The Nation Nigeria MTN withdraws suit against FG by Group, March 18, 2016 at 3:01 pm in News Update FacebookTwitterSMSWhatsApp MTN Nigeria has formally announced the withdrawal of the court case against the federal government of Nigeria. According to a statement issued on Friday, this is in order to pave way for continue settlement discussions with the Federal government towards an amicable resolution of the matter in the best interests of the Telecom company and Nigeria. In retrospect, MTN on 24th of February 2016, announced its withdrawal of the court case and made an initial payment of N50 Billion without prejudice. This payment was made on the basis that it would be applied towards a settlement when one is arrived at. Speaking in the press statement, the Chief Executive Officer (CEO) MTN Nigeria, Ferdi Moolman said: ‘’We have kept our promise to withdraw and we have followed through by formally doing so. This is in line with the premium we place on good corporate citizenship.” The formal withdrawal today at the Federal High Court, with all parties in attendance, signals further progress in the negotiations between MTN Nigeria and the Nigerian government. Speaking further, Moolman described the development as another manifestation of good faith and intent by MTN Nigeria. We have confidence in the equally good intentions of the Nigerian authorities and the strength of our mutual commitment to an amicable resolution. “The high priority that Government is giving to the sustainability of the industry assures us of a truly integrated approach amongst all parties, to the growth of ICT as a critical enabler of socio- economic development in Nigeria.’’ http://linkis.com/thenationonlineng.net/aBpG8 |

ABUJA – The Supreme Court, Friday, gave the Economic and Financial Crimes Commission, EFCC, the nod to prosecute the former Governor of Abia State, Dr. Orji Uzor Kalu on a 107-count corruption charge. The charge borders on the alleged complicity of the erstwhile governor in money laundering and illegal diversion of public funds to the tune of N5.6billion.Kalu was alleged to have perpetuated the fraud while he piloted the affairs of Abia State between 1999 and 2007. Though the anti-graft agency docked him before the Abuja Division of the Federal High Court on July 27, 2007, however, for the past eight years, the defendant, through various interlocutory applications, frustrated moves by the prosecution to open its case against him.The defendant firstly challenged the competence of the charge against him, as well as the jurisdiction of the High Court to hear and determine the case. Meanwhile, following refusal by the trial court to quash the charge, Kalu, took the case before the Court of Appeal in Abuja. The appellate court, in a unanimous judgment, upheld the competence of the charge, adding that the high court was constitutionally empowered to exercise jurisdiction on the trial.Dissatisfied with the verdict, Kalu approached the Supreme Court, begging it to set-aside the concurrent findings of the two lower courts. The former governor, through his lawyer Chief Awa Kalu, SAN, pleaded a five-man panel of Justices of the apex court, headed by the Chief Justice of Nigeria, CJN, Justice Mahmud Mohammed, to quash the criminal charge against him. He contended that the EFCC failed to establish a prima-facie nexus linking him to the ingredients of the offence contained in the charge. It was his contention that the proof of evidence the anti-graft agency adduced against him did not nail him to the commission of any crime. Nevertheless, the apex court, in a unanimous judgment on Friday, dismissed the appeal, even as it ordered the appellant to go and face his trial before the high court. While upholding the Court of Appeal verdict, Justice Suleiman Galadima who delivered the lead verdict, said the apex court was satisfied that the former governor has a case to answer pertaining to allegations that were levelled against him by the EFCC. Besides, the apex court ordered the Chief Judge of the Federal High Court, Justice Ibrahim Auta, to re-assign the case to another Judge to enable the trial to commence de-novo (afresh). The apex court also ordered accelerated hearing of the case http://www.vanguardngr.com/2016/03/breaking-alleged-n5-6bn-fraud-supreme-court-orders-efcc-prosecute-ex-gov-orji-kalu/ |

Senate President, Bukola Saraki, has said that the gender equality bill, which was thrown out by the Senate on Tuesday will be reintroduced to the Senate after being redrafted. The bill, which was sponsored by the Senate Minority Whip, Biodun Olujimi (PDP, Ekiti South), seeks to empower women politically and economically, as well as grant them equal opportunities with men in diverse human endeavours. But it was rejected after Senators argued that most of its provisions were in conflict with the 1999 Constitution of Nigeria, the same reason given by lawmakers in the Seventh Senate, when similar bill was also rejected. However, Saraki, who said he met with Olujimi in the morning today to discuss the bill, noted that the bill could still be passed after modifications. “I have it on good authority that Senator Biodun Olujimi who introduced this bill will reintroduce it after re-drafting it to address some of the reservations that were expressed on the floor of the Senate,” Saraki was quoted as saying in a statement by his Special Adviser on Gender, Ms. Fatima Kakuri. In the statement, which was posted on his Facebook page, Saraki said some parts of the bill that were crucial to the development of the nation. He, however, explained that the bill was rejected because of some provisions. He said, “As I said during the International Womens Day last week, I am of the opinion that there are substantial parts of the bill that are crucial to the development of our nation such as the equal access to education, strengthening of the laws on violence against women, ending abduction of girls, sustenance and promotion of entrepreneurship opportunities, gender mainstreaming and gender equality, female participation in governance, among others. “Unfortunately, the bill suffered a slight set back because there were some parts of the Bill that some Senators disagreed with along the lines of religion and tradition. The beauty of democracy is that it gives us the opportunity to consider different opinions and this bill can still be represented and reconsidered on the floor of the Senate.” The bill was entitled, “A bill for an Act to Incorporate and enforce certain provisions of the United Nations Convention on the elimination of all forms of discrimination against women, the Protocol of the African Charter on Human and People’s Rights on the rights of women in Africa, and other matters connected therewith, 2016 (SB. 116). http://www.punchng.com/gender-equality-bill-will-be-re-presented
