JaySterling:
Hey guys, I am about renting an apartment in the UK, I want to know if it’s a must to pay deposit in the UK and do landlords usually refund this money ?
Must you pay deposit. No
Will you pay deposit. Yes
Will LL refund your deposit. Obligated to (if there're no 'damages')
This is where it get interesting. On the subject of deposit, it's reassuring that deposit is safe!
There is a Tenancy deposit protection in the UK . LL are obligated to follow the rules. YouKay Deposit protection schemes and landlords
Extracts of Ma Ticha and Elder Lexusgs430 might be of assistance.
Lexusgs430:
Don't panic....... If your LL fails to deposit your deposit...... LL would be made to refund *3 of your deposit........ Don't panic ....... cheesy
https://d-w-s.co.uk/implications-landlords-failure-protect-tenants-deposit/
Ticha:
You have a tenancy under law so fear not. As long as you're paying rent as agreed, you have an active tenancy. Lexus is right. In this case, you won't even lose your deposit regardless of damage because he has broken the law by not lodging it and therefore can't claim anything off it. Even if he lodges it later, he has still failed to abide by the tenancy act. The good thing about not having a signed agreement is that there are no detrimental clauses he can enforce - at all.
... ...
But if you're leaving after 6 months, just relax and take him to the dispute resolution once the tenancy ends and claim back your deposit plus the extra. And if he has not provided any right to rent documents, claim the whole of your 6 months rent back too. First and foremost - check that he definitely hasn't protected it. You can easily check any of the 3 services - https://www.gov.uk/tenancy-deposit-protection/if-your-landlord-doesnt-protect-your-deposit
Make sure you give the right notice. Which is one month. Read here for more information - https://www.gov.uk/private-renting-tenancy-agreements/your-landlord-wants-to-end-your-tenancy

When our people gets to 'saner clime', they gets surrounded with or get involved with people, or with bloggers/YouTubers that makes it all rosy to be 'independent' all of a sudden. Interestingly, more often than not, the independence isn't much of financial independence but 'freedom' (to go wild). That's not to say that indeed there're not some that are truly oppressed (or even abused in the true word).
Any of the party, including the man can lay a defence. When you do, the plaintiff, claimant would soon see it's not all easy as they portrayed it to be to them. This often when its the wanna be independent gang. More often, especially for the men, the non-abusive ones, they are made to fear and they don't put up credible defence during the process. That a wanna be independent spouse decided to call police on you or file for so-called divorce doesn't mean you are stripped of your rights. So much that you sulked up and not do the needful. Unfortunately, it's often too late to start to gather credible evidences. If you're truly non-abusive, you'll get through as soon as the signs starts to show 🔂. Ifura logun agba
For the Christians in the house, may it be, through God's grace according to the song ... God gives us Christian home ....
To all, may we all build a lasting home.
PS: this is not a post to come down hard on our lovely ladies in the house.
Lexusgs430:
The applicant, would have to legally divorce the dependant..... The divorce can be done in the UK, but after the divorce, the dependants visa would be curtailed and would have to return to Nigeria (not unless the dependent got a claim of abuse) etc etc....
If that's the case, be prepared to pay a good lawyers bill ........

The applicant can remarry in the UK, but a decree nisi must be in place before marriage or home office would not issue a marriage license............
Make Una think am well ........ It's not that easy ......🤣😂😜

