Human rights lawyer, Femi Falana, said Thursday, that former President Goodluck Jonathan cannot contest in the 2023 presidential election, citing constitutional provisions barring the ex-president from seeking re-election.

The senior lawyer said this in a statement in response to growing calls on Mr Jonathan to throw his hat into the ring ahead of the 2023 election.

He said Mr Jonathan, who was Nigerian president between 2010 and 2015, would breach constitutional term limits of two terms of eight years if he runs for the presidency and wins again.

He recalled that Mr Jonathan became the President of Nigeria in 2010 following the sudden death of President Umaru Yar’adua, Yaradua and later contested and won the 2011 presidential election.

Mr Jonathan spent five years in office as President which would make it nine years in office if he contests and wins again, Mr Falana said.

“Dr. Jonathan is disqualified from contesting the 2023 presidential election. The reason is that if he wins the election he will spend an additional term of four years.

“It means that he would spend a cumulative period of nine years as President of Nigeria in utter breach of Section 137 of the Constitution which provides for a maximum two terms of eight years,” Mr Falana said.

The senior lawyer also said that by virtue of section 137 (3) of the Nigerian constitution, Mr Jonathan cannot seek a re-election to the office of the president having completed the tenure of the late President Yar’adua and sworn in again for a full four-year term in 2011 upon winning the presidential election in his own name.

“A person who was sworn in to complete the term for which another person was elected as President shall not be elected to such office for more than a single term,” the section 137(3) of the constitution cited by Mr Falana reads.

The National Assembly had introduced the constitutional provision via the Fourth Alteration No 16 Act 2017 which President Muhammadu Buhari signed into law on June 4, 2018.

Mr Falana faulted the argument that the constitutional provision signed into law in 2018 cannot retroactively apply to Mr Jonathan who had left office after his failed reelection bid in 2015.

Mr Jonathan lost the keenly contested election to President Buhari.

Faulting the argument that Mr Jonathan is exempted from the effect of section
137 (3) of the Nigerian constitution, Mr Falana referenced the failed bid of former Governor of Oyo State, Rasheed Ladoja, to seek an extension of his tenure to cover for the time he was kept out of office through illegal impeachment.

Mr Falana recalled that the Supreme Court rejected Mr Ladoja’s prayer on the grounds that a governor was only entitled to spend a maximum period of eight years or less and not more than 8 years.

He said: “Some people have said that the amendment is not retrospective and therefore cannot apply to Dr. Jonathan.

“Assuming without conceding that the amendment is not retrospective it is submitted that under the current Constitution a President or Governor cannot spend more that two terms of eight years.

“In other words, the Constitution will not allow anyone to be in office for more than a cumulative period of eight years.

“In Marwa v. Nyako (2012) 6 NWLR (Pt.1296) 199 at 387 the Supreme Court stated that Section 180 (1) and (2)(a) of the 1999 Constitution of the Federal Republic of Nigeria has prescribed a single term of 4 years and if a second term, another period of 4 years and not a day longer.

“In the case of Gov. Ladoja v INEC (2008)40 WRN 1 the Supreme Court rejected the prayer of Governor Ladoja for 11 months’ extension to cover the period he was kept out of office through illegal impeachment,” he said.

Mino Raiola has confirmed he is not dead after his agency poured cold water on reports that the football super-agent had passed away aged 54. Raiola is said to be in a bad condition in hospital at present. But he tweeted on Thursday afternoon: "Current health status for the ones wondering: p****d off second time in 4 months they kill me. On Thursday, reports from Italy - circulated by Tancredi Palmeri on Twitter - claimed Raiola, who represents Paul Pogba, Erling Haaland and Zlatan Ibrahimovic, had edied following an illness.

EFCC extradites Nigerian, Adedunmola Gbadegesin to US over ‘$148,000 romance scam’

TSB NEWS reports that the Economic and Financial Crimes Commission (EFCC) has extradited one Adedunmola Gbadegesin to the United States over a wire fraud scam worth $148,000.

Gbadegesin, who was extradited on Monday, is wanted in the US over an alleged conspiracy to commit wire fraud and money laundering.

According to the EFCC, the office of the attorney-general of the federation made a request for Gbadegesin’s extradition following a court order to the effect.

“The offences contravene Title 18, US Code, Section 1349 and 1956 (h) and carries a maximum jail term of 20 years was extradited on Monday,” the statement reads.

“His extradition was coordinated by the EFCC following a request from the office of the attorney-general of the federation, pursuant to a February 11, 2022 Order by Justice D.E Osiagor of the Federal High Court, Lagos, in Suit No. FHC/L/CS/765/21, which granted a request to extradite the suspect to the United States to answer to criminal charges bordering on romance scam, wire fraud and money laundering.

