Having fallen victim to forged documentation where i paid 250K for building plan approval in Abuja. I have created an online community to collate information on land acquisition and documentation procedure to help prospective property owners in making informed decisions and avoid being victims to fraudsters and other related issues. All land ownership transactions should be registered in the Deeds Registry. This is to ensure that the State Government at every point in time has accurate records of title status of all lands within its jurisdiction as well as to serve as reference point for members of the public who may be interested in knowing about the existence of any rights over land in the State. General Requirements -The applicant is to purchase and fill an Application Form from any of the designated Banks -The Deed of Assignment or Conveyance in 5 parts duly executed by the parties to the transaction -Current 3 years' tax clearance receipts of the applicant or in the case of a corporate body, that of two of the directors -An affidavit by the applicant, or in the case of a corporate body, a Director or the Secretary, verifying the information stated in the Application form -Affidavit of attestation sworn to by every person who signed as a witness to the transaction Application and Registration Procedure The following steps are taken in sucessfull allocation of plots; -Title applicant obtains an Application Form and returns the completed Application Form to the Lands Department together with the following supporting documents; -5 copies of Deed of Assignment executed by the parties, -Current Tax Clearance Certificate of the assignee -An affidavit by the applicant, or in the case of a corporate body, a Director or the Secretary, verifying the information stated in the Application Form -Affidavit of attestation sworn to by every person who signed as a witness to the transaction -The Commissioner forwards the Application form together with other support documents to the Permanent Secretary who forwards to the Director of Lands to process the application -The Director of Lands instructs the Schedule Land Officer responsible for the area in question to open a file, assign a file number to it and forward the file to the Principal Valuation Officer to value the property This is done by a Land Officer II who attaches a sketch plan of the property and submits to the Principal Valuation Officer -The Principal Valuation Officer reviews the inspection and valuation report. If there are no errors in computation and the report, the Principal Valuation Officer signs the report and sends the file back to the Schedule Land Officer. -The Schedule Land Officer notifies the applicant of fees to be paid and the designated Banks where the relevant payments are to be made. A copy of the schedule of fees is submitted to the Head of Accounts and/or Sub-Treasurer -The applicant makes the payments at the designated Banks, he submits copies of the Bank tellers at the Sub-treasury and the Accounts Department The Sub-treasury office confirms payments by checking the Bank tellers against the bank manifests. If the payment details are in the manifest, a receipt is issued to the applicant. However, where there is no evidence of payment in the manifest, the applicant is advised to rectify payments before a receipt can be issued. The Director of Lands should be informed of such situations. -The applicant submits a copy of the receipts to the Schedule Land Officer, who attaches the receipts to the file and sends the file to the Director of Lands requesting for approval -The Director of Lands checks the application to ensure all the necessary information have been provided before making his comments, and forwards the file to the Permanent Secretary, requesting for the Commissioner's approval -The Permanent Secretary reviews the whole process and sends the file to the Commissioner for approval if the transaction is in line with laid down procedures -The Commissioner signs the approval and forwards the file to the Permanent Secretary who sends the file back to the Director of Lands The Director of Lands instructs the Schedule Land Officer to arrange for the stamping and registration and also notify the applicant of the date to collect the registered Title document. -The Schedule Land Officer submits the file to the Registrar of Deeds for stamping and registration -The Registrar of Deeds registers the document -The applicant signs and collects the registered title document Fees Payable The fees that the applicant will be required to pay In this transaction include the following: -Consent/ registration fee -Stamp duty -Ground rent arrears -Inspection / preparation fee -Computer fee -10% penalty incase of defaults. http://www.naijalandproperties.com/community/documentation-approval-processes-anambra/proceedures-and-step-in-registration-of-deeds-of-assignment-or-conveyance-in-anambra/ |
Valid C. of O. duly confers statutory right of occupancy on the possessor and this entitles the owner right to use the land for a period of 99 years after which the C. of O. can be renewed or the land revert back to the government. Procedures: 1. Obtain application form from Lands Department of the State. The following documents are to be provided along with the application form; a. Deed of Conveyance b. One Recent Passport photograph c. Three years tax clearance d. Survey Plan e. Evidence of payment for Application Form f. Evidence of payment for Publication (Advert) g. Evidence of payment for Charting of the survey plan Next step; i. Physical Inspection by the Lands Department. 11. If all listed above satisfies the requirement of the lands department, the Lands Department prepares the Certificate of Occupancy in the name of the applicant and the purpose for which the application is made. iii. The prepared Certificate of Occupancy is then forwarded to the Governor or the designated officer for signing. iv Once signed, the land is then entered into the intelligence sheet to be charted to prevent re-issuing of C of O to another applicant within the stipulated period of 99 years. v. Proceed to final Stamp Duties payment vi. Ratification (now referred to as Regularisation) is a policy of grace that avails squatters on uncommitted Government Land, the opportunity to obtain legal title to the land encroached upon from the State Government. It is the process of allocating Government land to someone who had previously occupied landed property without lawful authority from the State Government. Regularisation is subject to two (2) basic conditions (i) That the property must not be situated in a Government Scheme, Estate or Committed Area; and (ii) The property must be situated within an area that conforms with Urban and Regional Planning regulations and standards of the State. Documents Required for Regularisation A covering letter by the agent or person