I would categorize the people from which you can buy any parcel of land into three: An estate developer, an individual & directly from the family who claims to own the land. If you are dealing with an estate developer (buying within an estate), you should ask for the approved survey plan, approved layout, the power of attorney and the global C of O. If you are buying from an individual or company (one who has bought and wishes to resell), you should ask for the receipt, deed of assignment, approved survey plan and C of O.

Buying directly from the family who claims to own the land is quite tricky. This is because it is difficult to determine the true owners of the land especially when the documents showing ownership haven’t been processed.

Where the documents haven’t been processed, there are no documents to show authenticity and a prospective buyer has to really a great deal on word of mouth from the members of the community to ascertain the true owner(s) of the land in question.

When the documents have been processed, they should provide you with the approved survey plan, approved layout (where the land is a large one and is being sold on a per plot basis) and the C of O.

From my experience, families usually don’t go to the length of processing their C of O. Reason being that they hope to sell off their land in the near future thus only do the absolute minimum required to show authenticity, in this case the approved survey plan and layout, then passing it on to the buyer who would go on to perfect his/her title on the land.

NOTE: It is very important that you have a good property lawyer before embarking on land/property purchase. Reason being that your lawyer is the one who ensures that you don’t run into legal trouble with land/property documents after purchase. It’s your lawyer’s job to verify the authenticity of any title document backing the land/property.

PROPERTY SEARCH
Under the Lagos State Land Bureau:

Conducting a Search:
• Application submitted with affidavit of purpose (searches are conducted using the following criteria: – Name of Owner, Registration Particulars, Address of Property and Survey Plan.
• Letter of Authority (where applicable)
• Endorsement
• Bill for payment of Search Fees
• Tender Tellers
• Conduct Search

Work Flow for Registration of Title:
• Confirmation of all payment receipt (by Accounts Department)
• Collection of Form A13 from the Office of Registrar of Titles by Applicant – 1 day
• Duly completed Form A13 with supporting documents are submitted by Applicant to the Office of the Registrar of Titles
• A registration number & application number are issued to a certified application – 1 day
• Notice are prepared for interested parties signatures
• Reply to Notice is received and Draft Entries prepared
• An approved Notice is e-mailed /posted by registered post to applicant
• Prepared Notice are forwarded to Registrar of Titles for approval of issuance of Notice to Applicant
• Approval of Draft Entries
• Typing & Binding of Title
• Final Indexing of Title
• File is sent via the Deputy Registrar of Titles to ROT for signature
• Registered Title delivered to applicant

Work Flow for Registration of Deeds
• Submission of Application with relevant documents for registration of Deed by Applicants
• Application with accompanying documents are checked and endorsed
• Satisfied application/document are issued with registration number
• Application sent for indexing
• Applicant file is send to Deputy Registrar of Titles for signature
• File is sent to Registrar of Titles for second signature
• Registered Deed is delivered

Work Flow for Registration of Certificate of Occupancy
• Certificate of Occupancy is sent with a covering letter from LUAD to Office of Registrar of Titles
• The file is sent to the C of O room to add a file jacket to the C of O Form
• C of O is sent to the Deputy Registrar of Titles for signature
• C of O is sent to Registrar of Titles for second signature
• The details of registered C of O is entered serially in a day book
• The registered C of O is entered is a dispatch book and sent to LUAD for collection by applicants

Good day sir/ma. Many people have been wondering what could be the cause of the incessant tyre burst accidents on Nigerian roads. The major cause is that we put too much pressure in our tyres. How did I know?

I was preparing for a journey, I changed some of my tyres and I asked the vulcanizer that 'what is the recommended tyre pressure?' He said 50. I said alright, he should inflate it to 50 all round.

When I got to where I was going, I was discussing with some people on the issue of the minister that died on the road due to a burst tyre and wonder what could have happened because nobody could imagine a minister would be travelling with expired tyres as many would think is the major cause of tyre bursts.

A man (lived in US for many years) said that the major cause of tyre burst in Nigeria is that we put too much pressure in our tyres and that each car has recommended tyre size and pressure clearly written on it by the manufacturer.

*I was surprised and begged him to come and show me where it's written on my car. To my greatest surprise, it's by the drivers door which I enter everyday without noticing it.*

By the time we checked, the recommended pressure for my tyres is 32! and I just traveled with tyres on a pressure of 50! He took me round his compound and showed me that of the cars (which includes a jeep and a sienna) there, the highest was 32. Some were even 29!

He further explained that tyres are made of rubber and expand at high temperature. So, when you are travelling in the afternoon when the asphalt on the road is hot, the tyre will want to expand. If the pressure in the tyre is too much and wouldn't accommodate the expansion, a burst is likely to happen at that time.

