from my own experience and discussion with other prospective property owners, i got to understand that the major problem with landed property acquisition is that many people do not know the right channel of property investigation or proper documentation. Thus, they rely solely on agents who most times turn out to be crooked. Earlier this may, i paid 250K to a woman at Kubwa, Abuja to help with genuine building approval for my project. She gave me a FCDA stamped approval only for FCDA officials to discredit the approval and now, my property is marked for demolition.

As we know that in Nigeria, most especially with government establishments, information on processes or procedure is very hard to come by. Most times, we learn in the hard way. This is why i have created an online community to help one another on information to guide prospective property buyers on valid processes. Also, as processes differ by region, we need professionals and experienced people to contribute on familiar location to make it easy for information seeker to navigate to appropriate and relevant sections.

FCT MINISTER DIRECTS DEVELOPMENT CONTROL DEPARTMENT TO TAKE FULL CHARGE OF BUILDINGS APPROVAL AND SUPERVISION IN FCT

The Minister of the Federal Capital Territory (FCT), Malam Muhammad Musa Bello has directed the Development Control Department of the FCT Administration to take full responsibility for building plan approvals and construction supervision in the Territory in accordance with extant regulations.
The Minister gave this directive in reaction to the unfortunate incident of building collapse on Monday at Gwarinpa. He reminded the Department that in line with the provisions of Section 7, Sub-section 1-3 of the FCT Act of 1976 and Part II, Section 27-41 of the Nigeria Urban & Regional Planning Law of 1992 amended in 1999, no person or body is authorized to carry out any development within the FCT without the written approval of the FCT Department of Development Control.
Malam Bello also directed the Department to ensure that the Federal Housing Authority (FHA), that approved and was supervising the collapsed building, and other stakeholders in mass housing development subsector in the FCT to henceforth adhere strictly to all regulations on property development in the Territory. He said further that the FCT Administration will no longer ignore the construction of buildings on flood plains and will take necessary measures to correct the anomalies.
While sympathizing with the victims of the incident, the Minister said that human lives often lost in the process of building collapse can be avoided if simple urban and regional regulations were sternly followed. He emphasized that his Administration would not fold its arms to watch the wanton waste of lives; stressing that human life is sacred and must be protected.

WHY FCTA CHANGED APPROACH TO DEMOLITION OF ILLEGAL STRUCTURES – MINISTER
WANTS RIGHTS COMMISSION TO ENLIGHTEN ABUJA RESIDENTS;

The FCT Minister, Malam Muhammad Musa Bello, has said that the FCT Administration has adopted new approach in the removal of illegal structures in the Federal Capital Territory, Abuja to give the exercise a human face.
The Minister stated this while receiving a delegation from the National Human Rights Commission, led by its Executive Secretary, Professor Bem Angwe, that paid him a working visit in his office at Area 11, Garki I District, Abuja.
Malam Bello explained that the FCT Administration abandoned its previous style of demolishing illegal structures in the FCT to enable affected residents salvage any useful material in the process.
He remarked that the owners of such property are dully carried along in the process and allowing them to carry out the exercise to enable them retrieve some useful material that can be taken away, thereby reducing the pains.
The Minister noted that the approach has really paid off because it has encouraged understanding and reduced lots of friction.
Malam Bello thus, appreciated the role the National Human Rights Commission played for the FCT Administration to adopt the new procedure.
The Minister described the Commission as reputable organization because the institution tells people when they are wrong; irrespective of whom they are.
He further described the Human Rights Commission as an institution of government that gives hope to the people that whatever happens, they have recourse and their voice will be heard.
The Minister recalled an incident where the FCT Development Control Department was dragged to the Commission in the course of enforcing Development Control laws, and the Commission agreed that although the Department was on the right side of the law, it needed to apply more human face and make sure Nigerians appreciate why they are taking those actions.
His words: “That for me was an eye opener and since then, I have insisted that whatever we do, it’s very important that we do a lot of advocacy and explanation to the people. Even if there is going to be demolition or relocation of people, there is a clear instruction now that no more destruction; give people reasonable time and notice and also encourage them to do the dismantling by themselves. That way, you reduce tension and more importantly, you allow them to salvage what has economic value...

All developers wishing to commence development of plots, temporary or permanent, within the Greater Port Harcourt City Development Authority Area shall apply on prescribed application forms obtainable upon payment of the relevant fees from the Authority. Steps Towards Obtaining Permission are as follows:-

STEP ONE: Outline Planning Application (OPA)
This is an application to seek planning permission in principle, before going to the extent of preparing detailed drawings. An application for 'outline' planning permission is submitted to ascertain whether the development is acceptable in principle. This application is relevant where the erection of a building is proposed.
It is therefore a planning permission for the erection of a building subject to a condition(s) requiring the subsequent approval of the Authority.

