This was not done, though clearly it ought to have been done. Therefore i would raise the defense that Equity regards as done, that which ought to have been done. And where Equity conflicts with the Law, Equity shall prevail.

Edit: Furthermore, the defense of provocation if properly applied would almost certainly ensure that the sentence would have been reduced to the bare minimum.

In my own case, I had an argument with my ex and we were not on talking terms for 2 weeks (though I was busy with work during that period). When I got back, I paid her a visit & needed to use her phone only to discover she's been flirting with other guys and even spent the night in a guy's house at the same time planning to spend the weekend with another guy.

She tried to wrestle the phone from me but I refused and kept it in my pocket.. Next thing she did was to tear my trousers and singlet during the struggle. That was the moment I lost it

There is yet to be a break in the chain of event because the woman is still suffering from the injury she got seven months ago because of the man's physical abuse of her.

You were talking about negligence. On whose part is the negligence supposed to be attributed to the man or the hospital.

It is the right of the person that was being physical abused to either file for assault or manslaughter because all of it was as a result of the man's physical abuse of the lady l.

I do not agree with those who say no matter what a woman does never hit her. What we should be preaching is NO One should hit anybody, No hitting of men, women, children.
