You're right but things has changed lately. You will be deported if you go to federal prison for a felony. That is automatic. State prison depend on the State. Some State will not report non citizen to ICE and will just release you after the end of your sentence but the guy in question was sentenced to federal prison and homeland security prosecute his case. People who know him should have advise him to run when he was on pre-trial release cos Naija better pass jail oo.

Having kids there doesn’t protect you.

Having citizenship does but to an extent. Naturalized citizenship can and has been withdrawn before.

He most definitely will be deported. One of the oath you take when you are approved for a green card is that you will stay out of felonious crimes such as robbery, rape, murder, fraud, impersonation, illegal possession of firearm, drugs, etc.

If you commit any of these offenses, the first thing the court does once you are charged is to notify Immigration and Custom Enforcement (ICE) of your crime and they also notify your home embassy, in this case the Nigerian embassy closest to the court jurisdiction.

Once the offender is sentenced, ICE keeps a track of ylthe court case. Immediately the sentence is served, ICE will proceed to arrest the individual and put them up for deportation proceedings in from of an Immigration judge. Once the deportation is approved, the person will be on the next flight to Naija.

Nigerians dint listen. Money is not running away. Get your blue passport first. Once you have it, at least you are sure that if anything happens, you will not be deported. Any document other than a blue passport, will most likely lead to deportation.

Aggravated felonies include drug trafficking, murder, rape, money laundering, sexual abuse against minors, perjury, and other crimes.

Conviction of an aggravated felony will result in deportation. More importantly, convicted non-citizens won’t be allowed to re-enter the United States.

Legal Protection Against Deportation
Green card holders who violate U.S. laws aren’t removed immediately. This gives immigrants a chance to protect their legal rights in immigration courts.

Some cases may allow you to obtain a waiver that grants legal forgiveness. Defendants must apply for this waiver, and your immigration attorney can help you determine its availability as well as other potential strategies for your protection.

Green card holders have the legal authority to reside in the United States. Although this provides some level of protection against removal, it doesn’t mean that these non-citizens can’t be deported.

Understanding the reasons why green card holders may be deported is the first step in securing your legal status in the U.S. Consulting with an experienced immigration attorney gives you the resources you need to protect you and your family’s wellbeing.

For certain crime, Citizen by Naturalization can also be revoked and deported to country of birth.

What you are trying to say is if you do illegal things, you can declare to run for president to avoid being held accountable. Running for president shouldn't be a cover to evade justice

What Trump did is something only 3rd world countries do. Even in 2000 election between Bush and Al gore that was decided by less than 250 votes, the loser still conceded and gave a beautiful concession speech and moved on.

If Trump is not prosecuted for his actions, it will be emulated by all politicians across board. Imagine if Biden loses in 2024 and follow Trump playbook to overturn the election and now declare to run for the next election to avoid being prosecuted.

Everything Trump is facing is strictly by his own making cos of his flawed character. We all saw the tweets, the videos and audio of him doing what he was accused of.

No Sir. That is now America justice system works. Prosecutor do not deport. ICE deport people from America. Once you're sentence to a prison, the prison official will inform ICE when a non citizen arrive and ICE will put a detainer on your name. The detainer prevent the prison from releasing you after you complete your sentence. ICE will pick you up from prison the day of your release and transfer you to ICE holding prison waiting for deportation. They wait because it's cheaper to deport people in groups. They charter a plane, load people going to countries closer to each other like Ghana, Nigeria etc and off they go. Case closed.

There is no exception unless it was part of a deal (this rarely happens) where the prosecution agreed not to deport him.


I think you missed the part where I said it rarely happens, but it does happen.
I know a case where some people were extradited from the SE of Nigeria to the US in the late 70s for drug dealing and were handed very long sentences (40 to 50 yrs). They all came from the same village. The guy who gave them away was a green card holder at that time. The prosecution knows that if he should return to Nigeria, he will be killed. He is allowed to remain in the US after serving his time simply because he cooperated with the govt and gave valuable information about the main guys behind the drug trade at that time.
So, if you can give the govt enough valuable information about crimes, the prosecutor and the judge can agree to make it part of the sentence that the defendant should not be deported even after serving his or her time. The information and corporation must be worth it for the govt to make such a recommendation. It rarely happens, but it can and does happen.

Even with US citizenship, after leaving prison, it's tough to get your life back in track. Nobody wants to employ someone just get out of jail and without job to pay your bills, person life go spiral out of control quickly.
America has high rate of recidivism because the system never forgive even when you pay your dues to the society.

True, but all things being equal, better to be a US citizen than not when dealing with the exact same situation. Like in this situation, with a US citizenship, the guy would at least be able to stay in the US with his children. And though he would be a felon, if he really wanted to he could find opportunities. But, because he's not a citizen he'll most likely be deported.
