By Ikechukwu Nnochiri ABUJA – The Economic and Financial Crimes Commission, EFCC, this morning, docked the former governor of Benue State, Gabriel Suswam before the Federal High Court in Abuja over a nine-count criminal charge bordering on alleged money laundering. Suswam was arraigned before Justice Ahmed Mohammed alongside his erstwhile Commissioner for Finance, Mr. Omodachi Okolobia. They were alleged to have looted about N3.1billion, being proceeds of shares owned by the Benue State government and Benue Investment and Property Company Ltd. The offence the duo allegedly committed are punishable under section 15(3) of the Money Laundering (Prohibition) Act 2011 as amended in 2012. Meantime, shortly after the accused persons pleaded not guilty to the charge against them, they were released on bail by Justice Mohammed to the tune of N100m each. The court further ordered the accused persons to produce one surety each, adding that such person must be a civil servant not below grade level 12 in either federal or state employment. According to the court, the sureties must be ready to depose to an affidavit of means. Nevertheless, Justice Mohammed directed that in any event that the accused persons fail to secure a civil servant to stand surety on their behalf, he said they should produce someone with national honour to stand on their behalf. Meanwhile, the case has been adjourned till December 8 and 9 for trial source:www.vanguardngr.com/2015/11/alleged-n3-1bn-fraud-ex-benue-gov-suswam-secures-n100m-bail/ |

From George Onyejiuwa, Owerri The Nigeria Bar Association (NBA) in Imo State yesterday declared that Governor Rochas Okorocha has no constitutional power to slash wages of magistrates in the state. The NBA also stated that magistrates were not under the executive arm of government and that it was erroneous to regard them as staff of the ministries under the executive arm. A statement signed by Stanley Imo, Christian Ikwuoma, Max Nwokenta and Chris Ugwuorji branch chairmen of Owerri, Orlu, Okigwe and Mbaise, respectively stated: “The Bar in Imo state, hereby, condemns in strong terms and also rejects any purported new salary structure unilaterally formulated by the Imo State Government for Imo State magistrates. The Bar further states and insists that the current salary structure for magistrates in the state be maintained without any reduction whatsoever.” The statement further read: “There has not been any increment in the salaries of magistrates by the Owelle Anayo Rochas Okorocha-led administration in Imo State. In fact, the existing salaries and allowances paid to magistrates in the judiciary have been in operation since 1994. Under the Military Administration of Navy Captain J.N.J Aneke allowances such as security and transport were provided for magistrates. Successive administrations of Udenwa and Ohakim improved on the allowances by adding other allowances such as upkeep, hazard, robbing, medical, journal and furniture. All these allowances have been harmonised as personal emoluments and taxable items. This is clearly evidenced in a circular written by the Head of Service of the state in May 2013. The leadership of NBA in Imo State insisted that members of the legal profession should not be used as scape goats for whatever misfortune that may have befallen the finances of Imo State in the recent past. They maintained that “ contrary to the propaganda being fed to Imolites, it is incorrect and fallacious to state that the salaries of magistrates in the state are the highest in the federation. It is on record that magistrates in Akwa Ibom, Lagos,Bayelsa, Rivers states amongst others earn higher salaries than magistrates in Imo. Most of these states are oil producing states like Imo State. They added, “many states that don’t have the resources we have are comfortably paying their workers. What is then the problem with Imo state.” source:sunnewsonline.com/new/you-cant-slash-salaries-of-magistrates-imo-nba-tells-okorocha/

The Peoples Democratic Party has asked President Muhammadu Buhari to send an executive bill to the National Assembly if he is serious about electoral reforms. The opposition party was reacting to the president’s lamentation on Monday that it was not enough for election tribunals to nullify elections and order for rerun, but those responsible for flawed elections should no longer go unpunished. Buhari made this view known after he administered oaths of office on the National Chairman of the Independent National Electoral Commission, Prof. Mahmood Yakubu, and five INEC national commissioners at the Presidential Villa, Abuja. “It is not just enough for an election to be cancelled and a new one ordered. It would be much better if all whose action or inaction led to the cancellation of such election to be investigated and if culpable prosecuted, whether they are individuals as candidates or party agents; institutions, such as political party, electoral body; or public officers as electoral staff or security agents. “Similarly, perpetrators of electoral violence and thuggery should not be spared. Unless our system stops covering up all forms of electoral malpractices, we can hardly get it right. No system endures with impunity”, the president was quoted as saying. Reacting to the statement, Deputy National Publicity Secretary of the PDP, Abdullahi Jalo, said Nigerians had not forgotten that it was a PDP administration that made the necessary adjustments to the Electoral Act that ushered in improved elections, beginning from 2011. “The President more than everybody else knows what to do concerning such matters. If he desires more sanctions for electoral offenders he should forward an executive bill to the National Assembly for the laws to be amended”, Jalo said. source:www.informationng.com/2015/11/electoral-reforms-stop-complaining-and-forward-executive-bill-to-nass-pdp-advises-buhari.html |

