PoliticsRe: El-rufai's Parallel Government With Buhari's Order, What Is The Implications? by N3TRAL: 11:55pm On Feb 16, 2023
Benbellamor:
The order of the supreme court is Not a judgement but 'an interlocutory injuction'.... as it stands, neither the police Nor the Army are served any cerified true copies to that effect.....moreso, CBN was not invited before the interlocutory order.... The president Veto carries more weight sir
1. The President cannot veto the decision of the supreme court. If the President could veto the judgment of the Supreme Court then Atiku would not pursue his election petition against Buhari because Buhari would simply discard a judgement ordering him to vacate office for not being validly elected by making a broadcast that he still remains president.

2. An interlocutory injunction of a competent court of jurisdiction is an interlocutory decision of the court. It carries the same weight as the final decision of the court. In fact, if it was granted by a lower court, an interlocutory decision of the court would require leave of court to appeal according to the CFRN 1999.

3. The Federal Government of Nigeria who is a Party to the case was served through the Attorney General of the Federation. I can't comprehend where service on the "Army" comes in here grin

4. In a democracy and in accordance with the CFRN 1999, the decision of the Supreme Court supercedes that of the President on this matter. It was abuse of power and unconstitutional for the President to make a broadcast contrary to the decision of the supreme court. A warrant of arrest would be issued against Buhari to face charges of contempt of court if the CFRN 1999 did not grant him immunity by virtue of his office.

5. El Rufai is reaffirming the decision of the Supreme Court that supercedes that of the President. He has not broken any law. This is a democracy and there are checks and balances. The only unconstitutional action and abuse of power is perpetuated by Buhari by virtue of his broadcast this morning.
PoliticsRe: Throwback: Ojukwu Speaks On His Plan To Contest For Senate Seat in Nigeria 1979 by N3TRAL: 9:34am On Feb 16, 2023
Nnamdi Kanu, Simon Ekpa and the rest are a downgrade of Ojukwu, honestly.

Ojukwu was fluent, articulated and strategic. He had an army under his control and was trained by the military of a world power yet he couldn't win the war.

With the current structure and setup of the Nigerian State, no secessionist stands a chance against the Nigerian government. A guerilla war will linger in the South East for a long time. The most it can metamorphose into is a country-wide genocide against Igbos.

Igbo people will remain part of Nigeria until other major ethnic groups let them walk away.

There's something peculiar about the unconscious systematic subjugation of the Igbo tribe politically that will be more pronounced in the shameful defeat of Peter Obi next week.

For the umpteenth time, Obi will not win:

Akwa Ibom State
Bayelsa State
Cross River State
Delta State
Edo State
Rivers State

The rhetoric that Igbos supported Jonathan is the most stupid claim. No one in the Niger Delta gives a Bleep about Jonathan's support.

Orubebe who protested Buhari's victory and wanted to stop collation on live TV in 2015 is now in APC.

Reno Omokiri whom Jonathan brought to limelight and even went on exile because APC won is Obi's greatest tormentor online.

PoliticsRe: Disgraceful APC Rally In Rivers: Is Wike Still Doubtful About The Peoples Will? by N3TRAL: 11:35pm On Feb 15, 2023
The fact remains that APC's presidential campaign in Rivers State had way more participants than Labour Party's campaign in the state. PSQUARE literally performed at an empty stadium.

Rivers State is a PDP State. The bulk of career politicians and shakers in the State are in PDP. They cannot attend a presidential campaign that has Tonye Cole, the APC Governorship candidate.

Wike has a successor in PDP and cannot sponsor a campaign that will enforce APC at all levels in the state.

However, the PDP structure in Rivers State will return Tinubu as President and then return their PDP Governorship candidate.

PoliticsRe: Breaking: Council Of State Backs New Cashless Policy by N3TRAL:
There is no greater oxymoron than the headline and the first paragraph.

The very fact that the resolution of the meeting was that the CBN should print more new notes means that the Council thinks Nigeria is not yet ripe for a cashless economy.

A cashless economy is one that is supposed to have less paper money in circulation and more electronic money transactions. How are you promoting a cashless policy by asking that more paper fiat money should be printed?

