Praise be to Allaah. The Arabic word ightisaab refers to taking something wrongfully by force. It is now used exclusively to refer to transgression against the honour of women by force (rape). This is an abhorrent crime that is forbidden in all religions and in the minds of all wise people and those who are possessed of sound human nature. All earthly systems and laws regard this action as abhorrent and impose the strictest penalties on it, except a few states which waive the punishment if the rapist marries his victim! This is indicative of a distorted mind let alone a lack of religious commitment on the part of those who challenge Allaah in making laws. We do not know of any love or compassion that could exist between the aggressor and his victim, especially since the pain of rape cannot be erased with the passage of time – as it is said. Hence many victims of rape have attempted to commit suicide and many of them have succeeded, The failure of these marriages is proven and they are accompanied by nothing but humiliation and suffering for the woman. Islam has a clear stance which states that this repugnant action is haraam and imposes a deterrent punishment on the one who commits it. Islam closes the door to the criminal who wants to commit this crime. Western studies have shown that most rapists are already criminals who commit their crimes under the influence of alcohol and drugs, and they take advantage of the fact that their victims are walking alone in isolated places, or staying in the house alone. These studies also show that what the criminals watch on the media and the semi-naked styles of dress in which women go out, also lead to the commission of this reprehensible crime. The laws of Islam came to protect women's honour and modesty. Islam forbids women to wear clothes that are not modest and to travel without a mahram; it forbids a woman to shake hands with a non-mahram man. Islam encourages young men and women to marry early, and many other rulings which close the door to rape. Hence it comes as no surprise when we hear or read that most of these crimes occur in permissive societies which are looked up to by some Muslims as examples of civilization and refinement! In America – for example – International Amnesty stated in a 2004 report entitled “Stop Violence Against Women” that every 90 seconds a woman was raped during that year. What kind of life are these people living? What refinement and civilization do they want the Muslim women to take part in? The punishment for rape in Islam is same as the punishment for zina, which is stoning if the perpetrator is married, and one hundred lashes and banishment for one year if he is not married. Some scholars also say that he is required to pay a mahr to the woman. Imam Maalik (may Allaah have mercy on him) said: In our view the man who rapes a woman, whether she is a virgin or not, if she is a free woman he must pay a “dowry” like that of her peers, and if she is a slave he must pay whatever has been detracted from her value. The punishment is to be carried out on the rapist and there is no punishment for the woman who has been raped, whatever the case. End quote. Al-Muwatta’ , 2/734 Shaykh Salmaan al-Baaji (may Allaah have mercy on him) said: In the case of a woman who is forced (raped): if she is a free woman, the one who forced her must pay her a “dowry” like that of her peers, and the hadd punishment is to be carried out on him. This is the view of al-Shaafa’i, and it is the view of al-Layth, and it was also narrated from ‘Ali ibn Abi Taalib (may Allaah be pleased with him). Abu Haneefah and al-Thawri said: the hadd punishment is to be carried out on him but he is not obliged to pay the “dowry”. The evidence for what we say is that the hadd punishment and the “dowry” are two rights, one of which is the right of Allaah and the other is the right of the other person. So they may be combined, as in the case of a thief whose hand is cut off and he is required to return the stolen goods. End quote. Al-Muntaha Sharh al-Muwatta’ , 5/268, 269 Ibn ‘Abd al-Barr (may Allaah have mercy on him) said: The scholars are unanimously agreed that the rapist is to be subjected to the hadd punishment if there is clear evidence against him that he deserves the hadd punishment, or if he admits to that. Otherwise, he is to be punished (i.e., if there is no proof that the hadd punishment for zina may be carried out against him because he does not confess, and there are not four witnesses, then the judge may punish him and stipulate a punishment that will deter him and others like him). There is no punishment for the woman if it is true that he forced her and overpowered her, which may be proven by her screaming and shouting for help. End quote. Al-Istidhkaar , 7/146 Secondly: The rapist is subject to the hadd punishment for zina, even if the rape was not carried out at knife-point or gun-point. If the use of a weapon was threatened, then he is a muhaarib, and is to be subjected to the hadd punishment described in the verse in which Allaah says (interpretation of the meaning): “The recompense of those who wage war against Allaah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter” [al-Maaidah 5:33] So the judge has the choice of the four punishments mentioned in this verse, and may choose whichever he thinks is most suitable to attain the objective, which is to spread peace and security in society, and ward off evildoers and aggressors. https://islamqa.info/en/72338 |

