For 16 years that the Peoples Democratic Party was in power, the federal government exhibited total contempt for the Rule of Law. The Constitution and other laws were breached with impunity while court orders were disobeyed on a regular basis. In the famous case of Attorney-General of Lagos State v Attorney-General of the Federation (2005) 2 WRN 1 at 150 the Supreme Court held that "In our democracy all the Governments of this country as well as organizations and individuals must kowtow to the due process and this they can vindicate by resorting to the courts for redress in the event of any grievance."


 
 One of the reasons why Nigerians voted for the candidate of the All Progressive Congress, General Mohammadu Buhari (rtd) during the last general election was his promise to fight corruption and end impunity in the country. Upon winning the election, President Buhari further pledged to abide by the Rule of Law. To that extent, he has a duty to ensure that all organs and officials of the Government operate within the ambit of the law. In particular,  he should not allow overzealous security personnel to engage in any form of impunity and thereby expose the Government to unwarranted embarrassment.

In July last year, the State Security Service (SSS)  searched the private residence of former NSA, Col Sambo Dasuki (rtd) at Abuja. When Col Dasuki alleged that his house was illegally searched, I pointed out that the action of the SSS was justified as there was a search warrant validly issued by a magistrate court in the federal capital territory that  authorised the search. He was eventually charged with money laundering and criminal diversion of huge sums of public fund before the Federal High Court and the Federal Capital Territory High Court at Abuja. Notwithstanding the gravity of the offences, both courts have admitted him to bail. But after he had met the bail conditions the SSS decided to rearrest him at the gate of Kuje prisons on the ground that investigations have not been concluded in respect of other criminal allegations.

[The decision of the SSS to ignore the order admitting Col Dasuki to bail coupled with the failure to re-arraign him on fresh charges is tantamount to impunity in every material respect. If the federal government were aggrieved by the order admitting Col. Dasuki to bail it should have challenged it in the Court of Appeal. Much as the Nigerian people are fully behind the Buhari Administration in the patriotic move to recover the looted wealth of the nation, the federal government should be advised to ensure that the procedure for the loot recovery meets the tenets of the rule of law. The SSS and other security agencies should therefore refrain from allowing corruption to fight back by playing into the hands of the criminal suspects who have committed crimes against humanity by diverting money earmarked for the procurement of arms and armament to fight the terrorists.

 In the same vein, the order admitting the leader of the Indigenous People of Biafra, Mr. Nnamdi Kanu, to bail should also be complied with. If the federal government has other charges against both suspects it should file them in the court. There is no provision for keeping criminal suspects at the pleasure of security officials. Meanwhile,  all valid and subsisting orders made by courts in favor of criminal suspects should be obeyed without further delay.

To ensure  that  suspects are no longer held in custody in any part of Nigeria without any legal justification section 34 of the Administration of Criminal Justice Act has imposed a duty on each  the Chief Judges to designate  a Chief Magistrate and  a Judge of the  High Court to visit all police stations and other detention centers within their jurisdiction, at least once a month. During such visits, appropriate directives shall be given while any officer who detains any person illegally will be sanctioned.

The oil rivers state opposition came from Ibibios because they fear that it will make Akwa Ibom lose their status as oil producing state. That they speak a dialect relating with Ibibio don't make them Ibibio. We have Ijaws in Ondo that speak a language relating with Yorubas, it doesn't make them Yorubas. Edwin Clark speak a language that has semblance with Urhobo, it doesn't make them Urhobo. This issue has been thrashed out last year. Obollos and Eastern Ibeno people even on this forum backed it. I understand the opposition from Ibibios nontheless.

This was why the Ijaws proposed oil rivers state with the Obolos and Ibenos failed. Ibenos and Obolos rejected the Ijaws and held unto their Ibibio brothers.

The problem is that most of them are less rational and more emotional. Imagine someone creating a thread how Ijaw want to "dominate" the South South. Fact check will tell that...

1. Since the creation of Rivers state in 1967(48years ago), Ijaws has only ruled for 5years and 20months as elected Governor. The Ndonis had 8years and the Ikwerre is having 8years and counting.

2. In Delta and old Bendel states, no Ijaw man has ever been Governor.

3. In Ondo state (where Ijaw is minority), no time has anyone picked arms against the Yorubas for governorship stool.

We are more comfortable with ethnic unity than governorship. In fact, even the Presidency, it wasn't all Ijaws that backed Jonathan. Yet, someone is talking about dominance. However, in the fraud called Eastern region, the Igbos collected everything without a space for ethnic minorities. Who wanted to dominate Nigeria by abolishing regionalism? Who wanted to dominate the South South by declaring Biafra(and was severly dealt with)? Who invaded Midwest, sack the Governor and installed an Iboman?

