He passed out immediately after activating MS. So he might nt knw how to use it then. Remember Kakashi took over a minute to take in only Deidara's arm while it take Tobi 2 seconds max to take in a whole body. So he propably had to wait till he had more chakra than before to use it. It even takes him time and concentration to activate MS when he first started using it.

Madara said he gave out his eyes(rinnegan eyes) to someone. Why else was he expecting Nagato to use the Rinne Rebirth on him?

During the Obito/Tobi vs. Konan fight, Tobi said the real reason for fighting Hashi was to acquire his DNA. But its like he was too injured to carry out his plan. And it also seems an Uchiha needs a Senju's DNA to awaken Rinnegan.