Explanations on Dream www.nairaland.com/3951174/explanations-dream-1 |
DREAM (1 of 7) الرؤى والأحلام Dream is what people see in their sleep. This is also called nightmare. Using Hadiths, dream may be classified into two or three categories: Two Categories of Dream 1. True dreams 2. Evil dreams. And this comprises of the Shaytan’s attempts to frighten and the workings of the subconscious. Evidence: Abu Qutaadah said: The Messenger of Allah (peace and blessings of Allah be upon him) said: _“True dreams come from Allah and evil dreams come from the Shaytaan. If anyone sees a bad dream that scares him, let him spit drily to his left and seek refuge with Allah from its evil, then it will not harm him.”_ al-Bukhaari, 3292 Three Categories of Dream 1. Visions or dreams that come from Allah. 2. Attempts by the Shaytan to frighten us 3. The workings of the subconscious. Evidence: Abu Hurayrah that the Prophet (peace and blessings of Allah be upon him) said: _“Dreams are of three types: glad tidings from Allah, what is on a person’s mind, and frightening dreams from the Shaytaan. If any of you sees a dream that he likes, let him tell others of it if he wishes, but if he sees something that he dislikes, he should not tell anyone about it, and he should get up and pray.”_ (Saheeh Sunan Ibn Maajah, 3154). I dreamt what should I do? No problem, no fortune-teller or soothsayer...needed. Understand the followings under each type of dream. True Dreams 1. Know that it is from Allah Evidence: Abu Sa’eed al-Khudri narrated that he heard the Messenger of Allah (peace and blessings of Allah be upon him) says: “If any one of you sees a dream that he likes, it is from Allah, so let him praise Allah for it and tell people about it... al-Bukhaari, 7045 2. Praise Allah for it Evidence: Abu Sa’eed al-Khudri narrated that he heard the Messenger of Allah (peace and blessings of Allah be upon him) says: “If any one of you sees a dream that he likes, it is from Allah, *so let him praise Allah for it* and tell people about it... al-Bukhaari, 7045 3. Tell people but only to the one whom he loves Evidence: Abu Sa’eed al-Khudri that he heard the Messenger of Allah (peace and blessings of Allah be upon him) says: “If any one of you sees a dream that he likes, it is from Allah, so let him praise Allah for it and tell people about it... al-Bukhaari, 7045. Narrated Abu Salama: I used to see a dream which would make me sick till I heard Abu Qatada saying, "I too, used to see a dream which would make me sick till I heard the Prophet saying, "A good dream is from Allah, so if anyone of you saw a dream which he liked, he should not tell it to anybody except to the one whom he loves, and if he saw a dream which he disliked, then he should seek refuge with Allah from its evil and from the evil of Satan, and spit three times (on his left) and should not tell it to anybody, for it will not harm him. " al-Bukhaari Volume 9, Book 87, Number 168 Note: Please learn from Prophet Yusuf’s story (Peace be upon him) (Q12:4-19..), don't just tell your dream! Fiqh of Menstruation 2 www.nairaland.com/3951166/fiqh-menstruation-2 |
Fiqh of Menstruation (2 of 4) Recitation of Quran during Menstruation It is permissible for a menstruating woman to recite Quran if she needs it according to the more correct scholarly opinion on condition that she does not touch it, and she may touch it with a barrier. Majmoo‘ al-Fataawa, 21/460, Majmoo‘ al-Fataawa, 26/191. The scholars of the Standing Committee for Issuing Fatwas said: It is permissible for the menstruating woman to recite from memory without touching the Mushaf directly, if she needs to recite Quran so that she will not forget it. Fataawa al-Lajnah ad-Daa’imah, 4/232 Majmoo‘ Fataawa Ibn Baaz, 6/360, Fataawa Noor ‘ala ad-Darb by Ibn ‘Uthaymeen, 123/27 , Fataawa Noor ‘ala ad-Darb by Ibn ‘Uthaymeen, 123/21. (Haashiyat Ibn ‘Aabideen, 1/159; al-Majmoo’, 1/356; Kashshaaf al-Qinaa’, 1/147; al-Mughni, 3/461; Nayl al-Awtaar, 1/226; Majmoo’ al-Fataawaa, 21/460; al-Sharh al-Mumti’ li’l-Shaykh Ibn ‘Uthaymeen, 1/291) Menstruating woman may read tafseer (commentary) of