THE Federal Government has directed the Debt Management Office (DMO) to commence payment of fuel subsidy expenditures incurred by marketers whose claims had been verified by supporting Sovereign Debt Notes issued by Petroleum Products Pricing and Regulatory Agency.
A statement signed by Senior Special Assistant (Media), Paul Nwabuikwu to the Coordinating Minister for the Economy and Minister of Finance, Dr. Ngozi Okonjo-Iweala, said the order was issued to reinforce the Federal Government's determination to ensure that there is no disruption in fuel supplies across the country.
Okonjo-Iweala said following the report of the Presidential Committee headed by Mr. Aigboje Aig-Imoukhuede, it was clear that some marketers also owed government significant sums of money which will be paid.
The minister said in view of the assurance of funds to meet marketers' claims there was no reason for marketers or other stakeholders to go on strike because government is addressing subsidy payment issues in a structured way that will continue to protect the interests of the country and those of genuine marketers.
It will be recalled that payments based on verified claims resumed after the June meeting of the Federation Accounts Allocations Committee (FAAC) when payments totaling N17 billion were made.
To prevent over payments, verification of claims is a cornerstone of the procedures adopted by the Federal Ministry of Finance for managing fuel subsidy payments.
The oil marketers have over the past few weeks been threatening to suspend fuel imports if government refused to pay some of their outstanding fuel subsidy claims, stressing that the high cost of bank credit was eating up their profit margins. http://allafrica.com/stories/201207271018.html |

A Lagos High court sitting in Ikeja on Thursday granted bail to the sons of the former and serving national chairman of the People’s Democratic Party(PDP), Ahmadu Ali and Bamaga Tukur, and some other suspects indicted in the oil subsidy scam.
Mamman Nasir Ali, Mahmud Tukur, and two others were granted bail by Justice Adeniyi Onigbanjo in the sum of N20 million each with two sureties in like sum, one of the sureties according to the court must be a blood relation and another a level sixteen officer in the Federal or State civil service.
The court also held that one of the sureties must own a property worth N100 million in Lagos and that the title of the said property must be registered with the state land registry and the sureties must present to the court’s registrar a three years tax clearance.
Justice Onigbanjo also ordered the defendants who also included Ochonogor Alex and Christian Taylor to deposit their travel passports with the Economic and Financial Crimes Commission (EFCC), which can only be released to them on the orders of the court.
Alao to remain in custody
Though all the accused persons are free to go home upon fulfilling the terms of the bail, Abdulahi Alao, the son of Ibadan businessman and politician, Arisekola Alao would, however, remain in the custody of the EFCC until the 1 August when another judge, Justice Habeeb Abiru, handling the second charge filed against him by the anti-graft agency will determine whether to grant him bail or not.
His bail application for the trial which he and his company, Axenergy Limited are being arraigned, could not be heard because the EFCC pleaded for more time to respond to the application. He is facing a seven count of obtaining N1. 8 billion under false pretence
Mr Alao in the charge was specifically accused of conspiring to obtain N1. 8 billion from the Federal Government by falsely representing that the sum represented subsidy paid to him under the Petroleum Support Fund for the importation of 20, 014, 627 liters of Premium Motor Spirit (PMS) which he falsely claimed was purchased and imported to Nigeria from Mercuria Trading N.V, vide MT Gavros ExMT Nippon Princess.
In the second case before Justice Onigbanjo, Mahmud Tukur, Ochonogor Alex, Abdulahi Alao and Eterna Oil and gas are facing a nine count of obtaining a sum of over N5 billion under false pretence.
They were said to have conspired to obtain the sum from the Federal Government by falsely representing that the sum represented subsidy paid to Eterna Oil and gas under the Petroleum Support Fund when they claimed to have purchased 33, 288, 338 litres PMS from Mercuria Trading SA and imported to Nigeria through MT Fulmer EX MT Emirate Star and MT Panther EX Emirate Star.
