Eteka1: Wike said Nigerians have right to protest but appealed that the people should be patient with the Tinubu administration as it is barely a year in power and has achieved a lot already, meaning that things will get better with time. Therefore, the people should shun the people calling for protest out of mischief. What is the misyarn there? Besides, Wike is not the only person that has called on people to shun the protests. Wike clearly said "no protest in fct" just yesterday or was it today sef... It's everywhere |

Eteka1: and who is Ajuri to tell Wike what to do or not to do? He is the president's spokesman. There is no way Ajuri would go on tv to say anything Tinubu has not directly instructed him to say. You can therefore take it that Wike misyarned and Ajuri was sent there to bring him back in line. |

Kobojunkiee: Again, defamation is not a limitation on the right to free speech this since the law does not immediately kick in the one supposedly defamed; that only takes place after a suit filed and a court rules that a defamation has in fact taken place. Wtf! What do you understand by limitation? If I can take you to Court and have you punished for saying something, do you then have an absolute right to free speech? Are you the real kobojunkie or an impersonator?? |
Politics › Re: Peter Obi, Alex Otti Differ On August 1st Planned Protest (Photos) by SmartyPants(m): 5:07pm On Jul 28, 2024 |
Kobojunkiee: Stick to the letter of the law. That is the letter of the law. It says any law that is made that limits the aforementioned rights is valid so far as it can be justified on any of those bases. |
Politics › Re: Peter Obi, Alex Otti Differ On August 1st Planned Protest (Photos) by SmartyPants(m): 4:40pm On Jul 28, 2024 |
Kobojunkiee: 1. The right to assemble is just one. See sections 38, 38 & 40.
2. Defamation is not a limitation to the right of free speech. See Section 39 and maybe 45 of your Constitution. Are you sure you understand what you read in Section 45? It very clearly provides the Constitutional bases for the limitations of Constitional rights--as I said--with such bases including: a. Defence, public safety, public order, public morality or public health; [the bolded are the clear limitations to the right to peaceful assembly] b. The defence of the rights and freedoms of others (defamation as a limitation to free speech clearly falls under this provision) There are thousands of articles explaining the limitations to rights. I'd suggest you devote more time to reading some than arguing here. |
Politics › Re: Peter Obi, Alex Otti Differ On August 1st Planned Protest (Photos) by SmartyPants(m): 4:16pm On Jul 28, 2024 |
Kobojunkiee: 1. A right is a freedom you do not require permission of any kind for!
2. Not true at all. For instance, my right to free speech for instance does not depend on the impact or on how others choose to construe what I have said. 1. That is why I just told you there is no such constitutional right to protest. There is a right to assemble as long as your assembly does not impede my freedom of movement and constitutes a public nuisance. As I've told you, this is a well-established human rights principle. See Article 27(2) of the African Charter for example. 2. Of course it is true. Your right to free speech is limited by a requirement that you do not defame others, constitute a public nuisance, make seditious proclamations and so on. Similarly, your right to assemble must not impede my right to a freedom of movement. |

Politics › Re: Peter Obi, Alex Otti Differ On August 1st Planned Protest (Photos) by SmartyPants(m): 4:00pm On Jul 28, 2024 |
Kobojunkiee: Not only is this statement not according to the Constitution, it also undermines the concept of what freedom is really about. If Nigerians have freedom to gather and protest but are to first report the expression of said freedom to the authorities for what i believe is for approval of some sort, then are Nigerians really free to protest? There is nothing like "freedom to protest" anywhere in the Constitution. There are rights of peaceful assembly and a right to freedom of expression that are jointly construed to create a right to protest. However, all freedoms are inherently limited by the extent to which they may impact others. Now Otti has also misconstrued the limitation, as the requirement is that intending protesters must merely inform the police of the time and place of their protest, which is not only very constitutional but also in line with international human rights norms. |