Governor Ayodele Fayose of Ekiti State has called on the National Judicial Council to probe the Taraba State governorship election tribunal’s judgment that sacked the state governor, Darius Ishaku, and pronounced Aisha Alhassan of the All Progressives Congress, APC, as winner of the April 2015 governorship election in the state. According to the governor, “such judicial rascality and conspiracy displayed in Taraba State must not be allowed to go unquestioned”. Fayose said having observed the Taraba State judgment and others involving the Peoples Democratic Party, PDP, it appeared there were different laws being applied to similar cases by the election tribunal. In a statement signed by his spokesperson, Lere Olayinka, the governor said that “instead of calling for Fayose’s head that they can never get, the judiciary must in the interest of democracy and rule of law purge itself of cash and carry judges that are daily giving tainted and contradictory judgments”. Gov. Fayose, who said even though parties to the case have the option of appealing – up to the Supreme Court, “those who truncated democracy in Nigeria through military coup must not be allowed to truncate democracy again through manipulation of a section of the judiciary and the Independent National Electoral Commission, INEC. “There are no gods in the judiciary and if Ghana, a smaller country could suspend 22 judges over bribery allegation and probe 12 others, the NJC must not play ostrich to these Salamic judgments being delivered by tribunal judges. “Those judges, who gave the Taraba State judgment, which is totally against the Electoral Act 2010 (as amended) and the one who took N15million bribe in Yobe State must be investigated by the NJC”. While also accusing the electoral body, INEC, of being part of the conspiracy against the PDP, Fayose wondered why the commission did not raise any objection to Governor Ishaku’s participation in the election when his name was submitted as PDP candidate, only for the commission to now cook up report against the PDP at the tribunal. “There are serving governors and senators in this country, who took part in the All Progressives Congress (APC) presidential primary election. After failing to pick the APC presidential ticket, their names surfaced as gubernatorial and senatorial candidates of APC in their respective States. Can INEC tell Nigerians when it took part in the process that produced those senators and governors as APC candidates? “There are also those who left PDP to become APC candidates, can INEC tell Nigerians where the primary elections that produced them were held? “This double-standard and conspiracy from INEC and a section of the judiciary against the PDP must stop because it is becoming more obvious that those who used the military to truncate democracy in 1983 are out to use a section of the judiciary to truncate our hard earned democracy”, he said. The Muhammadu Buhari administration will strive to deliver on its campaign promises to the people of Nigeria, the Vice President, Prof. Yemi Osinbajo (SAN), has assured. Osinbajo gave the assurance on Saturday at Ikenne, his home town where he was the Special Guest of Honour at the 39th Ereke Day celebration. Ereke is an annual festival organised in Ikenne, Ogun State, as platform for addressing the town’s developmental challenges. Osinbajo pointed out that the opportunity to address the nation’s numerous challenges and reposition the country for greatness is now. He said that the All Progressives Congress (APC) administration would keep its promises, saying “the President has no other business besides fixing the problems of the country”. He cited corruption and stealing as some of the reasons why things had gone wrong in the country, adding “but it is time now to fix all that have gone wrong”. He restated the commitment of the Federal Government to address the challenges facing the country. He said: “we have to deal with unemployment of young people; we have to deal with infrastructure; we have to deal with bad roads; we have to restore power, the challenges are many. “But I want to assure you that every single day that President Buhari spends in Abuja; that I spend in Abuja, we will work hard to achieve the promises we have made. “You can be sure of an honest and transparent government; you can be sure of hard work. “You can be sure that everything we promised, we will do”. Osinbajo, who also spoke to newsmen at the end of the event, said that President Buhari was working daily on how to solve Nigeria’s economic challenges. “The President you know has no other business; he is not doing anything else; this is his life commitment. “And he has said this is what he is going to commit his entire life to, to ensure that the economic problems are solved, employment opportunities are created”, the VP said. He called on the indigenes of Ikenne to re-dedicate themselves to the visions of their elders such late Chief Obafemi Awolowo former Nigerian nationalist and Premier of the old Western Region. source:www.informationng.com/2015/11/buhari-has-no-other-business-besides-fixing-nigerias-problems-osinbajo.html |