Ijaws are claiming Ibeno and Eastern Obolo,i don't want to delve into the matter now!.Am from Ibeno where they are claiming,and during that National conference,when they were making case for Oil Rivers state,they planned including us,but our elders warned them never nurse such ambitition. No part of my state will be ceded to Ijaws.I love Ijaws,but one Barcanista,can't make me loath them,unless they decides to push their agenda which they always mask "Niger Delta" too far!.
I wouldn't say their are no "ijaw bloods" here,but their exists NO indigenous Ijaw here!. If they makes such claim,then,they are saying their are indigenous Ghananians here,because almost all our waterside at Upenekang,are filled with Ghananians doing there fishing!.Ijaws are fishermen,and they move along sea-shores to offset their products,thats how they are found here,in the manner of them intermarrying and doing business with the aborigins.

courageous enough to come out and defend

short term it might be politically fashionable
for them to be on the side of some agitators.”
The minister, who noted that current
agitations by citizens were “completely
legitimate,” assured of the Federal
Government’s commitment to strengthening
the economy.
“There are many political frontlines in
Nigeria, religious, ethnic and the like but these
things do not come to the fore until when
there are serious economic problems like we
are having today.
“I have listened to the complaints of many of
these agitators and right down it is economic.
“They must understand too that but for this
furtiveness of this administration, this country
would have been by far much worse.
“There is need for Nigerians to understand
also that these are not ordinary times and that
the government is not just making excuses.
“I appeal to our leaders not to exploit this
situation to further destabilise Nigerians; our
leaders should be courageous enough to come
out and defend our unity.
“In the short term, it might be politically
fashionable for them to be on the side of some
agitators but in the long term, it is in the
overall interest of Nigeria that we all
understand our differences, respect them
forge a united Nigeria.
“There will be no alternative to one united
Nigeria.”
The minister emphasised the need for
government to have accurate and timely
information on complaints presented by
citizens.
“The most important thing is that the
government must do a lot of self-assessment
itself.
“The government has the responsibility to
listen to all; it also has the responsibility to
analyse issues to see which complaints are
genuine and those that are not and look into
them.”
He also stressed the need for the government
to take advantage of different media
platforms to make accurate information on its
policies and plans available to citizens at all
times.
He said that the availability of timely
information would curtail agitations, rebuff
rumours, and enhance citizens’ understanding
of government’s plans and policies.
The minster urged the media to take
advantage of available opportunities to
“dominate” the social media platforms with
positive and accurate information about the
country.
He further said that such dominance would
pre-empt negative information and activities
on such platforms.
“At times some of the agitations might be
because the government is not adequately
publicising what it is doing.
“Some of the agitations could also arise from
lack of understanding of government policies.
“Unfortunately, we have allowed the social
media to dictate the agenda for us; that must
stop immediately.
“If, for instance, we dedicate platforms that
churn out positive stories, very soon other
negative platforms become irrelevant.
“It is only the absence of an alternative
narrative with the correct information that
makes such other platforms relevant.”
He stated that churning out accurate
information will present a positive image of
Nigeria to the international community.

In fact,recent report from AI,put the figure of those who have been kill by Boko haram,since Buhari took over,to be well over 1600(May-Sept).

Of course,many of such attacks,goes on unreported,courtsey of the conspiracy of our local media(quite unlike them) houses,ably controlled by Lagos-Ibadan criminal media aoutfits such as Punch,The Nation,TVC,Channels,Premium Times,Osundefender,Sahara reporters,etc,to play the ostrich while lives are being wasted on daily basis,just to pretend/prove that "baba is working".

It's this bad that,Nigerians has to depend on international media outfits such as AFP,CNN,BBC,etc,and few other credible local media,to know whats happening.

Of course,the number of deaths and destructions being carried out daily by the state's authorized boko haram partners in 'progress',the islamic fulani herdsmen,remains relatively unknown,but an avarage Nigerian knows that,they have stepped up their heinous acts,since their commander in chief,Buhari took over.

One wonders,are "we" actually winning the "war"?.
Its worthy of note that,weeks to the elections,Nigerian Army confided the activities of Boko haram,to few local governments in Borno state.Abuja the nations' capital,was peaceful,lifely and safe again,unlike when they started.
But since the petroluem ministry savvy president took over,Abuja and other parts of North,has returned to the very bad old days.

My question,who is "WE"?. Nigeria or Boko Haram?.
Which "WAR"?.Jihad or war against terror?.

Surely not Nigeria that is winning,and the war Buhari is talking about,is JIHAD!.

Remember his pledge to show openly and inside him,his commitment towards the spread of islam.
NB:The spread of Islam,is always via Jihad,and Buhari/Boko Haram is once again winning!

Quote "An attack on Boko Haram,is an attack on North".
