Politics › ‘you’ve 15 Days To Respond To Suit’, Appeal Court Tells Chime by nerodenero(op): 6:58pm On Nov 08, 2013
‘You’ve 15 days to respond to suit’, Appeal Court tells Chime

Abuja – The Court of Appeal on Friday gave Gov. Sullivan Chime 15 days to file his respondent brief against an appeal challenging his position as governor of Enugu State.

The appellant, Chief Alex Obiechina, had approached the court in Abuja to challenge the Federal High Court’s decision to decline jurisdiction on his suit against the governor.

Justice Monica Dongban-Mensem, who presided over the case, gave the order following Obiechina’s application for the abridgment of time to hear his appeal.

“We understand the rules of the court give the respondent 45 days within which to file his respondent brief, but sacrifice must be made to ensure accelerated hearing of the appeal.

“We appreciate the magnanimity shown by chief Mrs Anayo Offiah (SAN), counsel to the governor, in accepting to concede to a lesser period to respond to the appeal,’’ she said.

The panel further granted a motion filed by Mr Oba Maduabuchi, counsel to the appellant, seeking the hearing of the appeal without responses from INEC.

“In the circumstance, the appellant’s application seeking the continuation of the appeal without brief from INEC is hereby granted.

“This is more so that INEC has not found it pertinent to file a motion seeking for extension of time to respond appropriately,’’ she said.

The appellant had asked the court to invoke the Court of Appeal Act to assume court of first instance and hear both the appeal and the main suit.

He is contending that the trial court was in obvious error when it held that he (the appellant) did not participate in the governorship primaries of the PDP on Jan.12, 2011.

Obiechina had argued that the governor became the party’s candidate in the 2011 election through fraudulent means and therefore prayed the court to reverse the trend.

Dongban-Mensem fixed Dec.5 to hear the appeal. (NAN)

Celebrities › Omotola To Be Honoured By Kinsmen by nerodenero(op): 4:23pm On Nov 08, 2013
Nollywood’s leading Actress, Omotola Jalade Ekeinde has never had honours, lurking too far away from her as every single stride the sexy actress makes seems to have a golden lining of honour about it. She has won virtually every award there is to be won in the movie industry within and outside the shores of the country and the only vacuum in her list of honours, which is one from her State of origin, is now on the cards.

The gist reaching WG has it that the traditional council of the Ondo kingdom has decided to confer on the actress a high-profile chieftaincy title in recognition of her outstanding achievement in the movie industry and also as an illustrious daughter of Ondo State.

Omotola, who was named as one of the most influential 100 people in the world by TIME magazine recently has become an human rights advocate and only a couple of days ago was presented with the Ebony Vanguard Award for her long standing achievements in acting, in Birmingham, United Kingdom in the presence of leading British film-makers.

Crime › Man Found Sleeping With Dead Wife Cleared Of Murder by nerodenero(op): 4:09pm On Nov 08, 2013
A court in Kenya has acquitted a German man who was arrested while sleeping with the decomposing body of his Kenyan wife and charged with her murder, court officials said Friday.

The court in the coastal city of Mombasa ruled on Thursday that there was insufficient evidence to convict the man, identified in court documents as Michael Bibcke Robel, 43, from the city of Hamburg, of murdering Esther Elsi Igoki Munyi in December 2009.

The court heard how the accused was found sleeping next to his dead, decomposing wife at their home near Mombasa after police were alerted by the smell. The accused had also stabbed himself in the chest in an apparent failed suicide attempt.

“It is pertinent that under cross-examination by the defence counsel, the doctor did concede that no obvious injuries were seen on the neck. There was no strangulation,” Judge Maureen Odero said in her ruling.

She also ruled that there were no eyewitnesses to the events, and that an autopsy failed to establish the precise cause of death beyond that of asphyxia — partly because the body was decomposing when it was discovered.

Judge Odero said the fact the man had remained with his wife’s decomposing body for several days was further evidence of his mental instability, supporting a finding by doctors that he was suffering from mental illness.

“A person of unsound mind is incapable of possessing malice aforethought required to prove murder,” the judge said.

Court officials said the man was handed over to a German embassy representative after the trial. The German embassy in Nairobi could not immediately be reached for comment.(AFP)

There is no better time to amend the law than now. The rate at which adults (male) defile infants and mature ladies is alarming. There is need to put a law in place that we not only serve as deterrent to others but also discourages such devilish acts.
Politics › Lawmaker Advocates Death Penalty For Rapists by nerodenero(op): 2:54pm On Nov 08, 2013
Kaduna - A member of the Kaduna State House of Assembly, Alhaji Muhammad Ali on Friday called for the amendment of existing laws on rape, to provide for death penalty on anyone convicted of the offence.

Ali, who represents Kawo constituency, made the call in an interview with the News Agency of Nigeria (NAN) in Kaduna.

He noted that Section 283 of the Penal Code Law only provided a maximum of life imprisonment for convicted rapists, adding that the law should be amended to carry the maximum penalty.

According to him, most rapists ended up with lighter sentence due to bottle necks in court processes.

“Rapists are not treated the way they should be treated due to one reason or the other in the enforcement of the law.

“Life imprisonment is not even enough for them; anybody caught raping a child or woman should face the firing squad. It is the only way to safeguard and sanitise the society,” the lawmaker contended.

Ali attributed the increasing cases of rape in the country to negligence on the part of parents, urging them to take their parental responsibilities more seriously.(NAN)

boay: Good points. Thanks. But assuming you are the minister of education, can you consider abolishing it to increase the standard of education?
Rome was not built a day. America's greatness didn't start today, it started long time ago. It is a gradual process. There will be long term plan to overhaul the whole system. Present Universities needs to be upgraded and equipped to international standard and more Universities will be built. More lecturers with proven credentials would be employed over the years. As I said, it is a gradual process but in the end, it will be abolished.

I remembered "my pikin" case and how it all ended. The owners were jailed with minimal years to serve. The damaged caused and the sentence given were not commensurate. The same thing will happen in this case. If a drug could killed many Nigerians and the sentences were minimal, only God knows how this matter would be treated. The fact is the judicial system needs to be overhauled or the section responsible for trying such cases need to be reviewed. I think a stiffer penalty needs to be meted out to offenders so as to serve as deterrent to others.
Education › Re: Should Part-Time Study Be Abolished? by nerodenero: 12:55pm On Nov 08, 2013
It all depends on the dimension you are looking at it from:
1.It generate more revenues for the University.
2. Most graduates from Part-time programmes to an extent do not really know the rudiment of the course of study owing to short time required for such programmes.
3. The high demand for tertiary education led to the introduction of part-time programmes and this isn't a bad idea.
4. Most students that enroll for such programmes are not necessarily the working class. It affords people the opportunity to school and work at the same time.
There are two sides to the coin. I cant say yes and at the same time, I cant say no. The best thing is that more funds should be committed to the Educational sector such that both infrastructural and manpower would be made available to absolve the ever-demanding masses seeking tertiary education.
