The judgment of the Supreme Court which nullified the conviction of a former Governor of Abia State and serving Senator, Orji Uzor Kalu, and his subsequent application seeking to be released from detention have continued to elicit reactions from senior lawyers. Although some lawyers have expressed concern that the judgement was a setback to criminal justice administration, one of his lawyers, Awa Kalu (SAN), said Kalu was a free man, explaining that, “There is no basis to continue to hold Kalu in custody. Supreme Court’s judgment on Kalu ‘unfortunate’, re-trial underway, says EFCC “The natural consequence of the judgment of the Supreme Court is that in the eyes of the law he was never convicted.” In the latest application before the Federal High Court in Lagos dated May 12, 2020, Orji Kalu is seeking an order setting aside the judgment of the court on December 5, 2019, by Justice Mohammed Idris convicting and sentencing him to 12 years imprisonment in a 39-count charge of money laundering to the tune of N7.6bn. Orji Kalu also asked the court to set aside each of the 39 charges contained in charge number: FHC/ABJ/CR/56/2007- based on “the sentences having been imposed without jurisdiction.” Orji Kalu also requested that the court made an order directing his release “forthwith from the custody of the Nigerian Correctional Service, Kuje-Abuja, FCT.” Lawyers to the Senator representing Abia North on the platform of the APC, Lateef Fagbemi (SAN) and Awa Kalu (SAN), filed the application after it became clear that he would not be released from custody alongside his co-defendant, Ude Jones Udeogu, after the Supreme Court nullified their trial and conviction. In the majority judgment read by Justice Ejembi Eko on May 8, 2020, the five-member panel of the apex court declared unconstitutional the provision of Section 396(7) of the Administration of Criminal Justice Act (2015) upon which the then President of the Court of Appeal, Justice Zainab Bulkachuwa, relied on to authorise Justice Idris to return to the High Court to conclude the trial. Justice Eko held that, “I have no doubt, whatsoever, that the Hon. M. B. Idris (JCA), having been elevated to the Court of Appeal, had ceased to be a judge of the Federal High Court.” “Accordingly, he had been deprived of whatever jurisdiction he had as a judge of the Federal High Court to proceed in the case ‘to conclude the hearing and ultimate determination’ of the part-heard criminal case No: FHC/ ABJ/CR/56/07 – Federal Republic of Nigeria vs Orji Uzor Kalu & Others.” However, a major twist unfolded when Orji Kalu’s lawyers went to sign the warrant of release to be attached to the judgment and shown to officials of the Nigerian Correctional Service in Kuje. Supreme Court clerks went through the judgement and noted clearly that Orji Kalu who was not an applicant in the matter was not covered by the order of the panel. The clerks pointed out that the intention of the panel as read out by Justice Eko was that, “The judgement of the Court of Appeal No: CA/L/1064C/2018, delivered on 24th April, 2019, particularly in respect of the appellant and as it affected him is hereby set aside.” Thus, only Udeogu was released. Subsequently, Orji Kalu, in the application told the high court that he was sure Justice Idris was out of jurisdiction when he was elevated to the Court of Appeal on June 20, 2018, as he lost his position on the bench of the Federal High Court when he subscribed to the Oath of Allegiance on June 22, 2018, and that he filed a no-case submission challenging this, which the judge overruled, thereby leading to further appeals. “That by a fiat dated the 2nd day of July, 2018, issued under the hand of the President of the Court of Appeal, His Lordship, Hon. Justice M. B. Idris (JCA), of the Court of Appeal, was directed to return to the Federal High Court to conclude the trial, then part-heard in charge No: FHC/ABJ/CR/56/2007 – Federal Republic of Nigeria vs Orji Uzor Kalu & 2 Others. “That upon the return of Hon. Justice M. B. Idris (JCA), for the purpose of continuing and concluding the trial, His Lordship overruled the no case submission filed by the Applicant as well as the 2nd and 3rd Respondents (Udeogu and Slok Nigeria Ltd) whereupon an appeal was filed at the Court of Appeal, Lagos division challenging the ruling on the no case submission as well as the competence of Hon. Justice M. B. Idris, JCA, to continue to hear the matter. “That the Court of Appeal heard arguments in the appeal on the 7th February, 2019 and on the 24th April, 2019, the Court of Appeal, dismissed the appeal on account of which the 2nd Respondent (Udeogu) lodged a further appeal to the Supreme Court which said appeal was heard and determined as Appeal No. SC.622C/2019- Udeh Jones Udeogu V. Federal Republic of Nigeria & 2 Ors.” Supreme Court judgement big setback The Chairman of the Presidential Advisory Committee Against Corruption (PACAC), Prof. Itse Sagay (SAN), said the judgment of the Supreme Court nullifying Section 396(7) was a setback and a disservice to the Administration of Criminal Justice Act (ACJA) signed in 2015, adding that no section of the Nigerian Constitution (1999) barred a judge elevated to a higher court from returning to conclude part-heard cases. Prof. Sagay said, “We found, in many cases, judges had spent five to seven years on a case, they were promoted and they could not continue with it. A new judge would start and the case would begin all over again. It was killing our judicial system. That was why the National Assembly passed that law under the ACJA.” In the same vein, Kemi Pinhero (SAN) said he felt sad that the apex court failed to see the mischief by parties in criminal cases; who always found a way to delay or get a trial to start afresh, which the provision of Section 396(7) of the ACJA sought to cure. Pinhero said, “Sadly, in construing the provisions of Section 396(7) of the ACJA, the Supreme Court failed to take cognizance of the mischief intended to be cured and merely viewed the issue from the narrow compass of an attempt to avoid the implication of the previous interpretation of the constitution by the court. “In fact, the Supreme Court failed to consider in the entire judgment why the provision was introduced, but held itself bound to only the letters of the law. This approach, in my view, has occasioned injustice to the prosecution. “It is my submission that what the Supreme Court should have done in the circumstances is to adopt a purposive approach in its interpretative role by taking into cognizance the fact that the constitution as at the time it was made could not have envisaged the current situation in terms of the level of corrupt practices and delay in the administration of criminal justice, thus the interpretation given to the provision of the 1979 Constitution in the previous cases of Ogbunniya and Our Line Limited’s case which was influenced by the prevailing circumstances at that time ought to have been distinguished as rightly done in my view by Hon. Justice Idris.” But other lawyers such as Adeniyi Akintola (SAN) and Yunus Ustaz Usman (SAN) said the cure for the wrongs in the administration of justice could not be made using another wrong. Akintola said, “I have been among those warning that most of the provisions of the ACJA cannot stand the test of the constitution. “There was a case involving a chief magistrate in Oyo State who was elevated to the High Court of the FCT. He came back to deliver judgement in the magistrates’ court and the Supreme Court set aside the judgement. So, it is not new, it has always been there in our jurisprudence.” On whether Kalu should have benefitted from the earlier judgment of the Supreme Court, having been involved in a joint trial with the appellant, Barr. Oyeghe Seprebo advised Kalu to wait till the hearing of his pending appeal at the Court of Appeal to make the application for his release. Seprebo said, “Both the appeal and the decision did not appear to affect Orji Uzor Kalu, hence one would think that his conviction stands pending when his appeal is decided. Otherwise it will not be different from a situation whereby a judgement is being enforced against a person who is not a party to a proceeding.” He added that, “The wordings of the judgement are very clear and unambiguous. If the apex court wanted the decision to affect all defendants, they would have couched it so expressly. Now assuming the order of the court was that this appeal is frivolous, baseless and lacking in merit, order of N100m awarded against the appellant, can the order be enforced against other respondents who were defendants but did not appeal? COVID-19: The grotesque conspiracy against Bill Gates By Amir Bagwanje Bill Gates is busy helping poor African kids with vaccines and empowering small businesses and deprived women with start-up capital in order for them to grow out of poverty. Diseases such as malaria, meningitis, the crippler polio and other infectious illnesses will bear testimonies to Gates’ decisive blows if they could speak. Their abilities to strike have been significantly mitigated by the spirited interventions of the Bill and Melinda Gates’ Foundation (BMGF). His humanitarian work around the world, particularly in Africa, the epicentre of disease and deprivation, has uplifted millions of people. The billionaire tycoon is as much a philanthropist as he is a technology guru. Every time there is a disaster, be it natural or man-made, this kind man would be there to help. Despite these virtues, some blockheads have the guts to accuse him of trying to decimate the human population with covid-19. They have concocted that Gates wants to install a chip in humans so that he can control the world population. This conjecture would have been hilarious if it was pun-intended. But unfortunately, many people believe it to be true. How can you kill people in order