By Rotimi Ojomoyela Ado-Ekiti—Indication emerged, weekend, that the Federal Government will soon disburse the over $2 billion remaining in the Excess Crude Oil Account, ECA, to state governments to fund capital projects in the states. Ekiti State Governor, Mr Ayodele Fayose, gave the indication over the weekend while featuring on a radio/television programme, Meet Your Governor, in Ado-Ekiti. In a statement yesterday, the governor’s Chief Press Secretary, Mr Idowu Adelusi, said the step would be taken for the state governments to be able to embark on or complete some capital projects. The governor, who added that Ekiti could get about N10 billion from the fund, said: “Nothing is going into the Excess Crude Oil Account again because oil is selling lower than the envisaged price in the international market. That has badly affected all of us. He explained that the 2015 budget for Ekiti State was based on oil selling at $65 per barrel, but it sells for a little over $40 now. “That has left our budget performing only in the area of Recurrent Expenditure. You know that I call a spade a spade. Ekiti is expecting about N10 billion when the ECA fund is shared. When it comes, I will tell everybody. I don’t hide things. “The capital projects that we have embarked upon since we came on board are being executed because we are prudent, transparent and open, and also because we leverage on goodwill with corporate bodies,” he said.Fayose said that considering the tough economic situation in the country, there was no way people could dodge paying taxes, rates and levies, adding that government would be crippled without finances. He implored butchers to stop protesting the N1,000 levy imposed on them for the slaughtering of cows, warning that anybody caught killing cows in unauthorised places would be fined N50,000. “It was during my first tenure that we built the abattoir and the place is not maintained. We have to maintain the facility for hygiene, provide where cattle are kept, provide water and yet they are complaining. The additional cost will be spread to others,” he stated. On the reconstruction of Erekesan Market in Ado-Ekiti, the governor gave the assurance that owners of the former shops would be given top priority in the allocation of shops when the new market is built. “We have done the accreditation of traders through the records with which we paid them compensation. So, there is no need to fear,” he added. source:www.vanguardngr.com/2015/11/fg-states-to-share-2bn-excess-crude-fund-fayose/ |
The All Progressives Congress, APC, has described Saturday’s judgement of the Taraba State Governorship Election Petition Tribunal as so far theclearest indication that the Peoples Democratic Party, PDP, has started harvesting what it sowed in its years of impunity and recklessness. It then insisted that the party should blame itself for whatever tragedy which has now befallen it and stop attributing the judgement to a supposed manipulation from the Presidency. The benefiting party, in a statement issued in Lagos on Sunday by its National Publicity Secretary, Alhaji Lai Mohammed, stressed that the PDP has always been a party of anything goes, hence it is a matter of time for the party to come to grief, first by tumbling from the pinnacle of power and now by losing, incrementally, whatever remains of its crumbled empire. ”President Muhammadu Buhari as well as his party, the APC, are strong believers in the rule of law, as against the rule of impunity, hence will never manipulate the judiciary for whatever reason. ”The PDP is clearly aware of this, but has chosen to blame everyone but itself for the fate that has befallen it. The PDP should have known that it will pay for its years of impunity and recklessness. For this party, the chicken has now come home to roost,” APC said. The party continued that if the PDP is not blaming the judiciary – its favourite whipping boy, it is blaming the APC, the Presidency or even Nigerians for its plight, warning it to stop shifting responsibility. The statement reads, ”PDP should leave the judiciary, the Presidency and the APC alone and accept responsibility for its actions. From the judgement of the Tribunal, it is clear that the impunity of the PDP cost it the election. Not only did the party breach Section 78 (b) (1) (2) of the Electoral Act concerning the organisation of party primaries, it was not even deemed to have participated in the April 11, 2015 governorship election in Taraba State in the eyes of the law. ”Apart from not complying with the Electoral Act, the election of the PDP candidate, Mr. Darius Ishaku, in the purported primaries in Abuja, was done after the stipulated time for party primaries had elapsed, according to theTribunal. It is thus clear that the election result in Taraba was not annulled for anyother reason but the impunity and recklessness that permeated the life and times of the cadaverous PDP. ”It is noteworthy that this is not the first time the court is ruling against PDP’s impunity of violating its own constitutional provisions and the Electoral Act with regards to ensuring internal democracy in the conduct of primary elections. ”The first landmark judgment came from the Supreme Court when it ruled against PDP’s impunity in 2007 and ordered that Rotimi Amaechi be installed as Governor of Rivers instead of Celestine Omehia who was illegally imposed. Secondly, the Supreme Court had also ruled against PDP in the case of Ifeanyi Ararume when the party took his mandate as validly elected Governorship candidate and handed it over to another aspirant. ”It is instructive to note that these judgments took place while the PDP was in control of the Presidency. The opposition parties then never questioned the integrity of the judiciary by making wild and weighty allegations as the PDP is doing now,” it stated. Warning that the PDP should blame itself for its gross impunity with regards to the conduct of primary elections forTaraba State, the governing party asked,“if all political parties, including the APC which was then in opposition, could hold their primaries in the state, why would the PDP that was in control of the State Government come down to Abuja for its primaries against the provisions of the Electoral Act and the PDP constitution. source:dailypost.ng/2015/11/08/stop-shifting-responsibility-taraba-ruling-was-outcome-of-your-impunity-apc-mocks-pdp/

