MaxInDHouse:I understand your concern and it is very valid because this is Nigeria and people do crazy stuffs You see the letter I wrote was consciously to tackle everyone involved so they can do what is right. This include, the church itself, the CDA, the Police as well as Ogun State Environment Management Team. The GO of that church has a lot of influence and heavy political connection which was why they were misbehaving in the first instance. But the letter was not about me rather it was about the instruction given by State Government, as established by the state House of Assembly and can be enforced by the police and state judiciary. So the case here is the state versus the church, not me versus the church I hope you understand why it is powerful to use this legal force in compelling noise polluters to desist from such act. , . |

The problem is that most folks start religious organisation without knowing that their sound system can be a source of noise pollution, besides most Nigerians are ignorant of the law against noise pollution as such they can press charges against such offenders. |

They did not want the situation to change, if they want it they will naturally resolve it particularly via legal means I did not wait for the complain to the CDA, i did not bother pleading with the church, I went the legal way and the issue was settled. The reason for writing this topic is to help anyone who truly desire to stop noise pollution in his area. It worked for me because I went the right and legal way, because i wanted the noise to stop. You saying that the State backed legal step i took to quell noise pollution did not work without you doing it as explained is quite unfortunate. |
AntiChristian:Did you write an official letter to the religious offending organisation? The you state the Noise pollution law of Lagos State in the letter? See, the issue here is this it only takes legal teeth for people to seat right. If you include the noise pollution law the organisation was violating the letter, if you report the case to the nearest police station showing proof that the organisation is violating the law, the police will naturally investigate the issue because their duty is to enforce the law. Section 23 Section 23 states: “Noise Pollution (1) No person shall create noise from -- (a) any of the sources mentioned in Schedule C or any other source exceeding 90 decibels in industrial areas or 70 decibels in residential areas” Schedule C Grinding machines, Churches, Mosques, electricity generating set, construction plants, record shops, studios, ceremonial activities, household gadgets, playing ground, road traffic, rail traffic, discotheque, car-park, barking dogs, indoor ventilation system, amplifier and other office appliances. So how do you use it Step One: Write a letter of complaint to the offending organisation regarding their violation of the state noise pollution law. You need to state this law in the letter because the leadership of most religious organisation do not know that this law exist. Step Two: If possible include the community development association where you reside. You do this by tagging the CDA Chairman in the letter using the CC: format and send a copy of the letter to the leadership of your CDA (Address the letter to the Secretary of the CDA). This is important because the CDA automatically become a witness to your claim that the organisation has violated the law I tried this myself in tackling a church that was making crazy noise in my hood and it worked. I guessed it worked because most people in Nigeria do not know the law regarding noise pollution, beside when they read that the information in the letter could land them in government wahala they quickly complied. Please note I am not a lawyer, I only used the available legal information in solving the noise pollution problem facing me and the people in my community. I had a terrible experience regarding noise pollution by one church about 100 meters away from my house. The noise is so irritating and frustrating to the point that I visit the church on several occasion to complain about the useless noise the church was making. Alas the church authority proofed that they have coconut head and remained stubborn by failing to reduce the noise level of there noisy church. So I decided to do a bit of legal research on how to fix the problem and eureka!!! I found the solution. Here is how I did it. I went to Ogun State High Court Complex at Isabo, spoke with some folks in the court about my problem and they directed me to the Library section of the court. There i was provided with the legal documents regarding Noise pollution in Ogun State. I found from the document that Ministry of Environment is in charge of issues relating to Noise Pollution or Any form of Pollution in general. Also there is law in place made by Ogun state government regarding all forms of pollution including noise pollution. Below is a copy of the letter I wrote to the church regarding their noisy church service. Sir Violation of Ogun State Environmental Management (Miscellaneous) Provision Law This is to officially notify you and the entire church authority that the noise from your church services, particularly the noise emanating from your church sound system is polluting the community which is a direct violation of the Environmental Management (Miscellaneous) Provision Law under the Law of Ogun State, 2006 Volume 2 Schedule C. Section 23 Section 23 states: “Noise Pollution (1) No person shall create noise from -- (a) any of the sources mentioned in Schedule C or any other source exceeding 90 decibels in industrial areas or 70 decibels in residential areas” Schedule C Grinding machines, Churches, Mosques, electricity generating set, construction plants, record shops, studios, ceremonial activities, household gadgets, playing ground, road traffic, rail traffic, discotheque, car-park, barking dogs, indoor ventilation system, amplifier and other office appliances The extreme noise coming from your church sound system is above the required 70 decibel sound threshold for residential areas as stipulated by the law, thus, your church is violating the law of Ogun State. For your information, at the stipulated 70 decibel sound level, residents beside and directly opposite your church building will hardly hear the sound coming from your church not to mention people like me residing two streets away from your church. Unfortunately, despite the fact that the distance between your church building and my residence is about 100 meters, the sound pollution from your church disturbs us badly, the sound pollution from your church even gets worse whenever your church hold vigils. Kindly desist from violating the state noise pollution law and allow peace and posterity reign in our community. Note, this matter will be escalated to the right authority if your church fails to stop violating the state noise pollution law. Sincerely" Ever since I wrote this letter to the church, they have stopped their lousy noise. Their compliance was not surprising because I included the community chairman as well as the Bale of the Community in the letter by sending them a copy each, this i did to add legal weight to the letter and also have witness in case I need to escalate the matter. My plan was to write a letter of complaint to the nearest police station about the church's violation of State Law regarding Noise Pollution and attach a copy of the the letter to it as evidence ad it been that the church continued in their coconut head attitude. So if a church, Mosque or any organisation or individual is making undue noise above the government approved decibels for both industrial and residential locations you can use the copy of the letter above as format. I am certain that they will comply, but if they fail, then write a complaint letter to the nearest police station regarding the issue and see what will happen. |
Well the issue about passport in Nigeria is basically about power play. Some folks want to take over the printing process from the former contractor who contract duration never expired. I remember applying for a new passport in Dec 9TH 2015 and got it the same day at the Abeokuta NIS office. As a matter of fact lots of folks came from Lagos to get their passport that day. I paid N25K to the NIS guy that i was refereed to via a friend. The cost of the passport was actually 17k or so then. (The way Nigeria officials are going about the Nigeria Air thing is gradually proofing the likes of Reuben Abiti and Madam Oby right about their criticism of poor preparation. Who does an airline business, especially an international airline business without first securing the domain name for the next 10years. I believe the Nigeria Air runs was packaged hurriedly to prepare a soft landing for Buhari and APC in coming polls. If everyone involved in making the airline a reality forgot about securing their official domain before going on publicity drive, how on earth do they want to tell Nigerians and the entire world about their seriousness. Do they even PR team in place? On a good day all information about Nigeria Air should have been uploaded on the official website now, thereby creating positive image and generate massive goodwill for the venture. The first thing that should been put in place should have been the official website containing relevant information about what the Nigeria Air Team are doing.
