This is basically the issue. It's like the provision that requires "spread" in presidential, governorship and local government elections. It is not enough for a candidate for the presidency to win majority of votes in the election. He must also win 2/3rd of the votes in 2/3rd of the states. This is to ensure that no single region can determine who will be president. A candidate must win in multiple regions before he can be declared the winner.

Similarly, I told people that said that Buhari was going to "Islamise" Nigeria that it was not possible under our current constitution. You would need to get the consent of 2/3rd votes of 2/3rd of the state houses of assembly and that's impossible.

There is a diplomatic option available and I will give example. I know you are aware, but not many people know that Lagos State is a Sister-City to Atlanta City in USA. The constitution has not forbidden cultural fraternity across sovereign boundary. Using Yoruba as an example, cultural identity with Brazil and Cuba. Either of the countries, or both, could sponsor UN intervention on grounds that Yoruba is their Holy Land, as Mecca is to Muslims and Vatican is to Catholics, continued existence of Yoruba in Nigeria is a threat to articles of history and divine faith both of which have tangible values to their people for spiritual growth and sustenance.

Yoruba cannot initiate a UN intervention since it is not a sovereing on its own but another sovereing can initiate one on its behalf and introduce convincing evidence and even call professional historians, anthropologists and theologians to deliver evidence and proof beyond doubt that if Yoruba continues in Nigeria the forces of destruction is a living threat and the Holy Land to millions of Osun and Ifa adherents around the world will suffer an irreparable loss.

First of all, Mr. OP you are mistaken.

The north has more legislators than the south.

Secondly there is no consensus of what is the southern agenda.
We can only achieve a common goal if we have a common agenda.

One common agenda today should be the decentralisation of the police force to allow state government to control policing.

You will need a constitutional amendment in order to change the shape of Nigeria, in order to add, remove, create any state in Nigeria, etc. That's why all the calls for referendums have been that a clause should be inserted in the constitution to permit a referendum and to give legal backing to the result of a referendum. The territory that makes up Nigeria is spelt out in the constitution (that's why it was difficult for the Lagos State Government to create new local governments during Bola Tinubu's era). Therefore, it will require a constitutional amendment.

The Constitution of 1999 was drafted and made law by Military Provisional Council. Am i correct? Here is the first part of the constitution -

This is interesting because the constitution itself is only repealable by another military power.

Ill bring our problem to light a little bit here.

1. South wants restructuring, North does not.
2. North wants to nationalize Sharia, South does not want it.

However, the sitting government continues to exercise executive power to circumvent the constitution in favor of Sharia. This is without doubt a violation of the law but a smart and bold approach. Its like he is saying screw everybody and the constitution, we do what we want...we gave you the constitution and we will disobey it as we please, there is nothing anybody can do! You try nonsense you will have the security force to deal with.

This is a hot yeear! Since the beginning of this year those who speak for North has continued to drop hint of using security force to fight dissenters.

If North is unable to get shariah through executive power or through constitutional amendment it is very likely they will attempt a security force take over, which would repeal the current constitution the same way they did with 1979 constitution. The 79 and 99 constitutions both converted ownership of Nigeria to North.

I suspect they will use security force to sack the National Assembly and then suspend the constitution. Look, if Buhari was in country when Mamman Daura laid siege on National Assembly he would not have intervened as VP Osinbajo did to restore order and then terminate Daura. Buhari would not have intervened nor fire Daura.

We have had two Southern Presidents and neither one had the boldness to restructure the country during his administration. I dont think the next Southern President will have the balls either. A change in the constitution to effect restructuring can only be done by a military take over when they suspend or repeal it. The one we have now was put together by them anyway.

It would then be safe to say Nigerians don't want to make it happen because with this the South equally failed to make Nigeria better.

What happens to other claims, like the constitution does not give the south good numbers in the house to Enact laws without the North....I smell plenty lies and propaganda against the North.

If this is true, It simply shows the hypocrisy of the south to have it all while still accusing the north of being responsible for the nations short coming.