to control them? Illogical! The truth is that technology guys, including Bill Gates, already control significant aspects of our lives. You cannot be formally educated, from the lowest to the highest levels, without benefiting from Microsoft products. The impact of technology in our lives today is immeasurable. He who controls technology dictates to the world literally. What they are imputing to this great philanthropist cannot hold water for so many reasons. His antecedents, impeccable humanitarian records, women and children empowerment, contribution to education and poverty alleviation, among others, especially in Africa, stand at odds with the deadly conspiracy against him. The BMGF expends over $2bn annually in various charitable courses in Africa alone. This man has willed 90 per cent of his money to charity. How dare anyone in his twisted mind accuse someone of his pedigree of mass murder! There was controversy around how COVID-19 swiftly spread; whether it was man-made in the Wuhan Institute of Virology or it spiralled from a Wet market where exotic animals are traded in Wuhan, Central China. Interestingly, this controversy has been laid to rest by the US Intelligence Community in its April findings, that: “Covid-19 was not man-made or genetically modified.” Scores of renown scientists and medical practitioners have agreed. Despite all the evidence that the virus came from China, some ill-informed people still went berserk with all sorts of unfounded conspiracy theories. Nigerians, in their longstanding penchant for alternative facts, did not hesitate to join the bandwagon that was raging fast like wildfire, and even took it to the next level. Their delusional wonderland knows no boundary. It beats my imagination that even well educated people indulge in this misinformation business. They even say without evidence that Bill Gates is bribing the National Assembly to pass a Covid-19 Bill so that he can make money from it. Laughable! Other groups who purport to be some kind of “experts” in world affairs, but no less ignorant, are blaming the 5G technology. My Muslim guys are saying it is a ploy by the West to stop them from their five daily prayers in mosques, forgetting that thousands of churches across Europe and America have ben shut as well. The virus is by far affecting more Westerners than Africans or Muslims for that matter. My Christian buddies “retaliated” with their own version of the conspiracy to the effect that President Buhari is using the covid-19 lockdown to stifle the growth of churches he so passionately hates or some unnamed Western Anti-Christ somewhere is attacking the children of God and that they need to pray fervently to overcome the enemy. Some know-it-all pastors and imams were reinforcing these fact-free theories from their pulpits. Some of them went overboard in the art of disinformation, they had to be reprimanded for endangering the lives of their gullible followers. Yet again, some other guys are accusing a non-existent American-Chinese biological warfare. The conspiracy spree graduated to the downright lunacy of accusing Bill Gates because, they claim he hypothesised in a 2015 TED talk about how unprepared the world is for the likelihood of a major virus outbreak. I wonder why they spared Obama and loads of other scientists who also spoke years ago about how ill-prepared the world is in the event of a possible resurgence of diseases like ebola and SARS. I am dumbfounded that lots of people believe these craps. It honestly breaks my heart that Bill Gates, who arguably is the biggest individual helper of Africa in history, would be paid back with a hideous conspiracy. Come on, Africans of conscience, stand up and defend the man that has dedicated his life to helping your brethren. I recall Dangote mentioned that his foundation was inspired by Bill Gates. Most Nigerians are habitual rumour mongers, they conjure up theories to explain almost anything, even in the face of undisguised evidence to the contrary. The early 2000s polio immunisation pandemonium is a case of reference, and more recently, the knee-jerk fairytale of “Jubril from Sudan” is still trending on social media. Clearly, Bill Gates is not the first victim of Nigerian conspiracy theorists. I recall during the formative years of the Boko Haram insurrection, many Muslims accused the duo of America and President Jonathan of sponsoring the carnage. They ridiculously argued that America was apprehensive of the burgeoning Muslim population, hence must be arming the terrorists to do their dirty job. Similarly, some Christians grotesquely fantasised that, Muslim politicians were orchestrating the slaughter of their own people, including the infamous 2014 abduction of Chibok girls, to discredit the Jonathan administration. So, we are basically accusing all and sundry but the real perpetrators – Boko Haram. These are the dangers of conspiracy theories. They allow you deny incontrovertible