That is what it should be.
I'm not here to bandy words with lazy APC fans, they can go ahead and search out/confirm the position of the law in respect to that election and the matters arising.

But two options are opened for INEC according to the Law:

1. INEC declares the living candidate that scored the highest number of votes winner;

2. INEC conducts a fresh polls altogether, after it would have given APC enough time to conduct a fresh primaries and come out with a candidate.

Anything other than any of those would tantamount to absolute lawlessness and a terrible precedence that will hunt everyone in future.

Admit it or not, my brothers and sisters from the other mother.
That is what should be.
It is not in throwing tantrums.
And if you guys use Federal might to something else on Kogi people and the entire country (as your stock in trade has been) you will be the worse for it in a time not too long from now

The race is between APC and PDP and not between Audu and Wada (as interpreted by Supreme court in deciding between Omehia and Amaechi) When Omehia was removed he was not replaced by the opposition party candidate but by his own party's candidate (Amaechi) because the PDP has already won the main gubernatorial election. So if you replace Audu with Omehia in this situation then you'll just simply have to produce a candidate from APC to take over the winning votes of APC in the main election(only intra-party candidate change is needed) or did Supreme court order that opposition candidate should take over in Amaechi case? if not why should Wada take over APC's vote when the party(APC) has not been found wanting or disqualified.
Going according to what Nurse Metuh is saying is simply going against the supreme court interpretation or PDP creating their own law for selfish reason.


So Nurse Metuh should sit down and let the Doctors (AGF and CJN) do the needful.

There were strong indications on Wednesday that the campaign organisation of the late Kogi State governorship candidate of the All Progressives Congress, Alhaji Abubakar Audu, was preparing a ground for the emergence of the deceased’s son, Mohammed, as a replacement for his father.

Audu died on Sunday, a few hours after the Independent National Electoral Commission declared the November 21 governorship poll in the state inconclusive.



The deceased had polled 240,867 votes in the election while the Peoples Democratic Party’s candidate and incumbent state Governor, Capt. Idris Wada (retd.), scored 199,514 votes, leaving a gap of 41,353 votes between the two leading candidates in the election.

INEC had declared the election inconclusive on the grounds that cancelled votes or registered voters in the 91 polling units, where the exercise did not take place were 49,953, a figure higher than Audu’s lead of 41,353 votes.

A leader of the APC in the state, who confided in The PUNCH, said the dominant view in the organisation was that Mohammed should join the race.

It was gathered that a few members of the group had also suggested that Audu’s running mate in last Saturday’s election, Mr. James Faleke, should contest the primary.

It was gathered that members of the group, which dominates the APC in the state, met on Tuesday night following the party’s declaration that another primary would be held to produce a replacement for the late governorship candidate.

The commission had on Tuesday written the APC, directing it to submit a replacement for the late Audu while the party said it would hold a fresh primary to produce a replacement for the deceased APC standard bearer.

The APC leader, who confided in The PUNCH, said the late Audu’s political structure was still intact despite his death.

He stated that nobody could win the state governorship primary of the APC without the backing of Audu’s supporters.

The source said, “Abubakar Audu’s supporters, including his campaign structure, are rooting for either Audu’s son, Mohammed, or James Faleke for them not to lose out entirely. They are narrowing it to either Faleke or Mohammed because the APC machinery believes that the election has been won. But the party elders and leaders, who worked for him, will be more comfortable with Mohammed.

The spokesperson for the APC in Kogi State, Abdulmalik Suleiman, said, “We are mourning. This is the time for sober reflection and we are praying for our late leader and icon. At the appropriate time, the public will know because APC has a way of solving its issues and problems.”

One of our correspondents, however, learnt that despite the state of mourning in the party in the state, no fewer than four aspirants have started jostling to emerge as a replacement for Audu in the supplementary election on December 5.

These aspirants, it was learnt, included Faleke, who was Audu’s running mate in last Saturday’s poll; Yahaya Bello; a former PDP governorship aspirant, Jubrin Echocho, and Salihu Atawodi.

While Faleke is from the Ijumu Local Government Area of Kogi West Senatorial District, Bello is from Okene in Kogi Central.

Echocho, who defected from the PDP to the APC after failing to clinch the governorship ticket of the former, is from Dekina LGA in Kogi East Senatorial District, the same zone as the incumbent governor, Wada.

Atawodi is from Dekina LGA and contested against Audu during the APC governorship primary.

Meanwhile, the National Working Committee of the APC postponed its meeting earlier scheduled to hold on Wednesday.

