One to inform the house about the outcome of my situation.That long awaited mail which any student would like to see in his /her mailed box just arrived in my mail box.I thank everbody for the support i received.It really worth for me to write this remonstration letter, exactly 29 days after the interview i received my visa.people try to discourage me not to write a remonstration letter because according to them my application cannot be reviewed.Thanks God i didnt listen to such advice.Please if there is way to appeal on your visa decision just go for it!!!!! Im very happy now thanks to this thread.Germany here i come......

You were probably not coherent enough in your first interview to convince them, that's why the decision to reject you was made at the embassy. They pick out words and all must follow. Also, you must have a full knowledge of what your Courses are about at the back of your hands.
Now that you have gone past them, as they have assured you, just relax and wait for the foreigners' office decision.

@Biglord Hahahahahahaha smiley smiley smiley you didn't understand me well, I said they didn’t discuss with me the reasons for my earlier rejection. I knew the reasons for my earlier rejection since it was written on the letter they sent to me.on my remonstration letter I discussed the reasons.so when I received a call from them I thought my interview will be based on the reasons of my earlier rejection .to my surprise during the interview they didn't mention anything regarding my earlier rejection. It is true she said yes to my application she went further saying that the final decision is from the competent authority in germany ,she added by saying compare to other master student I was very weak in explaining my course content and that if I'm refused a visa and I decide to reapply I should master my course content before reapplying..only this her statements put me down!!!! cheesy cheesy cheesy I starting thinking that maybe there are just playing games with me, how can you tell someone that for us at the embassy is a yes to your application and u go further by saying compare to other master student u were weak in explaining your course ......bla bla bla!!!!,its only this statement she made at the end that's disturbing me......at the end of the interview the ladies kept on smile at me but me!!!! I was smiling with them at all,if someone was present to just look at my face cheesy cheesy cheesy. You are absolutely right!!!! If it was a rejection they would have rejected again my application on the spot,is only those last statements she made at the end that's disturbing me cheesy cheesy cheesy cheesy cheesy

Let me share my personal experience I got with regard to my student visa at the German Embassy.I got my bachelor in 2013, during my interview that took place on the 9 may 2016 ,I told the visa officer that sometimes after my bachelor I got involve into business, why I mentioned that was because I wanted to make him understand that I wasn’t just staying inthe house doing notting at least I kept myself busy.I didn’t give detailed explanation to the consular officer as to why I got involve into business.I did that for 6 months in 2015.....I didn't know that this information I'm giving could make the visa officer think otherwise!!!.After answering series of question from the visa officer I left the embassy confident that I would be given a student visa.
After 3 weeks I received an email from the embassy ,it was a refusal letter.The refusal was on the ground that the German Embassy doubts my intention of studying and my language certificate isn’t reliable (this is the attestation I obtained from the language centre I was enrolled ).I was very shock...I calmed down for 3 days. After which I start preparing to write a remonstration letter (even though people were discouraging me not to write because according to them the embassy will not reply to it ,instead they were advising me to go for german classes and take the ZIDAF exam befor reapplying,for me it didn't make any sense as the master course I'm admitted is taught entirely in English and german proficiency isn't a requirement for enrolment. In 2014 I did English classes to under take the international English language testing system (IELTS) in view to apply for my master course. I wanted to acquaint myself with german language before travelling to Germany, so I went for german classes as well and completed level one.I attached supporting documents to my remonstration letter and went to deposit it at the German embass.6 days later I received a call from the german embassy requesting me to come the following day .After,the call I started thinking on what to say why I got involve into buiness since the embassy thinks I want to use my student visa otherwise. The following day at 7 am I was already at the embassy, I got in and sat in the waiting room.my name was called and I got up and move to the box where heard my name.To my great surprise 3 visa officers where already waiting for me,all were female.let me call them lady1, lady2, lady3.I sat down my blood pressure started to increase.lady2 was beside lady1 with an A4 paper on it were series of questions and photocopies of my course content my heart rate started increasing because i wasnt prepared for an interview,I thought that they will instead discuss with me the reasons for my rejection and what i wrote on my letter of remonstration,lady3 had the remonstration letter and the supporting documents I summitted to the embassy earlier.lady1 asked the first question I answered then lady2 asked I answered then lady1 switch off the microphone and was conversing with her colleagues, after conversation she switched on her microphone and lady3 tick first question on her A4 paper. Same thing happened through out the interview.After bombarding me with series of question they went into my course content,the fact that I was afraid , my heart beating rate increasing and being interviewed by 3 consular officer intimidated me ,confusion started I wasn't coherent when explaining my course content because I wasn't at all prepare for that.Finally last question lady1 asked.....u had your bachelor in 2013 what where you doing that you decided to apply for master studies in 2016.I explained she then asked for evidence and I summitted. I was then ask to go into the waiting room and that they will call me back in 5 minutes,I went as requested and after 10 minutes I was called.I set to myself that these ladies won't change their decision there r still going to refuse me the visa and maintain my rejection.I sat lady1 started saying........ I would be very open to you (just that statement made my heart rate to increase) compared to other master student you were very weak in explaining your course content (I new it was finished with me), she then said however (Just this word "however" made my heart rate to drop) to us at the embassy we say yes to your application (all 3 ladies smile but I wasn't smiling with them at all) but the final say is from the competent authority in Germany and the procedure will take upto 2 months. If you are refused a visa(she spoiled everything again smiley and you decide to reapply master your course content and certain technical aspect before applying....she continues to smile while saying good luck and I wish you the best,lady2 and lady3 were smiling also then lady2 told me....I wish you the best in your master thesis.I responded by saying thank you.while leaving the embassy I was kind of surprised that they didn't discus with me the reasons for my rejection and I too didn't mention that because they didn't ask,I was waiting for them to talk about it before I could say something .since this interview my days and nights have not been the same,I'm always refreshing about this interview and wondering if I will be granted this visa.