The Governorship Election Petition Tribunal for Taraba on Saturday nullified the election of Taraba Governor, Mr Darius Ishaku, of the Peoples Democratic Party (PDP). The Tribunal, sitting in Abuja, declared the candidate of the All Progressives Congress (APC) and a Minister designate, Mrs Aisha Alhassan, as the winner of the April 11 governorship election in the state. In a judgment the three-member tribunal held that Ishaku was not validly nominated as candidate of the PDP and therefore was not qualified, ab-initio, to contest the governorship election. Specifically, the tribunal held that the governorship primaries purportedly conducted by the PDP in the state was done in violation of section 78 (b) (1)(2) of the Electoral Act which guides parties nomination to the position of governorship candidate. It held that contrary to the provision of the section, PDP conducted the purported primaries at its national secretariat, Wadata Plaza, in Abuja with no clear delegation from the local government areas in the state. The tribunal sustained the testimonies of INEC head of election monitoring that the commission was not aware of any primaries conducted by the party in line with the provision of the electoral act which produced Ishaku as the party’s flagbearer. Section 78 (b) (1)(2) of the Electoral Act states: In the case of nomination to the position of Governorship candidate, a political party shall where they intend to sponsor candidates: (i) hold special congress in each of the Local Government Areas of the States with delegates voting for each of the aspirants at the congress to be held in designated centres on specified dates. (ii) the aspirant with the highest number of vote at the end of the voting shall be declared the winner of the primaries of the party and aspirant’s name shall be forwarded to the commission as the candidate of the party, for the particular state. The tribunal held that the defence by the PDP that the primaries were shifted to Abuja because of security challenges in the state was rejected by the tribunal. It sustained the evidence of the INEC official that there was no primaries election in the state and the emergence of Ishaku through the purported election in Abuja was after the statutory stipulated time for party primaries had elapsed. It held that since Ishaku was not duly sponsored by the PDP, the party had no candidate in the governorship election in the eyes of the law. The tribunal therefore voided the votes of the PDP and Ishaku in the election saying ``it is a waste’’ and declared the APC and its candidate, which came second, as the valid winner of the April 11 election. Reacting to the judgment, counsel to APC, Abiodun Owonikoko, SAN, said the judgment was a landmark being the first time the election of a governor will be nullified on the doctrine of wasted vote. He said with the judgment, the era of impunity in party primaries was gone and it would be a lesson not only for PDP but all political parties. On whether Ishaku will vacate the seat immediately, Owonikoko said the judgment ``is not the end of the road, there is opportunity for all the parties to explore whatever the grievance they have’’. Owonikoko added that if the governor or the party did not appeal within 21 days, Alhassan will be sworn-in as governor. NAN reports that counsel to the PDP were not available to comment on the verdict of the Tribunal as they all rushed out of the venue after the judgment. The national President of Trade Union Congress, TUC, Comrade Bobboi Kaigama, has stated that Nigerians are still waiting for the change President Muhammadu Buhari promised them during the election campaign. Speaking while addressing construction workers at the 10th Triennial National Delegates Conference of the Construction and Civil Engineering Senior Staff Association, CCESSA, in Abuja, the labour leader said government should know that the change mantra of the ruling All Progressives Congress, APC, was not only about anti-corruption war. He said the change should also tackle unemployment, insecurity and among other things. Also speaking at the event, Managing Director of Julius Berger Nigeria limited, Engr. Detlev Lubasch, noted that going by the present economic realities in the country and the huge indebtedness construction companies were facing, such companies were unable to meet up with their financial obligations. Lubasch, who was represented by a staff of the Human Resources unit, Moses Anietie, said: “Comrades, our industry is in dire straits, occasioned by non-payment for ongoing and already completed jobs. “As you all know, the construction industry is majorly engaged by the governments: federal, state and local, with little patronage from corporate entities and private individuals. In view of this, any distortion in the income equilibrium of our major clients will definitely affect the income and cash flow of the construction companies. “As a consequence of this, construction companies are unable to sustain the existing structures in terms of meeting its obligations to staff and subcontractors. lt, therefore, became imminent that there must be staff reduction as well as other cost saving measures.” source:dailypost.ng/2015/11/06/we-are-still-waiting-for-the-change-buhari-promised-us-tuc/ |