More false pretense
In yet another case, Mamman Nasir Ali, Christian Taylor and Nasaman Oil Service Limited were also arraigned before Justice Onigbanjo on a three count charge of obtaining N4. 8billion under false pretense.
Nasir Ali is the son of Ahmadu Ali, former chairman of PDP, and former chairman of the board of the Petroleum Products Pricing and Regulatory Agency (PPPRA).
However, the arraignment of Walter Wagbatsoma, Adaoha-Ugo-Ngadi, Fakuade Babafemi Ebenezer, Ezekiel Olajide Ejidele and Ontario Oil & Gas Nig. Ltd could not go ahead as Wagbatsoma failed to appear before the court.
His counsel Babajide Koku (SAN) informed the court that his client was not in court because he’s presently out of the country but would return to the country on Monday to enable him appear before the court.
But counsel for Ugo-Ngadi, Ebenezer and Ejidele, the second, third and fourth defendants respectively, Mr. Wale Akoni, (SAN), Abimbola Odeyemi and James Ogunyemi urged the court to separate the case of their clients from Wagbatsoma’s to enable their clients to be properly arraigned and also enable the court take their bail applications.
But Justice Abiru in his short ruling refused the request of the counsel on the basis that the request is premature at this stage as they are not yet properly before the court, he held that until their plea is taken the court cannot assume jurisdiction or make orders over the case.

Domestic airline operators under the aegis of Airline Operators of Nigeria (AON) on Wednesday appealed to the presidency to lift the ban on Dana, ADC and Sosoliso airlines.
According to the airline operators continued closure of the airlines, especially, Dana, which the operators said had been cooperating and complying with insurance rules, is dangerous to the industry.
In a letter dated July 24, 2012, Muhammed Joji, Assistant Secretary General of AON, noted that the policy of grounding all the planes of an airline whenever it is involved in a crash should not be meted on Dana. They said rather than correct the situation it was hampering operations and bringing loss to the airlines and workers.
The association, which lamented the death of over 150 passengers in the Dana plane crash, appealed to the presidency to also consider the financial and traumatic situation the workers of those airlines would be going through when they are not in operations. Dana Air operator’s certificate was suspended few days after one of its plane crashed at Iju-Ishaga in Lagos killing all 153 on board and about 10 on the ground.
The operators said Dana had since continued to pay salaries of its staff since the situation even though it is not in operations.
“I write as the Secretary General of Airline Operators of Nigeria (AON) to solicit for the kind gesture of the Honourable Minister of Aviation and that of Mr. President of the Federal Republic of Nigeria for the release of Dana Air to continue her commercial operation post the unfortunate accident of Sunday, 3rd June, 2012 in which lives were lost. Loss of life of any kind in any accident is regrettable and is always full of emotions especially with regard to the families of the bereaved and the nation at large.
“The chairman, management and over 540 staff of Dana Air are indeed very worried about the continued suspension of the airline’s operations without any notice of a new date of possible resumption. As a result of the suspension, the entire staff of Dana Air, their families, and other dependants risk losing their source of livelihood. The operators of the airline also risk losing huge and significant investments in Nigeria’s fledging aviation industry.
“On staff salaries alone for its over 540 staff, the airline currently spends about N90 million per month. Besides, the staff salaries, there are other overheads such as the office and staff accommodation, and the increase in insurance premium.
“The preliminary report on the accident released by the AIB did not indict Dana Airline of any wrong doing. The airline is also fully committed to assisting the families of those who lost their lives, as well as properties, during the incident, and has already begun compensating the families in accordance with the law.”
The operators noted that the trend of grounding airlines and phasing out of a particular fleet of aircraft each accident is becoming a recurring culture in the Nigerian aviation industry. This is certainly contrary to the practice in most of the ICAO-member countries.
“Without fear of contradiction, one could say that airlines are now shadows of their former selves. Many professional jobs were lost as a result of lack of consistency in government policies on aviation.
“I wish to seize this opportunity to urge the Honourable Minister in consideration of the foregoing and in the larger interest of the aviation industry and Nigerians to allow Dana Airlines to continue with its normal operations in Nigeria.