Dump headline!

Education in Nigeria has gone down the drain. Newspaper editors are no longer competent. Sad.

If the members of the council are not knowledgeable enough, at least experts working for news outlets should be.

An headline that best describes the outcome of the meeting should be :
"Council of State backs Naira redesign".
PoliticsRe: INEC - We Have No Option Than To Work With MC Oluomo Led Park Committee. by N3TRAL: 3:06pm On Feb 10, 2023
Why it seems everything is complicated when it's not is the loud minority that started following national politics after endsars in 2020.

Since 1999, INEC has always partnered with registered transport unions to distribute election materials to tens of thousands of polling units across the country.

Telling them not to do that is like telling them that NYSC members and university lecturers should not be adhoc staffs of the commission because almost all the youth corps members and professors are partisan.
It's another way of saying that Elections should not hold this year.

Let's face it, INEC as an institution cannot afford to employ hundreds of thousands of employees and pay them for four years for them to work only on two weekends of an election year. About 80% of INEC staff that will run the elections are temporary staffs who are ASUU members, NYSC members, Transport Union workers, Security operatives and a few undergraduates if there are vacancies NYSC members cannot fill.

Jogs1900:
What of if there was no judgement on the 15th? Will the injunction earlier granted elapse? Can the court still extend the implementation date on the 15th?
The injunction is an interlocutory decision, it subsists pending the determination of the suit to protect the res.

In simpler terms, the injunction will be binding on the parties until the Supreme Court decides on the matter.

For instance, If a State Government wants to demolish a building and the owner gets an injunction from a high court of the state to prevent the demolition, the injunction will last until the high court decides whether the Government has the right to demolish the building or not because if the Government destroys the building before the judgement of the court, the government will not be able to rebuild the exact building if the court rules in favour of the owner of the building.

The central bank of Nigeria and the FG will not be able to repair the damages that will occur because of the rejection of old naira notes if the judgment favours the State Governors at the end. The injunction will therefore subsist till the matter is determined.

If judgment is given in 2030, That's when the injunction will elapse grin

In his ruling, the Justice revealed that after careful consideration of the motion exparte, this application is granted as prayed.

An order of Interim Injunction restraining the federal government through the Central Bank of Nigeria (CBN) or the commercial banks from suspending or determining or ending on Feb. 10, the time frame with which the now older version of the 200, 500 and 1,000 denomination of the naira may no longer be legal tender pending the hearing and determination of their motion on notice for interlocutory injunction.”

PoliticsRe: Cbn And New Naira: Have You Asked Yourselve? by N3TRAL: 9:12pm On Feb 08, 2023
That's a big lie:

When COVID-19 happened, the FG and the Governors immediately formed a taskforce that saw billionaires and corporations operating in Nigeria donate billions of Naira to salvage the needs of the "poorest of the poor" as they were then called. The items donated were distributed to the states. The peak of Covid-19 in Nigeria was April 2020. Distribution of the items started in June 2020 after the first phase of lockdown relaxation. The warehouses were looted in October 2020. You lots speak like the donations stayed in the warehouses for more than 3 months.

Concerning the last ASUU strike, the Minister of Labour had more than 5 tarry meetings with the Union. The speaker of the house of representatives intervened more than once. The Federal Government took ASUU to court and won. They even threatened to register another union to displace ASUU. All hands were on deck to see an end to ASUU strike. Even Tinubu met with the Union.

The same people saying that CBN should not relax its policies because of elections are the same people that encouraged ASUU not to return to classes so that students can feel pain and vote against APC.

I can go on and on.

When most of you talk about compassion and humanity, I laugh because I understand that deep in you heart you do not care if a million people die of hunger as long as it satisfies your fantasies of winning the election.

Nigerian elites are more compassionate - facts.
PoliticsRe: Naira Redesign: Can States Sue The FG And CBN Over Monetary Policy? by N3TRAL: 8:42pm On Feb 08, 2023
Penguin2:
Kaduna, Kogi and Zamfara States have taken the Federal Government and the Central Bank of Nigeria to court and gotten an interim injunction restraining the implementation of the February 10th deadline for the withdrawal of old Naira notes.