filing the application for regularisation must accompany the application. This covering letter must contain the following contact details: address, telephone numbers, mobile phone numbers and where possible an e-mail address. A duly completed application made on (Land Regularisation Form 1) obtainable from the Lands Bureau. Application forms for Residential user cost =N=5,000.00, while forms for Commercial user cost =N=10,000.00. Alternatively, the Form can be downloaded from the Lagos State Government website. The Form must be dated and signed by the applicant and sworn to before a magistrate or notary public Four passport sized photographs of the applicant Land Information Certificate Photocopy of Purchase Receipt duly stamped Current Special Development Levy Evidence of payment of Income Tax Sketch Map of Site Location Three Original Survey Plans. Photocopy of Proof of Identity Letter of Authority (if the application is filed by a person other than the applicant) Where building plan approval is required, the additional requirements are as follows: – 5 Sets of Architectural Drawings – 5 Sets of Structural Drawings – Clearance Letter in lieu of Title DocumentsSunprint Copy Of Survey Plan – Coren Letter of Supervision – Calculation Sheet – Sworn Affidavit in Lieu of Tenement Rate – EIA report if land Title to be granted is commercial (2Copies) – Payment of processing fee for building plan approval – Photograph of property Caveat: Acceptance of applications for Regularisation is at the request of the applicant and does not in any way indicate that the application will be approved for Regularisation. It is no more a news that our churches are now competing: who builds the largest auditorium and who acquires the most expensive jet. It has now become a major milestone for churches to build a million capacity auditoriums. The rate of acquisition of expensive jets also leaves one wondering the new trend of evangelism. The biggest question unasked so far is if this has truly translated to genuine souls won for Christ. Unfortunately, the world has never been as confused as it is of today. How can one explain the dissociation between the growth of churches and the state of our society? What missionaries were known for in the olden days are in sharp contrast of the definitions of today. It used to be in form of gathering little to give to the society. Unlike nowadays, where it is taking the little away from the society. The number of contrasting doctrine in Christian world is alarming with Christians aligning and distinguishing with one or the other. Jesus saying of “let no one say I am of Apollo or of Paul……..” seems to have been torn off from the bible. The world is confused and sick. The Christians are supposed to heal the world. But what happens when the Christians are more confused? Salvation and redemption now mean unconditional help from God in time of misery and distress. How long shall our brothers and sisters continue in spiritual indolence? It is time you woke up and strive to recognize the true world of God. I was very proud of my tribe and always ready to share the stories with listening ears. Stories of great black people all over the world were inspiration and encouragement to me. Back to the present, one can hardly read anything good about Africa in the media. News of corruption, extreme poverty and hunger, divorce, armed robbery, violent elections, loss of lives, terrorism and many other unpleasant stories are always the latest breaking news and headlines. Though one cannot ignore these issues with urgent need for attention but the other pleasant stories should not be totally discarded. I wonder what will the coming and younger generations look up too. Too much of negativity is being projected by the media both locally and internationally. This has further brought low our self-esteem. If we Africans do not see anything good about ourselves, what do we expect foreigners from afar to see? Supporters of jungle justice do say that the system is corrupt; they have no trust in the judicial system. They are so quick to cite examples of accused people taken to police stations, only to be seen the following week committing the same crime. They believe the legal system robs the unprivileged and the low class citizens of justice. They believe that justice will never happen if not taken into own hands. It is saddening to see how people gather to rejoice over the killing of a fellow human in a very disturbing manner. A mob of young and old, Men and Women and boys and girls gathers. It is more shocking to know that a large percentage of the mob does not know the offence committed by the suspects. One begins to wonder; how did we degenerate to this point of having no respect for human lives? Africa and Democracy After so many years of gaining independence, Democracy as practiced in Africa has been subjected to extensive debate and controversy over the past years. Some say that Democracy is a foreign concept and alien to Africa. Some people believe democracy is imposed on African nations and does not mean the same in the western and in the African context. As we draw near to the month of September, we eagerly await outcome of major national activity:: elections in Guatemala, Trinidad and Tobago to be held in September 2015. Good electoral processes are unarguably the bedrock of a sustainable democratic dispensation. This is also more evident in many agencies and institution with benchmark setting of a transparent and peaceful electoral process. However, unlike the conventional presidential election process practiced in other African countries, the leader of the largest party or coalition in the National Assembly automatically becomes President in Angola. The People’s Movement for the Liberation of Angola (MPLA), is a political party that has ruled Angola since the country’s independence from Portugal in 1975. Legislative elections were last held in Angola on 31 August 2012. During 2012 pre election period, there were series of allegations on the government by the major opposition party (UNITA) which included corruption and lack of transparency. Also, there was unrest with several protests and arrests on the day before 2012 election. It should be noted that though UNITA accepted the result of the National Assembly elections in 1992, it rejected that of the presidential elections, citing cases of fraud. This led the party into resuming civil war. Election processes were greatly affected as elections were not held during the civil war. The Grand father of corruption. Greed! How could you enslave us all. Just a quick view into our environment will lead into conclusion of greed dominating all. Irrespective of age, religion or tribe. The main issue of corruption which has plunged Africa into the depth can be mainly attributed to greed. We all are greedy. We only seek to acquire at the detriment of others.