Can't agree more with the bolded. #Professionalism in all, at all ...
If they called a compliance meeting, that might be understandable. However, going outright to disciplinary with a threat of dismissal, is over the board. Must be defended vehemently.
ACAS is the first step before Employment Tribunal. ACAS doesn't mean you must go to Employment Tribunal after either. However, approaching ACAS is not simply to get back at an employer but a necessary advisory step. It assists both parties.
ACAS offers early conciliation (if the intent is to approach the Employment Tribunal at a later stage).
ACAS also offers mediation support with an end goal of mending relationship at work (from work disagreement).
In any case, ACAS or no ACAS guidance or involvement, facts are critical. Ensure you have all your documentary evidences with you for your so called disciplinary 'meeting'. Pay attention to all the pointers you've received on your post here: such as from Mimilyrics, Poanan, AlphaUno, Lexusgs430 and all I did not tag.
All the best. Keep calm, it shall comes out all good!
mimilyrics:
... ... There was a compliance/disciplinary meeting called and the company still went ahead with the payroll scrub.
... ...
Try to be as professional as possible in all your communications with the company to ensure that the error is cleared up and that no bridges are burnt.
Worst case scenario, you can always go to the employment tribunal to get compensation for the unfair dismissal if they go ahead with their threat of dismissal.

Keep calm and trust the (online) calculators
If you however wants to get hands dirty, £16.27 should yield at best £27k pm and +/-33k p/a if we use £16.27*39*4.33*12
Where 4.33 is average working weeks in a month, and 12 months in a year.
eniola1010:
Abeg how is going rate being determined
If they say going rate for a job is 33k gbp. And it is a 39hours per week job @ 16.27/hr.
How did they get that 33k.

I was going to get a Decagon student loan, but they said that was only for graduates. I will be 29 this year I don't want to be useless. I attempted JAMB several times without success into the university or polytechnic.

If 'HR' has merely stopped at ... don't work while visa being resolved, then there might be no need for #external intervention. However, when in this case, HR not only threaten disciplinary, but serves disciplinary with a clear rider. ... could lead to termination, then the kids gloves are off. HR has entered wavulence zone!
In between, ACAS is way off from actual employment Tribunal.
Well, who wants to be without a job or worse still with dismissal record!
Poanan:
You dont need to fight your employer. The office is a war zone dont make it worse. If the hr is saying you can't work, it hurts but if you go the way of tribunal, you may win but you wont like yourself. You can only do that when you know you will not return to that work. Your peace of mind is more important than creating a hostile environment for yourself. Why use the hammer to kill an ant? Allow it slide.

Must do at other universities, Not compulsory.
At PhD level, focus should be at #impact: type of research, contribution to knowledge, credible publications, worthwhile impact on society/community

Someone who did First degree and masters in same school, is it available to do PhD at same school?
Someone in academic advices it's not okay because they will refer to the person as inbreed PhD holder. It's good to obtain different degrees at different schools.

Keep calm and go through the process. While going through it, you should have been in ACAS like yesterday Friday already: unfair labour practice, forced leave, restricting or force deduction of remuneration
If what you narrated is what it is, your HR need a #reset.
Importantly, Bigtt76 asked a critical? ... When exactly did you apply for your renewal. As in when exactly; date, time, mode, where.
U'll need this at the disciplinary and ACAS. Renewal: You must apply online before your current visa expires
ACAS - link: ACAS approaching Employment Tribunal
bigtt76:
What date did you apply for renewal? I guess they are trying to protect themselves because it could work against them. Still try and put up a defence. I'm sure you will be fine.
rollykotex:
Hi all, I just need some advice from experienced people in the house. My visa expired on the 30th of January 2023. I have applied for a renewal which is not out yet my biometrics is in the 9th of February. I told my employer on the 30th of January that my visa was expiring that day but I have submitted another application.
Naso wahala start. Calls from head office HR, that I currently don’t have visa and cannot work. They immediately put me on leave without pay starting from 31st until visa is sorted. I gave the HR my application reference number for them to carry out chef themselves, them no gree. Meanwhile I was the one that informed my manager just to be safe. It was not as if they reached out first that my visa was about to expire.
The latest one now is that they set up disciplinary action against me that I don’t have papers to work in the UK. I’m confused because everything just went out of proportion. The email I got says I can attend with a trade union or a work colleague and that it might lead to immediate dismissal and all.
I just need heads up on how to tackle this and if I really need to take someone with me for the disciplinary action.
Thank you all.