The National Chairman of the Party, Chief John Odigie-Oyegun, said the postponement was to allow key officials of the party to fully participate in the burial of Chief HID Awolowo, who was buried on Wednesday in Ikenne, Ogun State.

The NWC had scheduled the meeting to deliberate on the date and modalities for fresh primary to elect a replacement for Audu.

Despite the postponement of the meeting, a group of youths under the aegis of Kogi Youth Vanguard, stormed the party headquarters to demand that Audu’s running mate, Faleke, be given the mandate to represent the party in the supplementary election.

Leader of the group, Bamidele Peters, who claimed to be from Kogi East, said, “Though we sympathise with the family of the late APC governorship candidate , Abubakar Audu, and the Kogi electorate, who voted for the APC, we feel that this mandate is not just for an individual but the entire party.

“We think the election should be allowed to be concluded and that there should be no replacement for the candidate until after the election. The party will after the election be able to replace its candidate.

“Our own interest under the circumstance is to ensure that the supplementary election is concluded. Even if the party will replace its candidate, it should be after the election; and I feel that if possible, the running mate, Abiodun Faleke, should be allowed to step in to replace the late governorship candidate.

In a related development, the Democratic Peoples Congress has demanded that a fresh governorship election should be conducted in Kogi State following the death of the candidate of the APC.

The National chairman of the DPC, Rev. Olusegun Peters, said this in a statement in Abuja on Wednesday.

Peters said, “The party rejects INEC’s position to continue the November 1 poll by conducting a supplementary election for 91 polling units on December 5, 2015.

“It is inappropriate for INEC to direct the APC to choose another candidate to substitute the late Audu and continue the governorship election when the people voted for the candidacy of Audu and not the yet-to-be-selected candidate the electorate did not vote for.”

According to him, the DPC strongly opposes the attempt by INEC and the ruling APC to impose a candidate on the people of Kogi State in what he described as a violation of democratic ideals.

The party chairman added, “We demand a fresh governorship election that will reflect the will of the people. This is the only way the nation’s frail democracy will be deepened and strengthened to provide its dividends to the long suffering compatriots.”

Meanwhile, a former Governor of Cross River State, Chief Clement Ebri, has called on the national leadership of the APC to consider fielding one of the children of the late Audu as a replacement.

In an interview with our correspondent in Calabar on Wednesday, Ebri, who was the governor of the state between 1992 and 1993, said the late APC candidate in the November 21 inconclusive governorship election was fortunate to have adult children, who were capable of filling the vacuum created by Audu’s demise.

Ebri said, “I agree that this is a democracy and not a monarchy; but to my knowledge, more than one of the late Audu’s children have the capacity to take up the ticket. I have seen them and I know them to have the capacity. So, why the party is still thinking of what to do, here is a suggestion – put another Audu in there.

“In 1991, when we were running our elections, Dr. Joe Nwodo was disqualified and the party got his younger brother to replace him. That was Ekwezelieze Nwodo, who did a great job.

“I am sure that the circumstance we have today dictates that we even consider that. By that way, the labour of the late Audu, who had never given up and had
sacrificed for his people, will not be in vain.”

Now I could hear voices in the room and I became alert, but I eyes remained close.
From the voices I could tell the first voice was a guy and other voice, that one sounded more like a mumble and I was sure the first voice wasn't Anthony's then i became confused. I was lying on my back and making an effort to keep my eyes closed but my ears remained open trying to pick up every tiny sound around me.
I was sweating, everywhere was hot, I could not wipe the sweat off my face because I was scared any movement I made would draw attention towards me.

A Conservative minister has said that British consular officials will visit controversial Radio Biafra director Nnamdi Kanu, whose arrest in October has led to protests in London and Nigeria, after a question from the joint Nigerian-British activist’s constituency MP, Harriet Harman.
 
James Duddridge, Minister for Africa and the Caribbean, confirmed that Kanu, who is the leader of the Indigenous People of Biafra (Ipob) had been visited in Nigeria by members of the Foreign and Commonwealth Office but that he did not ask for British consular assistance.
 
Duddridge said in his letter: “Kanu is a dual Nigerian/British national. In cases involving dual nationals in their country of other nationality we do not usually provide consular assistance unless we judge an individual to be particular vulnerable.
 
“Following concerns raised by friends of Mr. Kanu to the Foreign and Commonwealth office, including about his well-being and ongoing medical condition, we judged it appropriate in this instance to offer assistance.
 
