Since this atrocious raid of the 7 judges by the DSS, with the hefty figures they claimed they found, and the fact they did not submit themselves for a search as required by law, they definitely planted those huge amount of money to rope in the judges because they refused to compromise. The knuckle heads did not consider the admissibility of their so called evidence before embarking on their illegal search. Buhari is on a mission to destroy this country. In a normal society, heads should have been rolling at the DSS. The goons have abandoned their constitutionally mandated duty of internal security to dabble into fighting corruption. Eden007: As a justice of the Supreme Court, you are not allowed to make press statement, Sue anybody to court or report to the executive arm any sensitive issue without first seeking the approval of the Cjn. If you observe almost all the judges arrested are addressing their grievances to the Cjn not a press statement. Justice okoro started in his letter that he verbally informed the Cjn. That was all he was allowed to do by the ethics guiding the judiciary. Also, have you considered the implications onot the security of the lives of his family considering Apc is in power and they own all security agencies currently. You should be reasonable and logical. There is a video evidence, call log of amaechi and Umana's visit. A supreme Court judge wouldn't throw such toothless allegations he knows the implications of it going to court. Apc started the wrong war. Check my posts I said this thing earlier. I am an insider. And the proper procedure for lodging such complaint is orally or casually? Grundig: Ozekhome cleared that up. He said the portion jiti quoted could only be admidsible where thr person, in this case thr judges failed to honour an invitation. First and foremost Ozekhome was absolutely ignornant of the law in question and/or its relevant sections. He had to comment for the sake of arguments since he didin't know the law. He was shadow boxing! If he were in court he is required to seek an adjournment for him to go back and study the provisions of the law. He didn't want to look defeated on national tv. It is clear that the judges would have resisted the arrest. Either by active violence (as in the case of Wike) or by simply not opening the door. They had hard currencies in their home and were culpable of money laundering. It would have been easy for the DSS operatives to have found their way in. The section of the law citàed by Ogunye is applicable & not the old law being churned out by the learned SAN Secondly with respect to the power of the DSS, the President is given a sweeping power to direct the DSS in such manner. If he feels thàt their internal security of the country is in jeopardy. It is the simple truth that when there is too much corruption in the judiciary people would begin to lose confidence in the courts. And where that happens people would begin to revert to jungle justice. Jungle justice is a very big threat to our internal security and needs to be prevented at all cost. It is therefore justifiable and reasonable for a responsible govt to take quick action. Let me remind you all that Boko Haram and Niger Delta militancy are a product of jungle justice! |

I respect Jiti Ogunye' s opinion on this issue. He cited valid laws and gave logical interpretations to the laws. In his postulations he cited ACJA, Criminal Code, DSS laws...all of these were explained correctly. Ozekhome's rejoinder was unecessary because it was incorrect and not the fact in issue. shuggah: ) Search Warrants are executed between 6:00 AM and 6:00 PM except on weekends. 2) Search Warrants are valid only if issued by a court of competent jurisdiction. 3) Search Warrants obtained in one State of Nigeria cannot be executed in another State excepted it is endorsed by a Magistrate or Judge equal in rank to the one that issued the Warrant. 4) Only two or three agencies in Nigeria are charged with the investigation of corruption cases namely the EFCC, the ICPC and the Nigeria Police. 5) Politically Exposed Persons (PEPs) and VIPs who do not constitute a flight risk are usually invited to appear before investigation Agencies. 6) The National Judicial Commission (NJC) is the only body empowered to sanction Judges and Justices found wanting in the discharge of their duties. 7) A current Governor is the Chief Security Officer of his State.
A current Governor enjoys immunity in terms of prosecution and the inviolability of his person. 9) The Judges in question have issued unfavourable judgements against the arresting Agency in the past, thus casting aspersions on the motive for their arrest.
ISSUES FOR DETERMINATION 1) Did the arresting Agency actually procure an Arrest Warrant from a Court of competent jurisdiction? 2) Did the arresting Agency adhere to the rules governing the procurement and execution of a Search Warrant? 3) Did the arresting Agency exhaust the option of extending an invitation to the suspects before procuring the Arrest Warrant? 4) Did the arrested suspects at any time pose the risk of taking to flight? 5) Does the arresting Agency not have people at all the land, sea and air borders to prevent an escape of the suspects? 6) Did the arresting Agency at any time write a letter to the National Judicial Commission (NJC) highlighting the offences committed by the suspects and demanding their release for an interview? I leave this for the Court to decide ! My simple response is for you to go back and read your law books very well with special reference to the New Administration of Justice Act and the law establishing the DSS! |

Media trial might not give us a constitutional judgement but the conventional courts cannot give us justice either.
