Do bot do any of the said by most people they don't own anything and are the best to advise. Seek advice from competent lawyers.

Na them(the ministry) wey go help you bundle the tenant out with law.

The said tenant was owing over 1 years rent, not paying and not leaving.

Tenant was charged to court. The case has been ongoing for more than a year. Tenant and her lawyer do not show up in court on hearing date and have been adjourned for this reason each time...

Now running to almost 3 years in the flat without paying rent and without leaving....

Carry her name to Benin shrine....and hand over her case to the association of witchcraft in Benin.....you will definitely thank me later...

OP, you made a stupid mistake, why would carry your house give single lady? Single ladies, widows, divorced ladies are not reliable....avoid them like Ebola...
Lemme advise you, if you want to give your house out for rent, give it to those who have a reputation to protect.
The question is how will I know those who have a good reputation...?
That's another great assignment and if you cannot detect, give the job to reputable lawyers with good track records to do for you...

As for me, I will give them a form...and from what a tenant filled in his or her form, I can detect something from him or her and after that, I will ask the interested tenants to come with all those who want to live in my house...some will not show up while some will show up....from there you will know those who will not listen to your instruction....and you will ask all the family some inquisitive questions ....
By the time, they pass through different stages, those who are well-behaved will abide but those who are arrogant and brutish will not show up again...
In your interview with them, observe all kinds of little bad signs....and some links they have ....from the link, you could be able to predict some things about them...
And never drop your account details until you are well satisfied with the kind of family coming to live in your house....you will also verify some of the information he or she has filled in his bio-data form and also confirm about his or her behavior from her or his former landlord...
If you are not satisfied with all your finding...just tell the tenant that, he should look for a house elsewhere...after all, you haven't collected any money from them...
For you to have peace of mind with some tenants, you must be strategic...in your doing....don't let them occupy your house with friends and cronies from the same tribes, region, status, age group bracket, field, except a big and reputable company is standing as their guarantor....let them come with at least 2 big reputable guarantors
For my own house, I control it stressless because I have done what I needed to do before each tenant moves in...if any tenant wants to misbehave, I will first call his sibling and if there is no positive response, I will call the guarantor because the guarantor has signed a league with the landlord.....

Some landlords are just interested in the money Nd not in the person or family that will come and stay in the house...

My brother....your lawyer is. not smart enough...and some of that evil. lawyers connive with tenants so. that you keep on paying the appearance fee....an average Naija lawyer is wicked...3 years on a civil case....?
Don't worry, what you suppose to do is to be tracking all his resources because the court will. ask her to pay all your money but if you don't track her now and where she some of her property or bank details you might just lose all the money...but if you can track him...and they discovered that she has property or a huge sum of money in any of her accounts....or she has a car or any property whatsoever? After the verdict, just approach the court through your sluggish lawyer and let the court grant you an order to either garnish her money in her account or her car or any property in any part of the country that you are sure she owns...

OP, this is one of the old newspaper single ladies that I was talking about.. Most of them lack manners and if you battle with them, some fools here will. say probably because you toasted her and she didn't agree and so you want to eject her, or she may claim domestic violence or sexual harassment or molestation...so, to avoid woman wahala, struck them out of your intending tenant's list...

I am sharing a decade-long experience I have gathered in the real estate business...

The olosho that just quoted me should come and try the rubbish in any of my houses...if she will not lose all her life savings...I have done it before and I can still do it again...
The garnish you talked about, you will have to invite all banks in Nigeria and it will cost you money just to find out if has money in any of the banks in order to settle his debts. Enjoy your morning

It’s simple. As long as he owes you rent you don’t have to give him the 6 months notice rather 7 days notice of owners intention to recover premises thereafter you charge him to court.

Now this is the trick. In a Tenancy Recovery matter where the defendant tries to play smart and not come to court, all your lawyer has to do is apply for default/summary judgement as from all indications the tenants are not ready to appear for the matter. (25 days tops the tenant is out).

Where are you situated?

Just curious ,how much is it legally for the agent an commission charge,like what percentage is it? Also isn't caution fee returned if a tenant didn't damage any thing?

Ordinarily the issue of commission charge is usually left for the agent however there have been situations where such fees are negotiable so it’s up to your wits..

Yes caution fee is supposed to be paid back but it’s become a norm for them to refuse refund and most caution fees are so meager that going to court over them becomes a waste of time and resources.

Ps: when going into an agreement with an agent, ensure to notify the agent that you’ll be requesting your caution fee back where no damage occurs and should he fail, then you might take up legal actions (just a threat though lol) they most times do end up refunding a fraction of it.