Please anybody that has come across such situation or anybody reading should please give me his or her opinion on this matter and if I stand a chance for my visa to be granted. Thank you

hello!! VO, well... i have been quite a longtime out of nairaland but i am back now to express my worries.My brother back in the United state wants me to come and do post graduate studies in the US.MY worry is the permanent back on my status i narrated to you,i am still wondering though i was a minor i was still ban to enter the US.I acknowledge that it is true i submitted fraudulent documents but i didn't make them.Those responsible to take care of my file fabricated them and gave them to me to summit at the time of my interview and they even trained me on how to answer question at the time of my interview. my brother back in the US wants me to apply for a student visa but i keep telling him about my permanent ban but he says i cannot be ban to enter the US because the incident happened when i was a minor,so im just confused on what to do now,i don't want my brother to lose his money in the process to obtain a student visa,so VO i wish to know if really i still have a chance to obtain a visa? my permanent ban as a minor is it an error or what? please i need clarification on this point because i still wonder on this point.thanks for reading looking forward for your response,stay blessed

My personal opinion: I wouldn't worry about getting an attorney at this stage. Filing a waiver application (the I-601) is pretty straightforward. Of course, it's a personal choice, and getting an attorney isn't going to hurt; it's just not really necessary.

abujaniv: 212(a)(6)(C)(1) findings are for material misrepresentation, and carry a lifetime barr on travelling to the US. If someone has a 6(C)(1) finding, while they are welcome to apply for a non-immigrant visa, there is a multi-step process:

First, one has to convince the officer they qualify for the visa they have applied for, and overcome the legal presumption of being an intending immigrant. (This is often difficult, as they, by virtue of having a 6(C)(1), are known to have misrepresented themselves in the past.) If the officer doesn't believe the applicant qualifies for a visa, the interview ends there.

However, if the officer does find the applicant to qualify for the visa, the applicant can ask the officer to file a waiver request for them, which can come either with or without the officer's recommendation for a waiver. (We don't decide on the granting of waivers - the Department of Homeland Security (DHS) back in the U.S. does.) Then, the ultimate decision on whether or not to temporarily waive the lifetime travel barr is made by DHS.

When your brother becomes a citizen, he can file an I-130 petition on your behalf. But to file for a waiver with a sibling petition, you still need a spouse, parent, or child in the U.S., not a sibling.

You do have an ineligibility under 212(a)(6)(C)(1) for presenting false documents, and you'll need to apply for a waiver. In order to apply for a waiver, you would need to have been interviewed for an immigrant visa (in this case, a DV). You can't just apply for a waiver with the idea that some day in the future you might be applying for a visa.