The judgment has elicited myriads of reactions with most people questioning if the Supreme Court has the jurisdiction to entertain the case and grant such injunction which has made it imperative to look critically at the entire case and its merit.

First, it is pertinent to state that the present policy of the CBN falls under Currency, Coinage and Legal Tender.

Now, Currency, Coinage and Legal Tender is item number 15 on Exclusive List of the constitution. What this means is that only the Federal Government has powers over anything regarding monetary and currency policy and States or sub nationals or federating units have no rights or locus whatsoever to dabble into it.

For clearer understanding, the only time the states can take the Federal Government to Supreme Court are only on issues in the Concurrent List where both the FG and State Governments have power of legislation.

So, in a nutshell, the case instituted by Kaduna, Kogi and Zamfara States at the Supreme Court is standing on faulty foundation as the Supreme Court has no jurisdiction over the case.

The proper thing to do would have been to approach a High Court for Judicial Interpretation of the extent of powers of the CBN and FG as regards currency, coinage and legal tender.

Nlfpmod
Mynd44
Fergie001
Garfield1
Ejimatic
It doesn't work that way.

The exclusive and concurrent lists are more about legislative competence. For instance, it is unconstitutional for the House of Assembly of Kaduna State to pass a law to create a Central Bank of Kaduna State that issues a Kaduna State currency. It is unconstitutional for Abia State to make a law that states that 1 year notice must be given by the CBN before new notes are enforced.

The case of A.G Abia State & ors V. A.G Federation is a classical example that the Supreme Court can exercise its original jurisdiction vested upon it by Section 232 of the Constitution of the Federal Republic of Nigeria 1999 irrespective of what list the subject matter of litigation falls under in the second schedule to the CFRN 1999. In that case, littoral State Governments in Nigeria sued the Federal Government regarding resource allocation and resource sharing. The issues contained elements from the exclusive list especially whether they were to receive allocation for petroleum extracted offshore.

The States won the Federal Government in the case.

My guy , this your analogy is both bogus and unnecessary. There is no going around this one. Tinubu presents with many questionable incidents around him. There is something hideous about Tinubu, let's be honest. His Primary and Secondary classmates are all missing or they are just silent. People have evidence Bola Ahmed Tinubu is not his real names. That's very worrisome, he was involved in some narcotics deal in the U.s. where he forfeited over 500,000,000 us dollars. Then he operated over 10 bank accounts. These are all shady and security risk.

He became the governor and made himself an Emperor and cornered the common patrimony of the Lagos people. Nobody dare mess with the Jagaban of Lagos! His agberos will kill at will and he can outspend any candidate because he has too much money in his hands. He bought the trust of some northern governors with money and felt they owe him one.

Also , the man is having what might seem to be signs of early dementia. He cant believe what is happening before his eyes. He forget this is a different general generation with different times.

Looking at Obi , he is an easy sell. Took Anambra from 26 position in WAEC to number 1 for three consecutive years and remained at top 3 until last year when they dropped to 5th position. That's about 15 years of Academic excellence. You Lagos Tinubu can't touch that. Let me stop bgg
All you're saying is like me saying I can't support Obi because he's Ipob . He has always defended Ipob or because he said that ESN was created by the Governors of the South East. Those are allegations and not true. I can't judge Obi with those narratives because they are put forward by the opposition. In fact, if not for anything, it was during Obi's tenure that almost 100 corpses of suspected MASSOB members were dumped in a River in Anambra. When you connect those dots, you will conclude that he may not be a secessionist. I have never called OBi an Ipob member like others.

Tinubu graduated from Chicago State University, he returned and served Nigeria as a NYSC member. The pictures of those two certificates are enough. The files of the court case in the United States shows that he was running an accounting company in America. The other narratives are pushed by blackmailers, opponents and haters. There's nothing mysterious about Jagaban.

If forfeiture was for drug dealers El Chapo, Pablo etc would drop a billion dollars to be free.

Tinubu was never a drug dealer. As a lawyer with experience in Judicial systems who has actually read the files that were made public, I explained in simple terms what happened in the case.
