There is no judgment like that anywhere.you can read yaradua vs buhari supra hundred times.there latest judgment on fct status is in 2021.besides,the apex court judges are very predictable
Check Obasanjo vs Buhari.

. To me there is no problem.
,1 The intention of the Section 134(2)(b) of the Constitution is that, the candidate, in addition to having the highest number of votes cast at the election, must also poll not less than one quarter (25%) of the votes cast at the election in each of at least two-thirds of all the States in the Federation (36 States) and the FCT (a State kind of), thereby making it 25% of votes cast in at least 2/3 of 37 States. 2/3 of 37 is 24.6. Since no half of a state so we look at 27 as the 2/3 of 37 states

2 I also believe that where there are two possible meanings conveyed by the words of a statute or the Constitution, it is the most reasonable one. that will be taken so as to avoid absurdity..
3. The issue under reference was before the Supreme Court, in 2003 in the case of Buhari Vs Obasanjo (2003) All NLR 168, the apex court iheld that if there’s any issue on the provision of Section 134(2), they’ll toe the part that accords with common sense. They further undertook that the court is bound to adopt a construction which is just, reasonable and sensible.
4 what will now be more sensible ? To take Abuja asa soecial entity or to give him a toga of a state as decided by SC in earlier Judgements? In my opinion Having 2/3 majority votes cast in 37 states is more logical .
You may be right but there is another judgement in 2008 that clearly emphasized on the need to get 25% in Abuja.

This will be the first time we will be going this route so the Judges will surely give it their own interpretation.

S. 134(2): He has not less than one-quarter of the votes cast at the election in each of at least two thirds of all states in the Federation and the Federal Capital Territory, Abuja.”

The words here are "each" and "and".

Each is a distributive adjective pronoun, which denotes or refers to every one of the persons or things mentioned; every one or two or more persons or things, composing the whole, separately considered.” (SC in Eyisi & Ors v State 2000)

And is performing the function of joining two expressions or sentences which could be inseparable, integrated, joint or matched. (SC in Buhari v INEC 2008)

I think even though the SC has not ruled on the electoral status of the FCT, it will be treated as a State.

IGBOGENE27:
It is not an issue at all. In an election petition suits, petitioners are not allowed to sue a party that was not declared a winner by INEC. In Hope Uzodimma 's case, did he sue the candidates that came 2nd and 3rd? The answer is No. He only sued the person that was declared the winner by INEC. When he proved his case, did the court not declare him as a winner? The court did.

Election petitions are not normal cases as he think, even Lawyers that are not in the field cannot handle it. That APC included it in their petition, does not make it right. It may have been included to serve as a time waster in court.

The commenter is obviously not abreast with the practice and procedures for election petitions.
Ok. Let's see how our judge will be truthful about the case.
Politics › Re: INEC To Tribunal: Obi's Petition Is Abusive, Incompetent And Should Be Dismissed by rolams(m): 8:08pm On Apr 11, 2023
I think Atiku's petition may be strong enough to make court declare a rerun. The INEC and APC has not shown a serious defence thus far. Only technicality is what the APC and the INEC is relying on.

FreeStuffsNG:
How is not suing Atiku and PDP pre election matter? How is the absence of Mr Obi's name on the register as at the deadline pre-election matter? Even if there is a waiver , it must be submitted even before the primaries and acknowledged by INEC and accompany his petition but Mr Obi resigned from PDP on May 27, joined LP on May 28 and primary held on May 30 while he was not yet a member of LP.

It is the legality of his membership and participation which he is using to file a petition so if he has no locus standi the courts have no basis wasting its time!

The APC willfullly waited till now after the election so that Mr Obi can cancel Alhaji Atiku of PDP and Obi did the job for APC. Now it is time to legally dispense with Obi for doing a thankless job of destroying PDP.
The only issue I see here is the failure to sue/include Atiku but the irregularities issue raised in the petition may still give Obi the chance.

OfficialAPCNig:
We have finally seen the almighty Wole Onipekun repose to Labour Party and Peter Obi petition after hiding for days to receive PO's court service.

Dude is relying on technical ground to win the petition for their master meaning they have no substantial defence against LP and Peter Obi. They didn't even have solid argument for their 25% requirement for Abuja and Tinubu drug cases.

Sadly, for them, the Appeal Court, today in a separate suite filled by APM or whatever their is, destroyed the only little leg APC is hanging on for survival.

APC BATists should go and ask Ngige what he saw in the hands of Peter Obi and Ikpeazu SAN

grin grin grin
Obi should have included Atiku in his petition. That's the only strong argument/technicality I see in the response.

seunmsg:
Serous cost for wasting everybody’s time.

The APC equally argued that the petition was improperly constituted having failed to join Atiku Abubakar and PDP who were necessary parties to be affected by the reliefs sought

“By Paragraph 17 of the petition, the petitioners, on their own, stated that Alhaji Atiku Abubakar came second in the presidential election with 6,984,520 votes as against the petitioners who came third with 6,101,533 votes;

“At Paragraph 102 (ii) of the petition, the petitioners urged the tribunal to determine that 1st petitioner scored the majority of lawful votes without joining Alhaji Atiku Abubakar in the petition.

“For the tribunal to grant prayer (iii) of the petitioners, the tribunal must have set aside the scores and election of Alhaji Atiku Abubakar,

“Alhaji Atiku Abubakar must be heard before his votes can be discountenanced by the tribunal,” it said.

This point alone has destroyed Peter Obi’s petition. The quacks who filed Obi Obi’s petition will be sweating after reading this technical point. Wole Olanipekun is damn good in destroying cases on technical grounds.

To delusional obedients, it’s game over. Obi’s watery case has been shredded to pieces.
The technicality here strong die!

I wonder if Op had thoroughly gone through all the petitions before saying this. Are there no mutilation of results? Are there no votes suppression?

Concerning the drug issue, can hushpuppy become a president in Nigeria?

Untouchable had unknowingly use a girl for two different pranks, had it being I'm less busy , I would have take my time to search for it and drop it here for you to see, there's a particular one too that the lady he used was poor in acting, her countenances and anxiety gave them out as a staged video...

As for the trinity guy, that one na mumu, his pranks hardly makes sense and are too extreme has it mostly ends up putting him in troubles, he's not a relationship prankster...