facts, just so it conforms with your wishful thinking. No wonder everyone is confused in that country. Because we are chasing shadows while denying scientific evidence and truth. I think posterity is angry with us in advance, unless we begin to feel it is incumbent upon us to right what is wrong; to be grateful to people who have demonstrated nothing but kindness to us; not to vilify them with awful accusations of profiteering from our deaths, when in fact all their lives, they have been doing the exact opposite. This is even as the pan-Northern socio-cultural organization, Arewa Consultative Forum, ACF, and Second Republic lawmaker, Dr. Junaid Mohammed, threw their weights behind the governor, insisting that they would support any policy that would rehabilitate the Almajirai for good. However, the Joint Association of Northern Youth Groups said unless Northern governors revived the programme former President Goodluck Jonathan put in place for the Almajiri children, the desired objective might nit be achieved. Governor El-Rufa’i said on his Facebook page that he was “pleased to see our Almajiri children, the batch of 218 from Kano, Nassarawa, Plateau & Gombe States looking well & free of COVID-19.” “With the support of @UNICEF_Nigeria, AMA Foundation, other NGOs & philanthropists, they are being restored full human rights, dignity & hope as children! But the only problem is with the implementation. Speaking in a telephone chat with Vanguard in Abuja, President of AYCF, Alhaji Yerima Shettima, urged other Northern governors to follow the footsteps of Governor El-rufai in this regard. He said: “We’re excited with the news because the Almajirai is not different from any other Nigerian child. So, Governor El-Rufai’s move is a welcome development to us. “However, it is a shame some people still do not believe the Almajirai should be fully integrated into the society so that they can become meaningful members. “The Almajiri is a child with the basic rights to education. The Child Rights Act does not exist only for privileged children. The Almajiri boy may, indeed, hold the key to the future of this nation if properly educated. “So, we urge other governors to do replicate in their respective state what Gov. El-rufai plans to do for the Almajiris in Kaduna.” ‘Go back to Jonathan’s almajiri template’ But Murtala Abubakar, Convener of the Joint Action Committee of Northern Youth Associations, said the governor’s statement should be viewed with caution. “The governor is known for making promises regarding the education of children of the masses in the past just to make headlines. The problem militating against the almajiri system of education is lack of political will and consensus among the critical stakeholders. “What the governor is advocating is not going to work; the system needs reforms not abolition. Non-essential retailers are to be allowed to reopen in England in June, British Prime Minister Boris Johnson announced on Monday evening. Prof. Ademola Tayo, the Vice Chancellor of Babcock University says the institution has put together a team of researchers to find treatment for the raging coronavirus pandemic. The Vice Chancellor disclosed this in statement on Tuesday by Mr Joshua Suleiman, the Director of Marketing and Communication of the university to newsmen. According to the vice chancellor, the team has submitted research proposals on COVID-19 to relevant government institutions for sponsorship and is waiting for approval. “Babcock University has put together a team of researchers to find a cure to the raging coronavirus pandemic. “Our faculties in the departments of public health and agriculture, who are currently researching on COVID-19 have submitted research proposals on it to the Nigerian Institute of Animal Science for sponsorship. “We also do hope that private universities will be eligible for the Federal Government’s funding for research on COVID-19 vaccine so we can benefit from it,” he said. Tayo said that there were popular insinuations in some quarters that private universities seemed to have zero failure rate while certificates were being awarded to the highest bidders. He however flayed such insinuations, saying, “I cannot speak for other universities, but I supposed they don’t also “dash” degrees to students. “The private university system globally has effective and dynamic instructional mechanisms that make learning interesting and inspiring. I dare say that the private university system has contributed a lot to the higher education sector in Nigeria and Africa. “It is the amazingly interesting atmosphere of teaching and learning, and building a community of scholars and scholarship where lecturers and students relate with each other with mutual respect and comradeship.” NAN reports that since Feb. 27, when the Minister of Health, Dr Osagie Ehanire, confirmed the index case of COVID-19 disease in Nigeria, the number of conformed cases has increased.