Quran which is more than original Quran in texts. al-Sharh al-Mumti’, 1/267 Intimate during Menstrual Period Intimate, and with the area between the navel and the knee, apart from the front or back passage is allowed, Ibn al-Qayyim said in Tahdheeb al-Sunan, commenting on hadeeth no. 2167 from ‘Awn al-Ma’bood: The hadeeth “Do everything except intercourse” clearly indicates that what is forbidden is only intercourse in the site of menstruation,..but everything else is permissible. The hadeeth which speak about the izaar (waist wrapper) do not contradict that, because that is a precautionary measure and it is better. Al-Mughni, 1/419. al-Mughni, 1/415, al-Albaani in Saheeh Abi Dawood, 242. Fataawa al-Lajnah al-Daa’imah, 5/395, Al-Bukhaari (302) and Muslim (2293) Muslim (294), Sharh Muslim by al-Nawawi, and al-Mughni, 1/414 Entering Mosque during Menstruation The majority of Jurists of the four schools of thought are of the view that it is not permissible for a menstruating women to stay in the mosque. They quoted as evidence for that the report narrated by al-Bukhaari (974) and Muslim (890) from Umm ‘Atiyyah who said: “He (the Prophet (peace and blessings of Allah be upon him)) commanded us on the two Eids to bring out the virgins and those who usually stayed in seclusion, but he told the menstruating women to keep away from the prayer-place of the Muslims.” The scholars of the Standing Committee were asked (6/272): What is the ruling on a woman who enters the mosque when she is menstruating to listen to the khutbah only? They replied: It is not permissible for a woman to enter the mosque when she is menstruating or bleeding following childbirth… as for passing through, there is nothing wrong with that if it is necessary and there is no risk of her contaminating the mosque. Fataawa al-Lajnah al-Daa’imah, 6/272 (5/398) , Fataawa al-Tahaarah, p. 273. al-Mabsoot, 3/153; Haashiyat al-Dasooqi, 1/173; al-Majmoo’, 2/388; al-Mughni, 1/195 al-Bukhaari, 324; Muslim, 890. Risaalat al-Dima’ al-Tabee’iyyah li’l-Nisa’, p. 52-53. Fataawa Noor ‘ala al-Darb, 2/678 Prayer rooms in the university residences and elsewhere do not come under the same rulings as mosques in every aspect. Fataawa al-Lajnah al-Daa’imah (5/170), Liqa’ al-Baab al-Maftooh, 22/27. Menstruating women are not forbidden to enter Makkah or Madeenah only thing that they are not allowed to do is to circumambulate the Ka’bah. ‘Aa’ishah (may Allah be pleased with her) was with the Prophet (peace and blessings of Allah be upon him) during the Farewell Pilgrimage and she got her menses before she entered Makkah, but he (peace and blessings of Allah be upon him) did not tell her not to enter the city until she became pure (her period ended)! Rather he told her to do all the rituals of Hajj except for Tawaaf around the Ka’bah, which she was to delay until she became pure. He (peace and blessings of Allah be upon him) said: “Do everything that the pilgrims do, but do not circumambulate the House until you become pure.” Narrated by al-Bukhaari, 305; Muslim, 1211. My Brethren going to NYSC Orientation Camp _What are your preparations for a gathering not guided by Shari’ah?_ National Youth Service Corps (NYSC) orientation camps in Nigeria are not the same, thus activities on each camp may be different. For example: what is allowed in Benue may not be allowed in Kano and vice versa. Prepare what to eat, though there is provision for food but it may not be enough or be your choice. Prepare what to wear; short and tight dresses are not our dress especially for the female. Get dresses of that color (especially white) and use it diplomatically. Remember, the best provision for the journey: (taqwa) (http://www.nmnonline.net/articles/taqwa.htm) and strengthen your Iman every moment (http://productivemuslim.com/recharge-your-iman/). Muslim Corpers Association of Nigeria (MCAN) is on camp to guide you, register with them as soon as you enter. Stay in the mosque arena if it is allowed, for protection of your religion and attend their activities. And MCAN key members should follow protocol also for organizing activities. On camp you’re living like a traveler; still don’t know your destination, Place of Primary Assignment (PPA). Jurists differed on the ruling but the most evidenced is to do Qasr till you reach your PPA. Please read about Salat Qasr. It is haram to mix with opposite sex in the mosque which is the purest place on the face of the earth – then how about orientation camp that is not guided by shari’ah? Allah says: _“those who do not bear witness to falsehood, and if they pass by some evil play or evil talk, they pass by it with dignity”_ (Q 25:72). My brethren, it is not a must to attend promiscuous and immoral gatherings on camp, don’t be fooled. Islam strives to protect woman and guard them against the causes of temptation and deviation, it is not permissible for a woman to travel without a mahram. Ibn ‘Abbaas (may Allah be pleased with him) who said: The Prophet (peace and blessings of Allah be upon him) said: _“No woman should travel except with a mahram, and no man should enter upon her unless there is a mahram with her.”