“Gbadegesin who was arrested on September 2, 2021, is alleged to have defrauded an American lady living in Kentucky, United States, of over $148,000.”

According to the anti-graft agency, the suspect is billed to appear before a United States District Court for the District of New Mexico.

He is expected to be charged with two counts of conspiracy to commit wire fraud and conspiracy to commit money laundering.

Concern trails Abobaku over Alaafin Adeyemi’s Demise

The term “Abobaku” is presently trending on Twitter and other social media platforms following the news passing of Oba Adeyemi today.

Many tweeps have been sharing comments on what would be the fate of the one closest to the king, having enjoyed the same benefits with the monarch while alive.

While some showed concerns and kicked against the revival of such tradition following the circumstances that surrounded the passing the late Ife Monarch, Oba Sijuwade, whose Abobaku was said to have run away because of the fear of death; others are asking that chief Abobaku be closely monitored from escaping so as to be buried with the monarch to avoid calamity in the land.

Meanwhile, some days ago, there was a trending report of the Abobaku of Oníkòyí of Ikoyi escaping to an unknown destination and yet to be found.

In ancient Yoruba Culture, anyone who bore the Abobaku title was buried alongside the incumbent king upon his demise.

It is believed that the title was a way of strengthening loyalty and preventing betrayal that could lead to the King’s untimely death since whoever occupied the position was sure to protect the King as much as he could, to avoid his death as well.

Abobaku title was a death trap, as the holder of such title had their life depending on the death or survival of the incumbent King. But the position was much contested, just like other exalting chiefly titles in the kingdom. And this was because of the benefits attached to the title.

The abobaku is believed to be close to the King with the right to enjoy the royal largess. He may even have rights nearly equal to that of the King, depending on the cultural practices of the kingdom in question.

Following the death of the previous Ooni of Ife, Oba Sijuwade, it was rumored that the abobaku escaped; to avoid getting buried along with the dead King. But this has been dispelled as fake news, with clarifications emerging to prove that no such title existed in Ile-Ife.

And the Saarun of Ife who is said to be the closest to the Ooni, lived his full years and was never buried with the Ooni. Since the abobaku culture was abolished in 1859, there has been no record of this practice anywhere in Yoruba land.

A soldier, who was arrested for absconding from his duty post to join fighters of the Islamist group, Boko Haram, to raid a town, has committed suicide while he was being transported.

The soldier, Jibrin Biu, a Lance Corporal, attached to the Nigerian Army 159 Battalion in Geidam, under the Nigerian Army 27 Task Force Brigade in Buni Gari, Yobe State, reportedly disappeared for two days before he was tracked and arrested.

A source in the army revealed that the soldier was identified among fighters of the Islamist group last Sunday, as they attacked Geidam, a town in Yobe State.

His commanding officer subsequently tracked his phone and he was pinpointed at a point in Gashua, in the state.

According to sources, including the soldier’s colleagues, a signal was sent to the army base in Gashua and dragnets were spread out for him.

He was arrested at a checkpoint in a commercial bus travelling to Yobe on Tuesday morning.

Following his arrest, he reportedly snatched a gun from a soldier who was transporting him to custody and shot himself dead.

The deceased soldier was said to be in the Intelligence Corps of the army before becoming a weapons instructor. He was believed to be paid by the terror group to teach their members how to use firearms.

The army spokesperson, Onyema Nwachukwu, did not respond to WhatsApp calls and text messages sent to his phone for comments on the incident.

Last September, a similar incident occurred in Yobe when a soldier, Victor Ojeamiran, attached to the Nigerian Army 27 Task Force Brigade in Buni Gari, Gujba Local Government Area of Yobe State, committed suicide he was allegedly false accused of stealing.

The soldier was reportedly punished by his superior in public, while residents of the area shot videos of the punishment and later posted them on some social media platforms.

Mr Ojeamiran shot himself after he personally submitted a note to his platoon sergeant for delivery to his superior officer in the Task Force. In his suicide note, he insisted he was innocent of the allegation.

A Federal High Court in Abuja has sacked Yakubu Dogara from the House of Representatives and declared his seat vacant.

Mr Dogara, who represents Bogoro/Dass Federal constituency of Bauchi State, was the Speaker of the House of Representatives between 2015 and 2019.

The judge, D.U. Okorowo, on Friday, ruled that Mr Dogara’s defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) was wrong and meant he should vacate the legislative seat.

Mr Dogara defected to the APC after winning his re-election under the PDP in 2019

His frosty relationship with his state governor, Bala Mohammed, was one of the main reasons he ditched the PDP which he joined less than five years ago.

Mr Dogara had on July 24, 2020 dumped the PDP) and returned to his former party, the APC.