You didn't get what I'm hinting at, so I'll make it clear.

You are looking at what's required to pass a bill in the House of Representatives. All that's required is a simple majority.

However, a constitutional amendment is different (all the things that you listed require constitutional amendments).

In order to amend the constitution, you need

1) ⅔rd majority of votes in the House of Representatives.

2) ⅔rd majority of votes in the Senate

3) ⅔rd majority of votes in ⅔rd of all the state houses of assembly in Nigeria.

This is why, although voice votes are usually used in the National Assembly, electronic voting is used when they are amending the constitution, because they must count each vote to determine if they've gotten ⅔ majority.

I understood you at first.

In regard to referendum and secession, the two items are not in the current Constitution. They are to be added to the constitution. If they existed already and we are trying to modify them then we need 2/3rd majority to assent to the alteration, but this is not the case. There is currently no statute on referendum or secession.

The constitution authorizes National Assembly to make laws. They will make a law authorizing inclusion of referendum and secession. It is not alteration because the items are not there yet.

Does the constituion call for 2/3rd to pass a Bill, or simple majority?

States are not Constituencies. Land and People are iconified by a member in the House of Rep. That member is the voice of a Constituency (land and people).

We should be fighting for some level of autonomy in the name of regionalism or something similar where the center will not have so much power over the constituents. To that end, i don't care whether the north has more power or not as long as it doesn't carry much weight. Because as it is currently, the south is at the mercy of the North.

We should not fight for it. We have been doing that for decades. We have also been praying and fasting for decades. No more prayer.

Its time to vote at the Legislature.

I agree, this will require constitutional amendment. What is the procedure for amending the constitution and what kind of majority do you need to amend the constitution?

Three items are needed to go into the amendment.
1. referendum clause
2. right of secession
3. review on the exclusive lists.

Referendum is part of fundamental rights to liberty and freedom because it gives participants in the republic the choice between alternatives. The alternatives of restructuring is to keep a federated republic or a unitary republic. All the Southern regions and MB have expressed desire to go for a Federated Republic. These are four zones out of six. So in a vote I dont see how two zones will defeat the four that reject unitary government. Likewise if you look at the numbers from constituencies, 170 will defeat 104.

Even if you add MB to them for bonus they are still in minority. I don't know how we got bamboozled for so long into believing that South is minority. I dont know how it happened, but let's wake up with the new knowledge and do the right thing.

Southern Nigeria is the single democratic majority under our political system. Majority is not determined by land size or population but by legislative votes. Below is the total representation of Nigerians by constituencies. The idea of a majority by land size or population was promoted under military government. We are in a democratic government now. Our leaders in South need to stand upright and get a motion going and bring motion for restructuring to the House Floor. If the Reps vote on the issue majority will win the vote.

Majority rule is a decision rule that selects alternatives which have a majority, that is, more than half the votes. It is the binary decision rule used most often in influential decision-making bodies including all the legislatures of democratic nations.

Majority Rule
Democracy is defined in Webster's Encyclopedic Dictionary as:

Government by the people; a form of government in which the supreme power is vested in the
people and exercised by them either directly or through their elected agents . . . [A] state of society
characterized by nominal equality of rights and privileges.

What is left out of the dictionary definition of democracy is what constitutes “the people.” In practice, democracy is governed by its most popularly understood principle: majority rule. Namely, when something is voted on, the side with the most votes wins, whether it is an election, a legislative bill, a union-management agreement, or a shareholder motion in a corporation. The majority vote (or sometimes a plurality when there are more than two choices) decides the election or the issue. Thus, when it is said that “the people have spoken” or the “people's will should be respected,” the people are generally expressed through its majority.

The principle of majority rule has several functions. For one, it establishes a clear mechanism for making decisions. A majority of 50 percent plus one decides an issue or question. This ensures that when decisions are made more people are in favor than against. When decisions are made by slim majorities, the outcome may seem unfair to the “near-majority” that was on the other side, but that principle of majority rule is essential both in ensuring that decisions can be made and that minorities could not prevent the majority from deciding an issue or an election. Otherwise, a minority holding economic, social, and political power would use its power to dominate the majority of the citizens, thus instituting the antithesis of democracy: minority rule.