_ A man said: “O Messenger of Allah, I want to go out with such and such an army and my wife wants to go for Hajj.” He said: _“Go out with her."_ al-Bukhaari (1729) and Muslim (2391), Fataawa al-Lajnah al-Daa’imah (12/178). So, what is your preparation for this? Attacks on Muslim sister are frequent on camp. Listen brothers! Allah says: _"The believing men and believing women are allies of one another. They enjoin what is right and forbid what is wrong and establish prayer and give zakah and obey Allah and His Messenger. Those - Allah will have mercy upon them. Indeed, Allah is Exalted in Might and Wise."_ (Q9:71). Protect your sister diplomatically, who will protect her if not you. Posting to a Place of Primary Assignment (PPA) is a lesson for all; it looks like the Day of Judgment. From different institutions, meet and become friends. Within that short time you will not like to leave your friend but the camping is over you need to go. Collection of letter to PPA is touching; coper will line up in the same uniform. After collection of letter of PPA some will be happy and some will not be happy. You will see graduate crying! Why? He/she was posted to village while his/her friend was posted to town, thus feel frustrated. My brethren, don’t cry, ask Allah to give you the best, He knows you don’t know. Allah says: _“perhaps you hate a thing and it is good for you; and perhaps you love a thing and it is bad for you. And Allah Knows, while you know not.”_ (Q2:216). Any place you’re posted to, your religion is the priority, if you’re still a believer, what makes you happy than that?! May Allah make piety part of your journey, forgive your sins and fulfil the purpose of the journey. I make Allah responsible for your deen, your trustworthiness and for the results of your actions. Fiqh of Menstruation www.nairaland.com/3936560/fiqh-menstruation-part-1 |
Fiqh of Menstruation (1 of 4) Alhamdulillah wasolatu wasalaam ‘ala rosulillah Menstrual blood is thick-dark blood and it has unpleasant odour different from ordinary blood familiar to women. It is accompanied by pains or cramps, headache sometimes. Many women undergo pains during the period, it is pity and saddened heart to hear that some cultures or religions on earth still maltreat menstruating woman in this condition. In some villages in Western Nepal for example, women during menstrual period sleep in a small hut or shed out of a fear they will contaminate the home or draw anger of the Hindu gods on them if menstruating women remain indoors. Their believe is that many people in the part of the country (Nepal) like family members or livestock will get sick, or even die, if a menstruating woman doesn’t stick to the rules. On November 18th 2016, 26-year-old Dambara Upadhyay, died in the hut, among others in the history. To them be their religion, and to us (Muslim) be our religion. Islam justly gives women rights; establishes respect and honor for them in all circumstances. It is only those who don’t understand religion of Islam or those who follow their whims that abuse or maltreat woman. ‘Aisha (Peace be upon her) narrates that, “We set out with the sole intention of performing Hajj and when we reached Sarif, my menses began. The Messenger of Allah sal Allahu alayhi wa sallam came to me while I was crying and asked, ‘What is the matter with you? Has your menses started?’ I replied, ‘Yes.’ He said, This is something which Allah has destined for the daughter of Adam.So do what all the pilgrims do with the exception of the Taw-af (Circumambulation) round the Ka’ba.” ‘Aisha added, “Allah’s Apostle sacrificed cows on behalf of his wives. Al-Bukhaari 293, Al-Hakim. Narrated ‘Aisha (Peace be upon her): While in menses, I used to comb the hair of Allah’s Apostle. Al-Bukhaari 294. Narrated ‘Aisha (Peace be upon her): The Prophet used to lean on my lap and recite Quran while I was in menses. Al-Bukhaari 296 etc. This is our religion (Islam). In Risaalah fi’l-Dima’ al-Tabee’iyyah li’l-Nisa’ by Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) the most important rulings that have to do with menses in women mentioned are that in during menstrual period Salat (Prayer) is not allowed, Fasting is not allowed, Tawaaf (circumambulating) around the Ka’bah is not allowed, Tawaaf al-wadaa’ (the farewell tawaaf) is waived in her case etc. To be cont…Inshaa Allah May Allah grant us understanding of His religion and accept it as an act of ‘ibadah FIQH CLASS |
