The court "dismissed all claims against the parent companies... since pursuant to Nigerian law a parent company in principle is not obliged to prevent its subsidiaries from harming third parties abroad," judge Henk Wien told the court. Environmental groups had hoped that a ruling against Anglo-Dutch Shell, which is headquartered in the Netherlands, could set a precedent for global responsibility and open the door for hundreds of similar claims. Judge Wien said however that Shell's Nigerian subsidiary must pay damages to the farmers and fishermen in one of their claims, relating to oil spills near the Niger Delta village of Ikot Ada Udo. "Shell Nigeria has been sentenced to pay damages in one of the cases. An Ikeja High Court, Lagos, has urged the Redeemed Christian Church of God, Chapel of Victory, Ikeja, Lagos, to maintain “zero noise pollution” while conducting its religious programmes.
A 79-year-old neighbour, Mrs. Esther Ogunsalu, whose residence shares a common fence with the church located on 4, Sogunle Street, Abule Onigbagbo Estate, off Mobolaji Bank Anthony Way, Ikeja, Lagos, had dragged the church before the court for disturbing her peace.
Ogunsalu, in the case with suit no LD/1336/2011 filed before Justice Aishat Opesanwo, said the noise emanating from the church prevents her from sleeping, adding that it also “triggers her hypertensive heart disease.”
She asked the court to declare that the continuous occupation and use of the premises as a place of worship “contravenes the building and town planning regulations of Lagos State.”
However, Opesanwo referred both parties to the Multi-Door Courthouse, Igbosere, Lagos, for mediation.
At the Multi-Door Courthouse, the parties adopted a term of settlement dated November 7, 2012 which was signed by the church’s pastor, Dapo Morawo, and Ogunsalu alongside her lawyer, Mr. Dan Kizito, in the presence of a mediator, identified as Mr. Dosunmu.
The terms of settlement obtained by our correspondent on Monday stated, “That in the interest of peace and justice, parties have agreed to make peace and that the first respondent (owner and trustees of the RCCG) and the second respondent (Morawo) will maintain a zero noise pollution in accordance with Lagos State regulations and laws.”
At the resumed hearing of the case, Justice Opesanwo said since the parties had agreed to an amicable resolution of the dispute, the court would adopt the terms of settlement as its judgment.
“The said terms of settlement have been duly examined. I hereby adopt and pronounce it as the judgment of this court. Parties are urged to bear their respective obligations under the settlement terms,” Opesanwo said.

BENIN CITY-BARELY one week after he was sworn in as Permanent Secretary in the Ministryof Environment by Governor Adams Oshiomhole, thousands of Igbo traders at Mission Road, Benin City, Monday, protested to the state Government House calling for the removal of Maj.Lawrence Loye, over what they described as unwarranted closure of their shopsin the area. The placard carrying protesters who lamented that they woke up to see their stores locked up for reasons unknown to them, described Loye as a dictator and appealed to Governor Oshiomhole to “save shop owners from the hands of Maj.Loye” adding that operating businesses in the state “has been hell with us due to this kind of environment where they either lock up your shops or they asked you to pay exorbitant taxes”. But in a swift reaction, Maj.Loye described the call for his sack as nonsensical, explaining that the shops were locked up because the owners refused to obey the sanitation laws of the state which resulted to the blockage of the drains constructed by the state government along Mission Road. Loye asserted that “ these people are destroying government property and unless they evacuate the drains and ensure daily cleaning of the business area, we will not open the market. Today (Monday) is supposed to be sanitation day and I was at the marker as early as 7:30am to ensure that those sweeping the road and gardeners are around. When we started monitoring to ensure that the sanitation law is complied with, we discovered that the store owners or the landlords have used dirts toblock the drainage system which was only constructed six months ago. “The accredited waste managers were around but the shop owners refused to pack up the waste to enable the waste managers take themaway. Until they come here and sign an undertaking that they will keep the area neat the shops will remain closed. We are expecting rains now so we cannot afford to use refuse to block the drains.
