For the project in question, he didn't underquote, his quotation was the highest amongst the 3 submitted.

HMMMM.... NEVER KNEW HIS QUOTE WAS THE HIGHEST...

But professionally, looking at the building on ground and the money spent so far on the carcass... He must have underquoted generally without him knowing...my opinion though....
proffessionaly... IGNORANCE IS NOT AN EXCUSE... HE...N3XT MUST STILL REFUND YOU SINCE THE QS WORKDONE VALUATION CALCULATIONS SAYS SO..

It's easy to paint unrealistic pictures and defraud people of their hard earn money.

Building construction is not magic and no amount of thinking out of the box can make you execute a 40m project for 30m (a tleast at carcass level). What you get is a guy without the most rudiments idea of how structural engineering works under valuing jobs that he knows will not work but still went ahead to do because he has the intention to defraud and run away with peoples money at the end of the day.

Contractor do have issues with client but such issues should not be as a result of incompetence or fraud and must be resulted mutually without being taking to the public. Because anyone using the social media space to solicit for work should never allow bad publicity that will sow seed of doubt in their mind.

i concur to the above submission... Underquoting to get the contract was where the problem started from.. Whether HE N3xt have a defrauding mindset from the begining.. i dont know.....

But this mistake of underquoting which clients thinks they are saving money need to stop...

When u see contractor quoting unrealistic amount to do your project... please dont get greedy enough to award the project at such unsubstantial amount....

At last we have a figured amount to this contractual argument..

The client "Somehow" requesting 2 Million Naira refund...

The Contractor "N3xt" willing to refund 1Million 70k Naira...

QS Femi... Your job left is to be more specific on the job description and amount the contractor didn't agree to... so he can be compelled to pay or not base on the evidences of picture or video...

This case is simple...

I do not want to divert attention from the ongoing conversation I'm having with him here.

But a short response to your points are as follows;

1) A performance bond from a reputable bank was asked to be provided but he couldn't meet up.

2) The payment method of the project was quite unusual due to unexpected inflation in the price of materials while the project was ongoing. In order to cushion that effect, we've to pay on advance so that materials could be bought and stockpiled on site.

There's no retention and LAD clause in the contract.

QS Femi.. I will advice the client to firstcollect the money N3xt claim he is owing the client for now to reduce the burden... More clarifications can be done later..
Many Construction management procedure have been flauted from the begining of the project ( Retention and bank bond).
Even if the case get to police... amicable settlement will still be the recovery mode...
My 2 cents...

Don’t forget we were having a fixed-sum contract and there was never a time this year that cement was sold for N3,000 or unit of 9 inches block sold at N200 which were the official rates in the contract and which I abided with up till termination of the contract.

So, I made request for an upfront payment to keep my part of the bargainwhich I did. that explains why I was in a rush to get the carcass off my hook in May.

Oga N3xt... Try get the cost chart of cement all through the year from a relevant cement company to validate your cement price point through the year 2021... (Dangote has it own online)

hello to the house, I earlier put my plan up here for criticism. I got some reviews, saydfact as promised, helped with a redesign at no cost. Attached is the 1st brief. I will love to get the input of the house.

One of the challenge he faced was that i told him to try to maintain the existing facade because the initial plan had already been approved by the estate body.
