Abuja — The Nigerian National Petroleum Corporation, NNPC, weekend banned 113 oil tankers from lifting crude oil from Nigeria due to sharp practices recorded in the export of Nigeria’s crude. The tankers, according to a document signed by Gbenga Komolafe, Group General Manager, Crude Oil Marketing Division, NNPC, were banned from entering Nigerian oil facilities and territorial waters. The document obtained from Platts, a global energy trading information source, said, “The NNPC has prohibited 113 tankers from engaging in crude oil/gas loading activities in any of the terminals within the Nigerian territorial waters until further notice.” The letter, Platts report showed, was dated July 15, and addressed to terminal operators in Nigeria, while the tankers were listed in an attached spreadsheet. “The affected vessels have also been barred from movements within the Nigerian territorial waters forthwith. “Finally, enforcement of the above directives takes immediate effect pending a notice to the contrary by Government, please,” the NNPC noted. Shipping and trading sources disclosed that the NNPC’s grievance with the shipping companies stemmed from issues surrounding output figures related to crude oil exports at the port of discharge. The sources who chose to remain anonymous said there have been a few incidents between Nigerian authorities and their crude oil buyers on differences between the volume of crude that was discharged, compared to the volume on the bill of lading. A trader who is active in the West African crude oil market said, “We hear it is about the outturn figures, as there are sometimes differences between the loading and discharge figures, especially with certain countries.” Another source with a shipowner that would be impacted by the potential ban said, “We are currently gathering information. A lot of market players have received the document and we have to take it seriously. “The NNPC are asking for outturn figures but the receivers of the cargoes have this information, not the shipowners. Human rights lawyer, Femi Falana (SAN) has said that the former National Security Adviser, Col. Sambo Dasuki breached the law for refusing to allow officials of the Department of State Services, DSS “free and unhindered access” to search his residence for several hours last Thursday. Falana in a statement on Sunday, said contrary to reports, the search conducted on Dasuki’s residence house was was legal and authorized by law, since the DSS obtained and presented him with a search warrant issued by a Magistrate. He said: “The fundamental rights to personal liberty and privacy of the home of every Nigerian citizen are constitutionally guaranteed. As fundamental rights are not absolute they may be breached in accordance with a procedure permitted by law. “Hence, by virtue of section 146 of the Administration of Criminal Justice Act, 2015, the residence of any citizen can be searched with a warrant duly signed by a Judge, Magistrate or Justice of the Peace. Section 149 thereof imposes a duty on any person residing in any building which is liable to be searched to allow free and unhindered access to it and afford all reasonable facilities for its search,” Falana stated. Section 149 thereof imposes a duty on any person residing in any building which is liable to be searched to allow “free and unhindered access to it and afford all reasonable facilities for its search.” Last Thursday, a team of State Security Service (SSS) officials, armed with a search warrant, attempted to execute the warrant on the private residence of Col. Sambo Dasuki Dasuki, in Abuja in the Federal Capital Territory. Convinced that he did not deserve to have his house searched Col Dasuki refused to allow the SSS officials access to his house for several hours. The search could not be conducted until the armed troops guiding the house were withdrawn by the Army Authorities. In his own narration of his contemptuous action, the former National Security Adviser admitted that : “The SSS operatives came in two trucks with a search warrant from a Magistrate Court. The warrant gave them the power to search for ‘illegal weapons and any incriminating item.’ You can imagine what that is supposed to mean. “I left office on Tuesday and they got the warrant on Wednesday and executed it by 6pm on Thursday. “From 6pm on Thursday, throughout the night till about 6am this morning (Friday), they were searching my house looking for incriminating items.” In a sharp reaction to Col Dasuki’s narration of what transpired in his residence the SSS has confirmed that the search was conducted in strict compliance with a search warrant duly endorsed by a Magistrate. To prove that the search was not a witch hunt the SSS listed the items recovered from the premises including seven high caliber rifles, (high assault weapons), several magazines and military related gears, 12 new vehicles, out of which five were bullet proofs. Since Col Dasuki is presumed innocent until the contrary is proved it is not fair to comment on the “incriminating items” found and recovered from his house. It is pertinent to point out that the law requires the owner or occupier of any house or apartment to allow a search once a search warrant signed by the appropriate authority is produced by law enforcement personnel. Without any legal basis whatsoever, Col. Dasuki breached the law when he refused to allow the SSS officials “free and unhindered access” to his residence for several hours last Thursday. Contrary to the misleading information circulated in the media by the former NSA, his house was not illegally raided but lawfully searched pursuant to a warrant issued by a Magistrate. Since we operate a neo-colonial legal system which confers special privileges on people of influence, Col Dasuki was treated with dignity in the circumstance. In other words, the SSS personnel would have executed the warrant, rather forcefully, if the search involves the home of an “ordinary” citizen. Indeed, the special status extended to members of