Some of the matters considered in Outline Planning Application are:

Design
External appearance
Means of access
Landscaping

STEP TWO: Full Planning Permission
Full Planning Application (FPA)
This is an application with detailed drawing and information necessary to enable the Authority reach its decision. This does not, however preclude the Authority from asking for such further information as it considers necessary.
The application will include:

The site plan, detailed building plans, engineering drawings.
Drawings and information in such number as the Authority may require as stated in its notes for applicants.
The appropriate fee.
The Authority may, in certain circumstances, require an Environmental Impact Assessment and Health Safety and Environment Policy Reports.
Applicants are advised to refer to Development Application Check list.
Processing of applications are carried out by various departments/units within the Authority; i.e. Planning, Health, Survey, Engineering, and Inspectorate.

Lagos State Governor, Mr Akinwunmi Ambode on Monday fulfilled his pledge of making the menace of land grabbing in Lagos a thing of the past with the signing of the Lagos State Properties Protection Law. Governor Ambode also signed the Lagos State Neighbourhood Safety Corps Law, a move which is majorly aimed at boosting security of lives and property in all the Local Government Areas and Local Council Development Areas of the State. Speaking at the signing ceremony which was attended by the Lagos State Speaker, Rt. Hon. Mudashiru Obasa; the Chief Judge of the State, Justice Olufunmilayo Atilade and other top government functionaries, Governor Ambode said the laws were central to his administration’s focus of safeguarding the lives of all residents, as well as attracting, growing investments and improving the ease of doing business in the State. “In addition to equipping our security agencies, we have now created a legal framework to put some form of communal protection in place to boost and support the great job the Nigeria Police is presently doing,” Governor Ambode said. The Governor, who explained that the Neighbourhood Safety Corps would assist the police and other security agencies to maintain law and order across the communities, added that the Neighbourhood Safety Agency, which the new law established, would also be charged with the responsibility of registering all private home security and any other person employed for private home security amongst other things. On the Properties Protection Law, Governor Ambode said the need for the law followed the fact that one of the issues that discouraged investors and hindered the ease of doing business in Lagos in the past had always been the menace of land grabbing.

UPDATES ON APPOINTMENT OF NEW DIRECTORS OF LAND, AGIS, DEVELOPMENT CONTROL AND PARKS & RECREATION.

The FCT Minister, Malam Muhammad Musa Bello, has approved the appointment of Adamu Hussaini Jibrin as the new Director of Land Administration and Dr. Isa Jalo to take charge of the Abuja Geographic Information System (AGIS).
This new redeployment, which also affects the Departments of Parks & Recreation as well as Development Control, was contained in a circular dated August 10, 2016 signed by the FCT Permanent Secretary, Dr. Babatope Ajakaiye.
The new Directors of Parks & Recreation as well as Development Control are Ali Alhaji Ukele and Mukhtar Galadima Usman respectively.
Others are Imande Victoria – Director, Satellite Towns Development Department (STDD); Obiechina Helen Nneka- Director, Resettlement & Compensation; Ahmed Zalihau-Director, Urban & Regional Planning; Dr. Okoroukwu Humphery- Director, Public Health; Mrs. Jogai Cerie- Director, Archives & History Bureau and Olaloye Marufu Omoniyi- Director, Facilities Maintenance & Management.
Abubakar Yahaya is now the Secretary, Urban & Regional Planning Tribunal, while Mrs. Ohamma Perpetual Ndawii now takes charge as the Deputy Director (Planning & Resettlement) in the Resettlement & Compensation Department.
The Circular also directed that all Deputy Directors currently in the Departments of Land Administration and Development Control are affected by this posting and should report to the Department of Establishment and Training for further posting instructions.
The former Directors Land Administration, AGIS, Parks & Recreation, Facilities Maintenance & Management, Urban & Regional Planning, Development Control and Ibiang Okoi Ikpi of Facilities Maintenance & Management are to await further posting; while former Deputy Director/ Land Registrar in Land Administration Department is o report to Legal Services Secretariat for posting.
The circular further directed that these changes are with immediate effect and that all handing and taking over formalities are to be completed unfailingly on or before Friday, August 12, 2016.

Applicants with Customary titles make a payment of N100,000 only application fee into the designated AACSTRIS account at any Oceanic/Ecobank and upon certification of true ownership will be issued Statutory "bankable" titles.