To be eligible for a waiver for a 212(a)(6)(C)(1) ineligibility, you must be the spouse, parent, or child of a U.S. citizen, a Legal Permanent Resident, or someone who has been issued an immigrant visa (in this case, a DV). So if your parents aren't in the U.S. as citizens or LPRs, you'll have to take care of all this after you marry your girlfriend.

It's up to you whether you'll marry her first and try to get a waiver in your Diversity Visa case, or whether you get married later and wait until she files an I-130 petition for you as her spouse.

In any case, the best thing to do is to be very upfront and candid with the interviewing officer. We get worried when we find this stuff out from our computers instead of directly from our applicants.

I really, really can't give you advice as to whether you should get married or not and how that will affect your visa chances. I don't want you to follow my advice, get refused for some other reason that we haven't even thought of at this point, and hate me forever. It's completely your decision (and your girlfriend's). I do have faith that if you have a bona fide relationship it doesn't really matter when you get married -- we'll know if it's a real relationship.

VisaOfficer: Well, visas cannot be granted after the Sept. 30 deadline. Your case sounds fairly complicated and I don't want to give you incorrect information; you should wait until your interview and talk to us in person.

The bottom line is that if you have an ineligibility, even if a waiver is available, it's probably too late to get a 2014 Diversity Visa this year. But without seeing your case I don't know if you're ineligible or not.
thanks for the above responds. the DV for which i will be interviewed is in 2015 and not 2014, but for the moment i am tryin to convince my girl friend not to get married to me because we are likely not to be given a visa since she is older than me and the fact that we are young.so it is better for her to send her documents to KCC and be interview alone so that she can have more chances of getting a visa,this is the advice i always tell her,and she keeps up insisting for us to get married,so i have taken my decision not to get married to her because i dont want her to lose this lifetime opportunity.as for me i want to know if my status of inelligibilty can only be known during an interview? can i call the embasssy to find out about my status of ineligibility? and how do we go about to apply for a waiver?

I think waiver takes saveral months before it can be granted and that can exceed the dateline for DV (SEPTEMBER 30) so if i need to apply for a waiver,would my interview be kept pending(or what) till i am granted the waiver knowing well that the dateline for DV has passed? and also, what would be the next steps to follow if the waiver is granted?

on our previous disscusion you said that if the visaofficer who interviewed me entered an ineligibility into my record then probably that should be an error since i was a minor by then and you went further saying that this situation can be fixed.my worry is that,this situation can it only be fixed if i apply for a waiver? because i thought that if the visaofficer made an error then that can be fixed at the embassy without me applying for a waiver. i also want to know how would the visaofficer identify the error should in case there exist an ineligibility? or i am there one who is supposed to explain the situation?

If you have a bona fide relationship with the Diversity Visa winner, and you can talk about the relationship credibly, I wouldn't worry about the age difference. Your brother can also file for you once he is a U.S. citizen, no matter how old you are; sibling petitions currently take around 12 years before they can be interviewed, though. Again, I wouldn't worry about something that happened when you were 14. Going by what you've written here, it doesn't sound like it will be an issue.

It depends what the person tested positive for. Being HIV+ is not an ineligibility for entering the United States, but if the person is positive for TB, syphilis, or some other highly contagious infection, he or she will need to complete treatment before traveling.
why i am asking this is because the incident happened when i was a minor(14 yrs), i went for an interview for a student visa in 2007,the consular officer told me to come the following week for my student visa,when i came the following week as required ,i was told to come again in one week time,this situation happened for 1 month until i was called and told that some fraudulent documents was discovered into my file and that i am permanently banned to enter the US,later on the school for which i was enrolled send another I-20 for me to go for another interview which i did,the consular officer told me that i am still applying at the same school she went further saying if i continue to be apply for interview i will keep on losing my money,she refused me the visa.i am dating a girl,and she was chosen for 2015 DV lottery,we plan to get married for further processing,so my concerns are as follow: the fact that i am getting married to her is that consider as fraud since i have 22 years and she has 29 yrs?because i am really worried and confused.my second concern is if i can still be eligible for the immigrant visa under this condition since i was permanently ban to enter the US during my student visa interview?
another concern not related to those mention above is:my brother is a green card holder and he plans to get a US citizenship,an he wants me to benefit from it,so i dont know if my age (22yrs) still permit me to be eligible? and if the fact that i was permanently banned befor can affect this process?
