Well "mock" is the key word. Again in practice, courts in Nigeria don't allow u to give opening and closing argument/statements like they do abroad. You can only adumbrate on issues in your final written address, and you have just a few minutes. Some judges won't even let u do that. You would just adopt your written address as you final arguments in the case, and the court adjourns for u judgment.

Yes i am a lawyer who just resigned my job with a firm that is a household name for criminal matters. The character profile of parties has no bearing in the trial of a case. It only comes in handy when you are making a plea of allocutus. All that talk isn't a fact that can prove rape! Even if a nun is claiming rape, it won't blind the court from examining the cold facts of the case with regards to whether the offence has been proved sufficiently beyond reasonable doubt.

The defendant has a long standing history of luring women of working class background into false imprisonment and then rapping them. Thereafter, he takes them shopping to deter them from bring action for the offence of rape.

The mens rae element is intention and clearly the defendant has admitted that he had sexual intention.

The actus reus element is penetration without consent and evidently in my client testimony, he inserted his penis into her virgina and raped her serevely without the consent of my client.

My Lord, the defendant should be prosecuted for the offence he had committed.

All that would be just entertaining the court, the main issue is to prove all the elements of the offence of rape. The judge may not record most of all u said because it has no bearing on the case for rape. What is your definition of false imprisonment? What mission of getting to know a friend, that would make her leave her comfort zone to see a total stranger that could even be a murderer? Oga,she won't win the case. The man is not on trial for adultery, that is not a criminal offence. What concerns the court whether she was lied to?What the court will look at is if the prosecution can prove the elements of the offence of rape beyond reasonable doubt.

She cannot win this case.Firstly, no where did she say the man locked her indoors or kept her against her will. She had free entry and exit so much that she wad going to the hotel poolside. If she was deeply convinced that she just suffered rape, what immediate steps did she take to leave the hotel? Did she go to a hospital? Rape case cannot survive on the mere allegation of "I told him no, yet he forced himself". The law and Courts do not give judgment based on emotions, you need evidence to verify the cold hard facts!Did she call for help? Her phone was with her, did she open up to a family member or anyone?Can she say nobody would have been able to give her fare back home?

I have handled a case where after the incident the guy opened the door and the lady ran out half naked, crying. That was how the guy wad apprehended.A good Samaritan took her to a General hospital and yes we won the case!Secondly,the fact that the man is married doesn't change anything. Most wives know their husbands are not faithful. Infact in most cases the wife would appear with the husband in court till judgement is delivered! Even if she decides to divorce him afterwards, do you imagine she would want her husband to go to jail? Thirdly there is no financial compensation for rape victims... The only justice you get is seeing the accused behind bars. Lastly, whatever evidence of vagina injuries she had has already been compromised due to lapse of time. A medical examination is recommended immediately after the incident, that way the doctor can get proof of semen, blood from the bruises caused by forced entry. You can't win a rape case without a valid medical report corroborating your case!