Revised Procedure for Processing Excision Applications in Lagos State

STEP 1: APPLICATION FOR EXCISION

The Baale in Council/Secretary, family head or their duly authorized representatives shall forward excision application to the Land Use and Allocation Committee on the letter headed paper of the Community concerned.
The application submitted must be on behalf of the entire community and must include:

The Location and relevant Local Government Authority;
The Historical Background;
The population Figure;
Predominant Occupation of Community;
The perimeter Survey of the area claimed;
Proposed usage of the area to be excised; and
The justification for the Excision (i.e. reasons for request).

STEP 2: PROCESSING BY TECHNICAL COMMITTEE
Within 7 days of the receipt of an excision application, the same shall be forwarded to the Technical Committee on Excisions for processing.

STEP 3: CHARTING INFORMATION
The Perimeter Survey and other relevant information shall forthwith be handed over to the Surveyor-General for charting and status advice. This is to confirm whether or not proposed excision falls within any Government Acquisition or Revocation area, which is the basis for considering the application.

STEP 4: SITE INSPECTION
Within 14 days of receiving the Surveyor-General’s status advice. The Technical Committee members shall carry out a physical sit inspection with a view to ascertaining the authenticity of the claims in the application. Where applicable, this should be done in conjunction with representatives of the family, community or village concerned. During such visits, representatives and inhabitants of the community shall be interviewed with a view to obtaining additional information or documents to be considered along with the application.

STEP 5: CONFORMITY TO MASTER PLAN
Before submitting its report, the Technical Committee shall also ensure that the proposed usage of the area covered by the excision application conforms to the master plan of the locality.

STEP 6: SUBMISSION OF REPORT TO THE LUAC
Upon completion of the site inspection and all other necessary checks, the Technical Committee shall prepare a report and submit same to the LUAC detailing its findings and opinion on the application......

General Requirements
for an applicant to qualify for issuance of a Certificate of Occupancy, the applicant must provide the following:
-Survey plan of the plot(s) for which the application is sought signed by a Registered Surveyor or its equivalent
-Produce 3 (three) years current tax clearance, if the individual is of paid employment or in the case of a corporate body, 3 years current tax clearance of two of its Directors
-An affidavit sworn to by the applicant, or in the case of a corporate body, by the director or Secretary of the corporate body, verifying the facts stated in the Application Form
-4 passport photographs of the applicant with his name written at the back of each photograph
-In the case of a corporate body, photocopy of the certificate of incorporation or registration
-Submit with the Application Form, 4 (four) self addressed envelopes along with contact phone number and email address
-Photocopies of receipts issued to the applicant on the payment of relevant fees

Application and Registration Procedure
The following steps are taken in sucessfull issuance of Certificate of Occupancy;
-The applicant fills and returns the Application Forms to the Secretary, Land Use and Allocation Committee attaching 3 (three) copies each of the following supporting documents listed above
-The Administrative Officer receives the Application Forms and accompanying documents and signs the copies of the Application Forms. I.e registers the application and a file number is given to the applicant. The file number is the serial number of the application in the register
For example:
LLJAC/2043-02 Chukwu Obi
LUAC/2044-02 Agnes Ene
-The Secretary, Land Use and Allocation Committee sends a copy each of the Application Forms with the survey plan to the Surveyor General and Director Town Planning for their recommendations
-A memo is sent to Director of Lands to confirm if the said plot is a Government plot. Their recommendations are attached and the file is forwarded back to the Director of Lands who gives the file a new number and forwards to the Pernianent Secretary.
- The Permanent Secretary crosschecks the protesses and, if the process is in line with the approved guideline, makes a recommendation, and forwards the file to Commissioner for approval.
- The Commissioner approves and forwards to Director of Lands through the Permanent Secretary
- the Director of Lands computes fees payable based on plot description earlier submitted and forwards schedule and file to Secretary, Land Use Allocation Committee
- The applicant makes the payments at the designated banks, the applicant submits copies of the bank tellers at the Sub-treasury
-The Sub-treasurer confirms the payment by checking the bank tellers against the bank manifests. If the payment details are in the manifest, a receipt is issued to the applicant by each of the departments. However, where there is no evidence of payment in the manifest, the applicant is advised to rectify payments before a receipt can be issued. The Director of Lands should be informed of such situations
-Applicant submits receipts to Schedule Land Officer who recommends preparation of Certificate of Occupancy to Director of Lands
-Director of Lands signs and forwards the file to Permanent Secretary with recommendation that a Certificate of Occupancy to be issued
-Permanent Secretary sends file to the Commissioner. The Commissioner calls for the Certificate of Occupancy, signs and forwards it to the Registrar of Deeds for registration through the Permanent Secretary
-The Certificate is registered and applicant signs for and collects the original copy from Deed Registry