Pls check the recommended tyre pressure for your vehicle and others you know.

Steps to buy your car from USA and ship to Nigeria.

Register with a car auction website:

Online car auction is the safest and most reliable way to buy your car across the Atlantic especially when you do not have a well trusted ally over there. Don't make the mistake of sending your money to any dealership. Most importantly, never send your money to family and friends that are not well trusted as they may use your money to pay rent. Some of these auction companies offer free registration while others charge $200 (N91,000) initial registration as well as annual subscription. A few of these online car auction sites are copart.com, auctionexport.com, iaai.com etc. You will also need to submit your identification card as well as other required documents in order to increase your bidding eligibility.

Learn and understand the common terms used in car auction:

This is very important as the technical terms are tools you require to make purchase decisions. You need to know the meaning of salvage title, clean title, buy it now, pure sale, enhanced vehicle, engine start program, run and drive etc. You also need a basic idea of the location of the states in USA so your story won't be like that of a guy who bought a car in Oregon State thinking the car was in Orlando, Florida. He eventually paid additional $1,500 (N250,000) in shipping charges back in 2014. OYO is your case if you make such mistake today as you'll have to cough out N700,000.

Note that you cannot export a car that does not have a valid title. You should only proceed to bid if the car's title document is clean title, certificate of title or salvage title. You will not be able to export a car from USA if it has bill of sale or parts only certificate except the car is dismantled.

Search and select the car you want to buy:

This is the most tedious part of buying a car in Nigeria as you sometimes have to drive from Lagos to Ibadan in search of a car you may not like eventually. However, online auction gives you access to over 150,000 cars from your bedroom. Isn't that interesting?

At this point, you really need to shine your eyes. This is where most people make mistakes as they fall in love with a car that looks spotless in picture. Thereby ignoring the fact that the vehicle narration states that it has a front end accident. You may not see the front damage in the picture because the car may have been partially repaired by the insurance company before putting it up for bid. Hence, you have to pay attention to every single detail and don't just look at a car on the surface.

Well, some car dealers in Nigeria don't pay attention to details because they prefer to buy the scrappy accidented cars which are cheaper and they come fix them here. Make sure you do a Vehicle History/VIN check before you proceed to buy the car. You can also engage the service of independent inspectors who would do a thorough inspection of the vehicle on your behalf. This inspection service comes at a cost of about $90.

Buy your car:

Some cars are listed as buy it now which means you can buy them at the displayed price immediately you spot them. However, other cars can only be purchased at a predetermined bid date. So you have to wait for that date and time to join the bid room (See video of Nigerians in the bid room).

Pay for your car:

Bank wire transfer and debit/credit card are the 2 main options you can use to make your payment. The card payment is faster and cheaper, however, you'll be restricted by maximum card limits and declined transactions on most Nigerian cards. Therefore, you are probably left with just the wire transfer. Buy dollar from your Aboki and send through your bank dollar account. All these can be done over the phone and online.

Furthermore, you have to initiate the transfer of the money as soon as possible because you will be charged a penalty of $50 to $100 if they don't get your money within 2-3 business days. Immediately they receive the money, they credit your car auction online account with the same amount. Hence, your payment for the car in processed and voila! the car is yours.

Ship your car from USA:

At this point, you or your shipping agent in USA will arrange a tow truck or flat bed to pick up the car and deliver at the closest US seaport. This cost may be as low as $200 and it may be as high as $1,800 if you buy your car in a state that is far away from the seaports on the east coast.

Note that your car must leave the auction company's compound/yard within 7 days after the bid date. Else, you will start to pay $20 daily for storage charge.

Your shipping agent clears the car through US customs for export. Before, you know it, your car is already on the Atlantic heading to Nigeria. Most people prefer Ro-Ro (Roll on Roll off) shipping method to Container shipping. This is because the container shipping method is a little more expensive. You also have to pair with other people in order to share the container cost. The challenge with the pairing is some of the people you share the container with may delay in presenting their shipping documents or payment for import duty in Nigeria and this may make you incur demmurage at Lagos port.

Clear your car with Nigeria Customs:

You can do this yourself if you have the time and energy to spare. Alternatively, employ the service of a reliable clearing agent who will clear your car within 2-3 days.

The surface duty is 35% of the estimated value of the car. In addition, you will pay surcharge, VAT, shipping and terminal charges as well as other miscellaneous charges. Note that owners of 2016 and 2017 cars with mileage less than 5,000 kilometres will pay surface duty of 70%.

Finally:

It takes an average of 6 weeks to get the car from the auction site to Lagos. I have done it before in 4 weeks but that was just a one-off.

Now. you can buy your car from USA and ship to Nigeria without leaving your house.