Ag shame. That's where these discussions should be taking place. If not, the thread is not serving its purpose.
Perhaps to get insights into the Skilled Worker, one should peruse the caseworker guide.
Skilled Worker caseworker guidance (accessible) - Updated 4 January 2023
Mandatory points requirement
Assessing tradeable points

Recently, they 'remove' the requirement on graduate qualification. That opens up meeting the skilled kob requirements.
The YouKay gov Skilled Worker site is 'silent' on the points!
If you have a 1. COS, 2. a job in the Skilled Worker Eligibility list (eligible occupation code), English ticked, then your points requirement should be a done deal.
If however the employer is one of those dodgy ones, your points might not be meet. Why, because they would most likely have not done the basic checks on your job and your eligibility.
eniola1010:
Omo no love for that thread o. Everyman for himself

... ... I can't tell if it has always being like this but at 2021 when I started following the skilled worker visa. applicants will need to accrue a total of 70 points to be eligible for the visa.

We can pick up from your house from £18 per 0-30kg cardboard box. Otherwise you can send it yourself.

Timeline is typically 4-7 working days from the Friday it departs the UK.

To make a booking kindly send an email (Mon to Fri) to teamcrayonuk@gmail.com and we will sort you out.

Thank you.

Every stay is for a max 6 months irrespective of how long the visitor visa is given for (2, 3, 5, 10 years). Before the end of each six months, she must leave the UK and re-enter again, except Home Office has granted the concession. Withdrawal only make the status quo worse.
So sad, you've penned Mum down as an overstayer. Hope, she can still come back in future.
Beware of street corner advice. Most goes against the law of the land, irrespective of how some have been able to beat the system!

Well, for now, as you've been advised, get her a Travel document to travel back ASAP. When back in 9ja, start the return process, obviously revalidation the visa.
Alternatively, get an immigration lawyer to petition her continuing stay on medical ground. Good luck with that though.
PS: this is not a binding legal advice as contemplated in law

This should be voluntary return. I actually called them but since her leave to enter is still till December, they redirected me to call the regular contact with computer responses.

All I'm trying to pass across is let's learn to relate to or engage a visa category according to it's official name.

However, most UK univ have 'special' recognition for 9ja!

Skilled Worker brings some changes to Tier 2. If you're not on PSW, you need Skilled Worker visa.
Your PSW does not counts towards 5 years to ILR. It however counts as part of 10yrs (legal residence) to ILR. PS: This is also different from ILR on the basis of private life.
Skilled Worker counts towards 5 years to ILR irrespective of job categorisation.

However, to get Skilled Worker, there are certain requirements - #Eligibility. For some, eligibility implies being on the shortage occupation list but not necessarily. Put differently, it is not the job on shortage occupation list that counts towards 5 yrs ILR, it is having the Skilled Worker visa that counts. However, the shortage list positively aids the Skilled Worker for some jobs.

If you want to stay longer: ... After 5 years, you may be able to apply to settle permanently in the UK (also known as ‘indefinite leave to remain’). This gives you the right to live, work and study here for as long as you like, and apply for benefits if you’re eligible.
What you can and cannot do - With a Skilled Worker visa you can:
apply to settle permanently in the UK (also known as ‘indefinite leave to remain’) if you’ve lived in the UK for 5 years and meet the other eligibility requirements

You must: ... have lived and worked in the UK for 5 years

To start counting towards your 5 yrs for ILR ,the permanent job gotten must be on the shortage occupation list and the employer must be ready to sponsor you and a COS must issued for that

Gurus in the house help my confusion please😂
As a student on a tier 4 visa you can decide to switch, get the CoS and start counting 5yrs towards ILR (permanent residence) OR you can decide to finish from the school, pay £2000 to get 2yrs Pgwp. Here is were my confusion lies omo
So let's say I decided to finish my school, get my 2yrs pgwp and luckily for me I got a job (permanent role)

1) will I still be needing CoS since I got a permanent job role?
2) will I start counting 5yrs for my ILR since I got a permanent job role or [s]will have to apply for ILR immediately I got the permanent job role[/s]?