“The Nigerian Authorities granted access to our consular team to visit Mr Kanu on 3 November 2015 where he is being detained in Abuja. Mr Kanu has confirmed to us that he has access to a lawyer and that he does not require the British government to make any further representations to the Nigerian Authorities on his behalf. We do, however, intend to make a further consular visit to check on his well-being.”
Kanu was arrested by the Nigeria state service (DSS) on charges of criminal conspiracy, intimidation and belonging to an unlawful society. He pleaded not guilty. Ipob and other pro-Biafran movements call for the independence of territories that constituted the Biafran Republic, established in 1967 and re-annexed by Nigeria in 1970, following a civil war that claimed between one and three million lives.
On 23 November, Kanu attended a hearing at the Abuja Magistrates Court and his trial was adjourned to 1 December. Kanu’s lawyer, Vincent Obetta, said the DSS had been authorised by the court to further detain his client to “conclude what they said was an investigation of terrorism and terrorism financing”.
 
Kanu’s arrests sparked protests in Nigeria and other countries with pro-Biafrans demanding the immediate release of their leader.

Platini is provisionally suspended from Fifa's Executive Committee due to an investigation into a £1.3m payment made to him by Fifa president Sepp Blatter.

Fifa's ethic committee are seeking to impose a lifetime ban on Uefa president Michel Platini, according to the lawyer  at the head of the investigatory chamber's report into the 60-year-old Frenchman.

Hans-Joachim Eckert, the German judge who chairs the adjudicatory chamber of Fifa’s ethics committee, has opened formal proceedings against both Platini and Fifa president Sepp Blatter after receiving the final report of an investigation into alleged serious breaches of their ethical code regarding a £1.3m payment made to the Uefa chief by Blatter in 2011.
Blatter and Platini facing length bans as Fifa open formal proceedings
However, lawyer Vanessa Allard, who had led the investigation into Platini and Blatter, has told AFP that she has recommended a lifetime ban for the former France international footballer.
Both face lengthy bans if they are found guilty, with a decision believed to be made in December over their futures with Fifa. Platini hopes to succeed Blatter when the next Fifa president is elected on 26 February 2016, but any ban will rule his application invalid and he won’t be allowed to run for the presidency.
Seven candidates hoping to be Fifa’s next president.
Blatter and Platini are currently provisionally suspended by Fifa pending the outcome of their investigation into them. Both deny any wrongdoing.

President Muhammadu Buhari, yesterday, descended on the judiciary, saying the overall levels of judicial service delivery in the county still leave much to be desired.
President Buhari said he was perturbed that more than ever before, “allegations of judicial corruption have become more strident and frequent.”
Flagging-off the 2015 All Nigeria Judges’ Conference  in Abuja,  yesterday, Buhari, who was represented by Vice President Yemi Osinbajo, SAN, accused corrupt lawyers and judges of sabotaging his efforts to recover stolen assets.
He said: “Further on point of negative perception, there is both local and international dissatisfaction with the long delays in the trial process. In the past few years, this has become especially so for high-profile cases of corruption, especially where they involve serving or former political office holders.
“As my lords are undoubtedly aware, corruption transfers from public coffers to private pockets, resources required to deliver social and economic justice.
“Government’s attempts to recover such assets in accordance with the law are often faced with dilatory tactics by lawyers sometimes with the apparent collusion of judges.
“These tactics are often not directed at reaching any conclusion or affirming innocence or guilt, but at stalling trials indefinitely, thus denying the state and the accused person the opportunity of a judicial verdict. I wish to echo the sentiments of the vast majority of Nigerians in saying that we cannot afford to continue on this path.”

The Nigerian Communications Commission (NCC) yesterday  said it would sanction MTN, Airtel and Globacom for defying its directive on automatic migration to Pay-As-You-Go data bundle.
The Commission made this known in its ‘2015 third quarter Compliance Monitoring and Enforcement Report’ obtained posted on its website.
NCC said it had continued to receive complaints from subscribers on automatic migration of data bundle package to Pay-As-You-Go Billing on depletion of their data bundle.
‘’Consequently and pursuant to section 53(1) of the NCC Act, 2003. The commission on 3rd August 2015 directed all mobile service operators to comply with the data bundle directions.
According to News Agency of Nigeria (NAN), NCC said “where a subscriber’s data bundle account is fully depleted before the due date, service providers should notify the subscriber via SMS, giving information regarding the tariff/ billing rate for automatic migration.
