Section 109 (g) of the Constitution states “being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected: Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored”
So, who determines the part in bold? You? The governor? The court? If I say I’m defecting because there is a division in my party, is it the governor that will determine whether there is truly a division in my party or not? So, what is self executory about this provision?
The only body that can decide that a lawmakers has lost his seat as a result of defection is the court because of the condition attached to the law. You either believe the lawmaker’s claim or go to court to disprove his claim and get a consequential order for him to vacate his seat. Trying to get him out of office without passing through the court is a resort to self help and anarchy. The governor must respect due process and rule of law. He can’t be a judge in his own case.
That's is the mistake we all make, the courts is not to decide that but you that's is defecting should on your own know that you have lost your seat for your actions, now it's looking like a normal thing because we have transferred that responsibility to the country. Go and read the constitution, we are in a very useless country, once you defect before the end of tenure, the right to do is to vacate the seat , you don't need another legislation or court to come declare your seat vacant that law is self executionary, but we have transferred the law to the courts that it must be the court that has the right to declare that seat vacant, the governor is in order for not dealing with the 27 lawmakers, INEC should be blamed for not conducting elections to feel the positions

Eteka1: Good. The Federal High Court had stopped the election but Fubara stubbornly went ahead.
The courts didn't stop the election, the courts has no power to stop elections they only asked the police and DSS not to provide security for the elections and INEC not to release the register which was as late because INEC had already done that before the judgement.
Eteka1: They should rather tell Fubara to obey the Laws of the land and lawful judgements of the Courts. This strategy of blackmail and intimidation will only backfire on Fubara who is the sponsor.
Obey which judgement, shopped judgement or what, they should give a judgement and stop the LGA allocations, since they think they own the courts, they tried with the state and they failed now it's the LGA allocations, I wish them well.

But lots of these governors did complain they couldn't pay the current 35k minimum wage how come they are even going above the federal government approved rate, so it means state workers would earn more than federal workers, or what's the federal government paying since the minimum is 70k