the ruling class has also been demonstrated in the decision of the SSS to place the retired Colonel under “house arrest” in a country where the flotsam and the jetsam are regularly railroaded to jail even when they are not associated with any “incriminating evidence”! However, it was reported that Col Dasuki’s passport was seized during the search of his house. The SSS ought to be reminded of the case of the Director-General, State Security Service v Olisa Agbakoba (1995) 3 N.W.L.R. (Pt 595) 314, wherein the Supreme Court held that the passport of a Nigerian citizen could not be seized without due process. It would be recalled that the seizure of the passport of Alhaji Sanusi Lamido Sanusi ( the current Emir of Kano) by the SSS under the Goodluck Jonathan Administration was declared illegal and unconstitutional by the Federal High Court. In addition to the order for the immediate release of the passport the court awarded N50 million reparation to the then embattled Governor of the Central Bank of Nigeria. Therefore, the SSS should return the passport of Col. The Dutchman feels that the former midfielder does not possess adequate experience to lead the Super Eagles forward after the sack of Stephen Keshi Former Nigeria technical adviser Clemens Westerhof thinks the Nigeria Football Federation is making a huge mistake by handing untested Sunday Oliseh the job of the national team manager. Oliseh, 40, was handed his Super Eagles debut by Westerhof in 1993 and the Dutchman feels that his former protégé has not gotten the requisite experience to handle such a difficult side with lots of egotistic players. The former Borussia Dortmund and Ajax midfielder has only ever managed a third division Belgian side Vervietois as well as worked as TV pundit and a member of the Fifa Technical Study Group for the 2014 World Cup. “No, no, no, no that cannot be, he can’t be Super Eagles coach. Oliseh cannot do it, no, he can’t,” Westerhof was animated as he told Complete Sports . “If the Nigeria Football Federation is bringing Oliseh to handle the Super Eagles, then that is too bad because it is not right. It is not proper, he is not the right man for the job.” The 75-year-old, who led the Super Eagles to their second African title in 1994, then reeled off the work experience he and recently sacked Stephen Keshi earned before being handed the Nigeria top job. “Before I took over the Super Eagles in 1989, I was head coach of Feyenoord and we were champions after many years. I coached other top teams in the first division, Vitesse, MVV and came back to Vitesse again. “Keshi was a top quality player in Belgium with Lokeren, Anderlecht, RC Strasbourg in France, Sacramento Scorpions and all that. He coached several other teams including Togo and Mali. “Where did Oliseh coach? What is his coaching experience? Do you want to start learning how to coach with the senior national team,” he asked. Westerhof also detailed the kind of problems likely to be faced by the new coach in the face of player egos. “Coaching amateur teams is not enough to get experience of handling top teams like the Super Eagles. Players cannot respect him, you know, he cannot command their respect and influence as they loved and respected me, as they also respected and loved Keshi,” he said. “What the players of the Super Eagles need is a coach who the players will love to respect, who has positive influence on the players and I don’t think Oliseh has these qualities,” Westerhof said. The National Population Commission has hinted that the conduct of the population census and head count for all Nigerians scheduled for 2016 would depend on the willingness of Nigerians and the Federal Government because of poor budgetary allocation. ADVERTISEMENT The commission also called for a review of The National Policy on Population to accommodate current realities “in view of recent changes in the demographic profile of the country.” NPC said, “The review is to assess the performance of the programmes outlined in the policy and also to respond to emerging national and international issues in population and development. We are currently leading the review process”. The Chairman of the NPC, Chief Eze DuruIheoma (SAN), expressed these views on Thursday in Abuja during a press briefing in commemoration of the 2015 World Population Day, with the theme, “Vulnerable population in emergencies.” According to him, if indeed Nigerians want the conduct of 2016 national census, they must demand for it, just like they did during the recently concluded general elections. The PUNCH recalls that a former chairman of NPC, Chief Festus Odumegwu, was removed in 2013 by former President Goodluck Jonathan, following comments credited to him that previous national censuses figures were inflated to favour the northern parts of the country. He had said that over N200bn would be required to carry out the census exercise that would be universally acceptable to correct the mistakes of the past. But DuruIheoma, who recently complained of poor budgetary allocation, said the fate of the conduct of 2016 census rests solely on Nigerians and the Federal Government that should provide the needed funds for the exercise. He said, “I want to remind us that censuses are supposed to be held between five and 10 years after the previous one. Now, the previous census in Nigeria took place in 2006. A maximum of 10 years will take us to 2016. That is why we are sticking to the 2016 date. That is when the next census is due in this country. “Population census is an exercise that involves Nigerians. Look at the way Nigerians reacted to the last (2015) election. They demanded that they wanted it; the next thing after the elections ought to be the national census. We want it to be in the consciousness of Nigerians. The last one took place in 2006. Ten years after, we want to know how many we are. “Our duty here in the NPC is to help Nigerians realise this goal. We are ready to heed the call of Nigerians. Whatever they want us to do, we will carry out their wish.
