you to your self. You're better left like this because people like you ends up dragging intellectual people down to your level. You're a menace to the society. |

chidiokay: Even if there was a transfer, was there a remark indicating the purpose, beside any agreement that as not surpass the signature phase can be reneged/breached with full impunity Oral contract without witness or recording or prove of term is a waste, its convenient to deny and Judges are not omni-present, when 1 cancel 1 = 0 Your argument is not based on fact. Contracts can be entered orally. In an orally contract you don't need a signature for it to be binding as long as there is offer, acceptance and consideration, you have a legally binding contract. The purpose of the money transfered must not be explicitly stated but by implication be known ( The buyer is already riding the car for some time, and within that same period he had made payment to the seller of an amount that can be considered to be payment for the car)

advanceDNA: So if u want to enter into higher purchase agreement with someone...there won't be written agreement of total amount and the installments??
Can't the buyer claim u have not paid him in full after u complete ur payment?? There is no agreement here...only word of mouth I will sell...pay me......I'm not selling again..... And u started insulting ur whole family.....
This is funny.....everytime u want to form brilliant u just end up saying rubbish.... Please carry ur 10 year old IQ out of my mention.... Guy, are you so dull to realized that contract can be entered orally? A contract can entered through the following. A written Contract Oral Contract And a contract by implication. What ever the buyer claims can be argued in the court of law. During the period of the said payment of instalment, the buyer or the saler must have reveal the condition of the contract and the agreed amount to a third party who would be made to swear jury in a court of competent jurisdiction. I have told you, you lack knowledge on the said matter of discuss. Keep quiet and learn.

chidiokay: laws of contract, where there is no documentation or witness of any sort
really !! You don't need a witness when the transfer of money was done electronically. ( And the transfer carried the description " payment for car". ) Contract can also be entered orally!! Read, Read, Read!!! |

advanceDNA: Lol....go and carry ur research and teach ur family members at home....u want to form brilliant but u ended up saying nothing....
which law of contract allows buyer to jack up sellers car becos he refused to sell his goods..??.which research told u this??
There's is no sale here.....he paid but there was no exchange of goods or receipt...... He can't force the seller to sell his goods.....
He can only argue other technicalities in court ...... like if he has official proof he borrowed money with interest to pay for the car ...which can make a judge award small compensation . No judge will force a seller to sell his goods Honestly speaking, without statement of doubt your parents and guardian wasted their money sending you to school. I have never in my entire existence seen an illiterate being so frivolously boastful. That being said, let look at what the law has to say about ( Hire Purchase). When the OP did with the buy in the eyes of the law is hire purchase.

advanceDNA: Don't u think u are the one supporting street way....cos that's what the buyer is trying use here... ...The buyer has no right under any law to force the seller to sell....weda he paid in installment or at once......
We can't even call this issue seller's remorse because goods has not change hands and no receipt given... technically...sale has not happened You need some education on law of contract.. Read and research. |

TINTINABULATION: I do not know the system of communication in place, but i will suggest you adopt putting everything in black and white.
Raise an official memo whenever you are going on strike, and issue a rejoinder when strike has been called off. Serve the Management a copy of the memo at both instances.
By so doing, you will absolve yourselves from matters like this. You can't lead people, especially Nigerians with very poor disposition to work, with words of mouth only.
This one is gone but re-organise your leadership strategy to safeguard future re-occurrence. Thanks a lot and I really appreciate. |

Namaster: See as you latched on to a nonsense theory to get an explanation that suits you. Are you forgetting that Theory Y is also a thing?
Fact is you bleeped up!
It sounds like you work in a factory and you were TOO eager to declare a TOTAL strike when the situation is something that could be fixed EASILY.
You are NOT a leader. You just occupy a leadership position.
A position you seem to exploit. You want management to jump at your say so. You want the employees to jump at your say so.
YET when shit hits the fan, your BLAMED your fellow workers claiming that they are lazy and unmotivated.
BTW with what happened this morning, MANAGEMENT knows you no longer have control over the workers. And the employees know you are a snake that does not have their backs.
In short, you are the BAD GUY. If you understand the X and Y theory very well you will understand that staffs and workers especially in Nigeria, naturally do not like work and are looking for every means possible to cheat the system and thwart productivity. Secondly I don't work in a factory or sweatshop, far from it actually and at least 90% of staff here are learned and have undergo at least university education. You know little or nothing about labour union and managing people and this is what all you have said has clearly suggested. In all your efforts to sound intelligent, you ended up achieving the opposite. Your opinions are subjective and is based on assumptions and everything you said up there are all in your head. You have never being in a leadership position, so it is easy for you to think it is easy and compromises shouldn't be made. According to you, workers should evade work even when their demands has been met. You won't last long in a work place and would be a cancer to the organization. And if you're already working, it's won't take long before your rebellious attitude is known to all. |

fyzaila: You that declare an industrial strike, when the issue was resolved did you declare that the industrial strike has been call off? Even if the issue have been resolved, you still need to write boldly on a cardboard paper that, "strike has been called off" I had a meeting with them and called off the strike. What I do believe is this, theory x played it part today and it's natural. |
Romance › Seen As The Bad Guy From Colleagues In The Place Of Work. by Localemperor(op): 7:10pm On Jan 31, 2024 |
Something happened in my place of work, I work in an industry where the internal labor Union is active and till growing. Due to the kind of work, there is always or likely to be a disagreement between the employer and employee and this might affect production. So both parties have always made effort to see that issues are resolved before they escalate. I happened to be the leader of the labour union, I have always made sure I tackle industrial issue that affects employees and staffs and even to an individual level. We all lived inside the place of work, it's a large expense of land, our various houses is inside the industry and we avoid contact with the outside world due to the nature of what we do ( more like off-the grid stuff ). On our last Union meeting I talked about working as a team to solve labor problems. Now this was what happened today. Yesterday, there was an emergency in the industry that affects all workers and employees. As the labour leader I went straight to our boss in other to address the issues with him, he told me he was tired ( it's was already night ) but i made mention to him that it was an emergency that require immediate attention but till he refused to give me audiences. When I went back to the staff quarters I declared total strike and no union member was to resume work tomorrow ( which is today ). So this morning, when it was time for work and it's was obvious no worker was going to work after about two hours of work time wasted. The management called for dialogue, I took some union members and negotiated with the management. The management as promised went to work and saw that the issue was addressed. There was about 5hours of work time for the day when the issue was addressed but the workers refused to resume work even after the issue was addressed immediately and provisions was made to every person there. They refuse to go to work but I went to work because I saw no reason why the civil disobedience should continue even after issues was addressed 100%. Now they see me as a saboteur that is pretending to look good in the eyes of the administration. I'm beginning to think that I did something wrong. Please what do you think? |
