koladata:I do not know the specifics of her situation and not support her overstaying her visa in any way. Nevertheless, for her to come and look after her grandchild in the first place, it is likely that her own child is a us citizen and would have filed an adjustment of status and this may take time for a variety of reasons. Being out of status is not the same as illegal immigration. Entering the US illegally is not the same as over staying your visa. One has records, the other has none. A person that overstayed a visa has a pathway to citizenship, person without any arrival record and no entry visa at all has no pathway to citizenship and there are millions of them in the USA that ought to be deported. |

Illegal immigrants are those who walked across the border without any recorded documentation of identity or entry records. There is a very big difference. |

budaatum:I'm not teaching you how to get a Visa. I am filling in the "gaps in your knowledge" to show and prove that she was denied the visa not because she did not provide proof of funds, but that she was denied in spite of providing proof of funds that...because providing that proof of fund is a part of the application and does not guarantee that the application will be granted. The information may not be of any practical use to you, but if you are receptive you would have learned how the process works. I know of somebody who had a full scholarship of tuition and stipend for living expenses. The person was denied a Visa because he could not orally convince the VO of having strong economic ties which in turn implies that he would come back after studies. There is a way to structure your responses to the VO that meet all three criteria. Her response to the course of study question was too short. She ought to have explained why she chose the course , why she chose that particular school who she was in regular contact with and how completing the programe will have a positive impact on her future career. Her response to the sponsor question is below par. She said her dad is a business man who sells and supply fabrics to western states. That is a semi vague response as it contains no concrete info. She could have elaborated on how she decided what course to study, why she choose the school and how the studies would concretely accelerate her career and how she talked to her dad who said it was a great idea and decided to give her full support. Her oral responses were minimal and unconvincing by interviewing standards and that is why she was denied. |
budaatum:Don't worry. You are talking way more thank listening and because you are not listening you are not learning anything new. When you number is called , you go before the Visa officer and after the greetings you hand over all your supporting documents. From Passport, I-20 ( which contains the school admission information) to bank statements. The ViSA officer takes a cursory look at them and begins to ask questions while confirming the information that you already presented. A valid reason to travel in her case means she needs to convince the VO by her response that she genuinely wants to go to school in spite of the documents she presented and does not have other intentions. The next thing to convince the VO of is that there is funds available or will be available to fund her education. It is only after convincing the VO orally that he will bother to even take a more detailed look at the bank statements that you already handed over at the beginning. The third thing you want to convince she needed to convince the VO of is that she has enough social and economic ties that will make her return home after her studies. Living parents, young children, a thriving business, landed property, leave of absence from work all fit into this category. The interview did not even get to that stage because her responses were way to short and tepid. Everything depends on the quality of your responses. The whole interview successfully or usually does not take more than 3- 4 minutes. It is your convincing oral responses that will make the VO even double check your packet to confirm that it is okay to issue the Visa. It is a default NO until you convince me to give you a YES mode of interview. Her oral responses were simply not convincing enough. But there is no doubt that she submitted financial proof of funds to cater for her schooling. You can't even get the I-20 from the school that will.permit you to attend the interview in the first place without your bank statements. I have said more than enough. |
budaatum:Can you show where in her post that the visa officer requested for financial evidence. If you know the procedure, you will know that once you stand before the officer, you hand over everything you brought at a go. I am just amused that you can be talking convincingly and unnecessarily about a process you have not experienced yourself. The Visa officer is looking for the applicant to prove three things before a visa can be approved. Proof of funds is just one of them. She was not denied because she did not provide financial evidence...because it is mandatory to present for her class of visa. From the conversation, they did not even get to the third one as she failed the very first one which is " a valid reason to travel" Why? She did not mention her school, she did not mention her course of study nor did she talk about why she chose the country, school and course. So because the visa officer concluded that she had did not have a valid reason to travel, it was easy to deny and not even bother with the third criteria. I dey sure sey na agent help am process the admission and fill all the forms and they told her not to talk too much. |

If she provided proof of funds as an integral part of the process, how could you now reach the conclusion that she was likely denied because of a lack of financial evidence. As one who has gone and guided a good number of others through the process successfully, and a handful who did not succeed with their interview, I know that her responses were not comprehensive enough. She is probably one of those who had been advised not to say much...hence her giving short answers that are not convincing enough. She likely had an agent do the whole application and visa officers can smell that easily which indicates that the student may not have a genuine desire to go to school thereby failing one of the three tests that are required to be passed for the officer to grant a visa. I know she provided financial evidence but she failed to pass the remaining two criteria required. |

Presenting it does not guarantee a visa approval. I've had someone get a full masters scholarship ,yet was denied. In her case, what I see is too short and tepid answers that failed to change the mind of a visa officer who already had an inclination not to issue the visa. |
