Thats question is for those who told you that Ironsi introduced unitary system. The person who actually introduced unitary system is Gowon who abolished the 4 Regions he inherited from Ironsi with Decree 14 and created 12 'units' or states to replace them

Elumelu doesn't have the locus standi to challenge how another political party that is not his nominates it's candidate.
It's not his business how labour party chooses to nominate it's candidate...this is the position of the law.

The case will be dismissed and thrown out by the court of appeal
1. the tribunal lacks jurisdiction over all pre election matters.
2. Elumelu lacks locus standi
3. time permitted for filling of such cases in the high which is 14 days have long elapsed

I am not wrong, the electoral act is very clear on who have constitutional right to challenge nomination processes by political parties.

Elumelu in PDP doesn't have the constitutional right to challenge how labour party nominates it's candidates no matter how flawed the processes are.
Only an aspirant who must have participated in the party primary can seek redress in the high court not even the tribunal cos all pre election matters goes to the high court.
Elumelu was not contesting the party nomination of Ngozi... What he is contesting is that Ngozi didn't participate in the primary election so how come LP forward his name to INEC and therefore votes that belong to him should become void and the court rule in his favour.

All matters that has to do with how candidates are nominated by political parties for elections are treated as pre election matters .

nomination of a candidate; double nomination of a candidate; disqualification of a candidate; wrongful substitution of a successful candidate’s name by the electoral body; wrongful omission of a successful candidate’s name by the electoral body; complaints about the conduct of primaries, and false declaration on oath about particulars of a candidate.

Only aspirants of the same political party have local stadi to challenge outcomes of nomination processes in court within 14 days from the day the event occurred; members of other political parties are considered as persona non Grata.

Kindly note that these are not my personal opinions but the position of the law.
You are so wrong with your submission and the 3 Honorable Judges just follow the constitution and Electoral Act... How can someone who is not a member of a party, who didn't participate in the Primary Election become the party flag bearer?

I see alot of ignorant people are happy about this absurd judgement.
It has been decided over and over again in various courts that how candidates emerge in a political party is strictly an internal affair of the party as stipulated in the electoral act.
Submitting register to Inec doesn't prescribe any penalty or prevents political parties from accepting new members.
Did you read the reason he was sacked? The Tribunal ruled that as at 28 may 2022 that the primary was held, Ngozi was not a member and didn’t participate in the primary election. You all should start asking Aburi and co how come his name was submitted to Inec and not the real winner of the primary.

The constitution is explicit, no political candidate can be disqualify base on no name on the membership register. It only require a party to sponsor a person and there is no where in the constitution or electoral Act where it stipulates window period to belong or not to belong to a political party. It's even a breach of principle of Association on Human Right.
The electoral Act says submit membership register but was silent why the register must be submitted. I challenge anyone To point to any part of the electoral Act that place penalty for non-availability of candidate name on the membership register. I am waiting for the proponent of this arrant judgement that is against logic and Nigerian constitution to quote it for the world to see.
He was removed because as at the time LP had her primary election in 28/5/23 he was not a member yet. So how come he became the flag bearer should be the question.

No. This judgement won’t affect Obi because he participated in the primary election monitored by INEC. This judgement stated that Ngozi is not a LP member as at the time the primary election was held. I think his name was swapped with someone’s who participated and won the primary.

Nobody is denying that he scored the highest votes. His nomination was against the Electoral Act. The court ruled that as at 28th of May 2023 He was not a member of LP. All votes he got will become wasted/void and the person who score the 2nd highest votes will become the winner.

According to the OP the court will count votes scored by each party in over 176,000.
When the LP lawyers can’t even argue during the hearings any state that they have total number of votes higher than what INEC declared. Also the blurred papers are printout from the IREV which the court will not even look at because the EA didn’t even recognize it.
The court is not a Father Christmas where you go and get gift.