Mr Dogara had earlier in 2018 dumped the ruling party for the main opposition platform after having political confrontation for about two years with the then governor of Bauchi State, Mohammed Abubakar.

In a letter of resignation addressed to the Bogoro ‘C’ Ward Chairman of the PDP dated July 24, 2020, Mr Dogara mentioned a breakdown of governance in his native state of Bauchi under the administration of Governor Bala Mohammed whom he said he helped installed as a governor in 2019.


The former speaker said he could not successfully ask questions about those issues without being accused of disloyalty if he were to remain in the PDP.



He argued that if he abdicated this responsibility of telling the truth to power in Bauchi State, having done same under the administrations of former Governors Isa Yuguda and Mohammed Abubakar, he would be the most irresponsible and unprincipled politician in Bauchi State.

The explanation contained in the letter was sent to PREMIUM TIMES by Mr Dogara’s spokesperson, Turaki Hassan.

Mr Dogara was elected speaker on the APC platform in 2015. He decamped, alongside dozens of other lawmakers, to the PDP in the build-up to the 2019 general election.

He won his re-election as a lawmaker on the PDP platform but did not contest the speaker’s position as the APC won majority seats in the parliament.

After his meeting with President Buhari on July 27, 2020, the head of APC’s interim management committee, Mala Buni, who also attended the meeting, said Mr Buhari was pleased with Mr Dogara’s defection

BREAKING: Former President, Goodluck Jonathan involved in road accident in Abuja
Former Nigerian President, Dr Goodluck Ebele Jonathan has, Wednesday, escaped death when his convoy got involved in an accident earlier today in the vicinity of the Abuja airport, while on his way out of the airport.

The crash resulted in the loss of two police officers attached to him.

Jonathan, in a statement signed by his media aide, Ikechukwu Eze, expressed deep sadness over the unfortunate tragic death of two police officers attached to him, in a road crash today in the vicinity of the Abuja airport, while on his way out of the airport.

The former President who described the incident as painful and heart-rending stated that the sudden death of the two security details has thrown him into deep mourning.

Dr Jonathan noted with sadness that the deceased, Inspectors Ibrahim Abazi and Yakubu Toma, were fine officers who were dedicated to their duties and service to the nation.

Two other officers sustained injuries in the accident which involved a car conveying the security men. They were rushed to a hospital in Abuja where they are responding to treatment.

The office of the former President has offered condolences to the families of the bereaved and the Police High Command.

Dr Jonathan prayed to God to grant the souls of the departed eternal rest and bless their families and the nation with the fortitude to bear the loss.

Aso Rock is a National Monument. It does not belong to the president or his ministers yet we have continued in the military tradition of not having pictures of this national symbol as a symbol of pride just as the National Assembly building.

The executive is a third arm of the government and separation of powers implys that no arm of government is greater than the other. Why the serecy with the symbol of that arm of government if not as a remenant if the oppressive military regimes that assumed absolute powers. This secrecy does not cover National assembly building or Supreme Court.

I'm not saying that anyone should be allowed access into the building, but it a national Symbol and should be promoted as such.

Nigeria is the only country in the world that its citizens do not know what the presidential residence looks like. If pictures of the presidential bulding would result in security breach, the White House would have been bombed serverally by now. On the contrary, the white house is accessible to United States citizens as a simple house on the street where tourists come and snap pictures with police officers. The same in Ghana next door.

At long last, the Peoples Democratic Party PDP may have finally taken a decision on the controversy surrounding the zoning of its 2023 presidential ticket. According to the Daily Trust, the 37-man committee chaired by Benue State Governor, Samuel Ortom, charged with the responsibility of coming up with an acceptable zoning arrangement has resolved to throw the presidential ticket of the party open to all aspirants.

Prior to the purported decision of the zoning committee to jettison zoning, stakeholders of the party from the North and South have been polarised over the issue. While PDP stakeholders from the South have insisted that the ticket be zoned to their region, their counterparts from the North have been urging that the party jettison zoning.

However, the Daily Trust is reporting that majority of the members in the zoning committee have agreed that the race for the presidential ticket of the party be thrown open.

A member of the committee from the North who spoke to the newspaper said since the ultimate goal of the party is to win the presidential election, majority of them have agreed to go for a zero zoning arrangement. The member claims what the country is looking for is not zonal president but a Nigerian president that will reinvigorate the cohesion and unity of the country.

One factor that may have led majority of the committee members to throw out zoning.

The 37-man committee is made up members drawn from the 36 states of country and the Federal Capital Territory (FCT). This means the North has majority over the South in terms of numbers. The North has 19 states plus the Federal Capital Territory (FCT), while the South has 17 states. Considering the position of Northern presidential aspirants on the issue of zoning, getting majority among the committee members to side with the Northern presidential aspirants and agree to a zero zoning arrangement will be easy.
