Hello everyone,
I need an advice on an F1 visa issue and will really appreciate if I can get a way forward out of this. I know this house is full of gurus and highly blessed. Kindly help a sister in a jam.
My story goes thus:
Sometimes in 2016, my pregnant sister and her husband with their son applied for a US tourist visa and were granted. During the interview, the consular asked whether my sister will visit the doctor and she replied negative. My sister spent 5 months in the US and returned with the child. Their visa expired and the husband is the busy type and has no time for the renewal. Fast forward to this year, the husband was granted admission for a graduate study in the USA and was even offered a little scholarship by the school. The husband applied for F1 visa and was refused. During the interview, the consular stated that the husband travelled with his wife without their child to the USA two years ago and gave birth there after having misinformed the then consular that they will not visit the doctor. She asked where the wife is and the husband answered that she is at home with her business. She also asked how much was paid and the husband answered. The consular also asked for the receipt but the husband answered that when the wife is coming to renew her visa,she will bring it along. My sister's husband doesn't want to miss this scholarship so he wants to apply again before the school resumes this month. What can he do to be granted the visa? Should he apply with his family again for F1 and F2 visa? Any suggestions from the gurus and VO's in the house?will really cherish one right now. Thanks.

Your wife was asked specifically if she was going to have a baby and she answered no. The fact that she went ahead is misrepresentation. The VO set a trap for you. Check on the birthing thread for cases of women in this same situation. You will see that it is not easily surmountable with some women being denied several times even after showing full payment. Even if you present your receipts the fact is you cannot be trusted to abide by the terms of the visa category given. My advice: you (the student) can apply again in time for the school program and try your luck. Your wife may find it difficult to renew, even if all bills were paid

Had my interview today with my wife and son. Embassy was crowded as expected. Got there in time to do the pre-interview screening. Got on the queue and watched how the VO on window 6 was having a field day dishing out pink papers though he gives you every chance to overcome the normal presumption. Eventually I got called to window 9. So many pink papers by the way.

TRANSCRIPT
ME: Hello, good morning.

VO: Passports please.

ME: Gave her with smiles.

VO: Where in the US are you taking your family?

ME: Orlando, Florida for Christmas holiday.

VO: Have you travelled as a family in the past?

ME: No (I brought out my old passports) but I've been to the UK in the past as a tourist and masters student.

VO: Don't worry about that.

ME: Smiles.

VO: I can see you are in banking. How long have you been with XXXX bank?

ME: Told her.

Now facing my wife.
VO: Madam how long have you guys been married?

MY WIFE: About 2 years now.

VO: What do you do?

MY WIFE: I'm the MD/CEO XXXX. Specialists on bla bla bla.

VO: I see you have a son already (pointing at my son sleeping on madam's shoulders). Do you plan on having more kids? (In my mind, how e carry concern you?)

MY WIFE: Smiling. Yeah but I'm not pregnant yet.

VO: Typing vigorously as though she has a deadline to keep. Stretches out her hand. Heaps of white papers and another heaps of pink papers.

Grabs a pink paper and started some hard-core rap I can't remember.

We said thank you and left.

MY wife and son have been sleeping since that morning time till now. Should I go back to the embassy tomorrow morning?

Lol yes , everybody and their mama don turn to immigration lawyer. Unless one has a complicated case like deportation , one should try to file by yourself. All you need is basic reading and writing skills . Most of the information you need is on the USCIS website . I have seen too many people getting bleeped by attorneys and paying thousands of dollars for it.

Exactly , I know want that people want the America dream( I’m not sure if even exist) but not everyone can have it . The truth of the matter is , everyone can not live here. Someone people do not have a pathway to citizenship and some phony lawyer will them that they do and they end up being stuck. It just better do it your self , and any information your not clear on , you research yourself. Please no one should kill themselves to come here , there are other places where you can hammer as well.

I now create another ds form got new application Id for my wife and I . Went to update my ID on appointment page but can't change my wife own because she was filled as dependant . Mine change but how can I change or update her own?

In the interests of sharing... sent dropbox off on 2nd July, case created on CEAC on the 3rd, status changed to administrative processing on 13th, issued on 16th and received a text for pickup today. Nothing additional requested. Thx for the assist.

Minimum of about two weeks/10 working days. That's with no hiccup (I noticed that the issue date in my passport was the same as the date it changed to admin processing). Others may tell you different.

Pls guyz I am currently filling my DS 160 form. I work with one of d Fed Govt agencies and I also have a business, will I put the combined income in the monthly income space or I should put what I earn alone frm the Fed Govt, den while filling additional work that’s if dere is an option for that as I haven’t gone beyond my current page yet. To fill for what I get frm secondary place of work. Need a response tonyt pls?

I think it is cutting it quite close as they tell people anywhere from 10 to 15 working days minimum. If there's anyway you can postpone your event on the 16th try, or else you may have to try to get your passport back. Best of luck.

Is it possible for the husband to reapply for f1 while the wife and the kids apply for f2? Although they might not accompany the husband now.