Matawalle should be emulating SW Governors, stop paying amnesty to criminals. Stop bribing rapists, murderers and kidnappers to stop crime. Exercise law. We have law, enforce law on criminals.

Malami is a native of Zamfara. Why, as the Minister of Justice, has he not directed Matawalle to stop abetting crime or face full enforcement of law by security forces?

....but he is threatening legal and lawful Amotekun with security forces.

Matawalle should copy other governors and stop aiding crime in Zamfara.

Nigeria does not have the military force to tackle bokoharam.

When bokoharam enters barracks, which has happened many times, they overtake the premise, confiscate hardwares and break into the armory and take whatever they want. Sometimes they spend two hrs in a barrack and leave with no casualty.

The mother of all breach happened when they entere Jaji, the reputably seat of military headquarters, and killed at random and made away with hardwares. They spent over an hour and did not loose a single life. No reinforcement came to aid Jaji.

Buhari has lost his mind to say this is the bokoharam he wants to defeat. I laugh in Daura language. grin

There is no land called Nigerialand. None!

Nigeria is a mere geographical sovereing space comprising of regions or lands that are composites of the country. The regions therefore have more power and authority together when in harmony. This union of powers is what extends power to Nigeria.

When the regions are out of harmony, naturally the power and authority owned by Nigeria should diminish, not get stronger.

This basis of majority power and its net effect is the structural foundation for democracy.

Under civilian administration the process of governing is harmonized with the powers of regional authority and makes the leader or leaders in a region more authoritative than the leader at the federal seat of adminisaration. We have six regions in Nigeria, their majority will be four. If four regions find harmony of purpose they should be able to invoke their joint authority and effect change as they so desire for the country. The remaining two regions by default.must follow behind them. If the other two do not find the new direction satisfactory to their values and purpose they can elect to cease membership in the sovereingty. This principle is the framework for secession.

So what has handicapped the leaders and administrators in the four regions of SW, SS, SE and NC, who have persistently for over 10yrs called for restructuring, from effecting their majority and seizing government from the other two?

One of the worse things to have happened to Nigeria is military rule, introduced in Jan 66. There is no point to detail or relive the pains of it but lets agree and accept that the event of July 66 and the bloodshed of 67 war has been the single instrument which has empowered NW and NE to become the master of deatiny over the majority four regions.


In an interview I read today Yakasai was saying was saying if SW does not disband Amotekun its a direct dare and test of federal security forces. Are Yorubas not in the security forces? Does he expect them to enter SW qnd start killing off their own people? Yakassai is pretty much calling for mutiny at best. Yoruba soldiers will revolt and sabotage the federal might. There is no way the political wish of 2 regions can be enforced on the other four when all four are heavilybrepresented in the security force that will be used for the enforcement. It is even a surprise that what NW and NE are planning and continue to voice out in threats of using security force to get their way has not been picked up by leaders of SW, SE, SS and NC as imminent threat and for them to take ownership of that same plot to crush NW and NE and use security force thereby install restructuring permanently....and by extension revoke the current constitution and institute a new one with secession clause.

The four majority regions can do this and heaven wil not fall. By not doing so, now that we do not have martial rule under military, under a permitting civilian government that recognizes the power of four consensus as the majority authority and decider of destiny for Nigeria over the other two dissenters, our leaders and administrators in the four regions have submitted themselves willingly to be enslaved by a minority.

Those desiring restructuring do not need permission to be granted by President or the other two regions to agree. The four agreeing regions are the authority for the nation. This is not APC/PDP, this is about people, their land, their culture and their survival.

If NW and NE feel they want to use security force, remind them the other four regions have more enlisted personnel and officers in the force and their combined majority will devastate the security force personnel from NW and NE combined.

Pass this to our leaders in SW, SS, SE and NC, leta get Nigeria restructured right away.
