The Senate is currently working on an amendment to the 1999 Constitution with a view to conferring indigeneship of a state on any resident that has consistently lived in that state for at least 10 years.

The proposed law is titled, “A bill for an Act to alter the provisions of the Constitution of the Federal Republic of Nigeria, 1999 to define who is an indigene of the state.”

The bill, obtained by our correspondent on Friday, was sponsored by the Chairman of the Senate Committee on the review of the 1999 Constitution, Senator Ovie Omo-Agege.

The bill seeks to alter Section 31 of the Principal Act by inserting new subsections 2,3 and 4.

The new provision states that someone could become an indigene of a state if he or she was born in that state, or if he or she had lived in the state for a continuous period of not less than 10 years.

Such a person, according to the proposed legislation, should be able to show evidence of residency in a given local government area for a continuous period of not less than 10 years.

The person must also have evidence of tax returns issued in the state for a period of not less than 10 years; and should not have been convicted for a criminal offence.

It reads, “A person mentioned in subsection (2) of this section (3) shall be entitled to apply to the local government chairman for a certificate of indigeneship of the state.

“A woman who is married to an indigene of a state for a period of not less than five years shall automatically be an indigene of that state.”

The proposed law, however, gave conditions that could make a woman who was divorced or became widowed, remain an indigene.

It states that the marriage of the woman must have been for a period of not less than five years and that there must be children born in the marriage.

The bill would also alter Section 318 of the Principal Act to now define “indigene” as a citizen of Nigeria who is indigenously born to a state.

Such a person, it added, should have been granted indigeneship of the state after an application to the local government chairman.

A woman who is for a period of not less than five years married, divorced or widowed with children to an indigene of the state, the bill added, is qualified to remain an indigene.

The issue of state of origin has become highly controversial in recent years.

It reared its ugly head last week again when members of the Cross River State House of Assembly failed to confirm Justice Akon Ikpeme as the substantive Chief Judge of the state.

Her main offence is because she is not an indigene of the state.

Ikpeme is of Akwa Ibom parentage. She was born in Calabar, Cross River, when Akwa Ibom was a part of Cross River.

She is married to a man from Cross River and has been working for decades as a judicial officer, including being a director of public prosecutions and a judge in Cross River.

Akwa Ibom was created out of Cross River State on September 23, 1987, by the military regime of Ibrahim Babangida.

But the Cross River State House of Assembly, Tuesday, declined to confirm Ikpeme as the chief judge on the grounds that she could become a ‘security risk’ to the state because of her ties with Akwa Ibom.

She had been in acting capacity since December 3, 2019, following the retirement of a former Chief Judge of the state, Justice Michael Edem.

Ikpeme’s tenure in acting capacity ended Monday, March 2, 2020.

But this might not work. We all can tell what tribe anyone is from just from their names. But it’s all good. One Africa is the final goal.

Someday in the future, my grand kids should be able to take a train ride from Ikeja to Nairobi.

Corona virus is threatening the worlds economy and my people have not started making progressive plans on how to avert economic crisis that would surely arise from it.

These are not the kind of laws we want to from these senators, I mean how does this kind of laws improve our current state of economical handicap, our current state of industrial barrenness or is it our current state or ethnic divide ?

All the political elite should concentrate on are industrial development and economic growth so that more people can be employed and the enormous wealth of the great country Nigerian can be distributed.

The tribes must agree to that. You can’t just come and make a decision affecting tribes who have resided in their territory for 1000’s of years because you have refused to develop yours or grow. You will now come to their land and replicate the failure you are bringing from your ancestral land to theirs. We are Nigerians because tribes agreed to be. Never forget that. Be content with your territory or develop it. Don’t force yourself on others.

You are right but what do you expect to become of mumu people who can't protect their land? You lose what you don't protect. Don't let us deceive ourselves, Yorubaland is the only land open to be taken over and it's the only reason the bill is being passed, and Yoruba senators will vote for it if they are not even secretly leading it. Yoruba have lost land and will continue to lose land, with the young children of today sending curses to their parents wherever they are for screewing up their lives. I don't know how cursed a people can be.

We want restructuring first.. Let every state have independent power to institute laws that will protect and provide for her indigenes without the intervention of the Federal might....


Oil rich states should be allowed to exploit, produce and refine it's oil by itself.... And to remit 25% to the FG...

You, Nigerians go to the UK, US and steal theirs abi fight for your rights in court and protest over there. This is another man's land that is ok abi?


Myself am not even outside my region but I support the bill.

Give some people who have stay in a particular area for long "some" rights.


But i doubt if the bill will see the light of the day going by the nothing work syndrome in Nigeria.

I have never seen a self-hating selfish people like Yoruba in my life, even in the face of danger. The children they bring to the world are nothing to them. Yoruba elders no longer care about the concept of "jeun omo" cos they have sold out the future of their children. You can't leave overseas and go and build your 3 br barndominium in a nice forest and stay close to nature because of foreigners living in Yorubaland who will not only robb you but kill your entire family too. Yoruba living standards have been badly affected by the immigrants who contribute nothing to our land but sniff life out of it. At this point, Yorubaland is putting itself in a tighter corner it won't be able to get out of. I'm just one person and I'm even tired of talking about this, I know Yoruba goose is already cooked and it will take some divine intervention to get out of the hole Yoruba are digging themselves in.
