The United States applications for jobless benefits has fallen less than last week forecast, it shows gradual improvement from the worst of the pandemic-related retrentchments even as states re-open more of their economies.

Initial jobless claims for regular state programmes totaled 1.51 million in the week ended June 13, down slightly from an upwardly revised 1.57 million in the prior week, Labor Department figures show. Applications have exceeded a once-unthinkable 1 million on a weekly basis since mid-March.

Continuing claims – the total number of Americans claiming ongoing unemployment benefits in state programmes – decreased to 20.5 million in the week ended June 6. Those figures are reported with a one-week lag.

Given the unprecedented surge of claims in recent months, many economists look to the non-seasonally adjusted figures for a more accurate read on claims. Unadjusted continuing claims actually climbed by almost 26,000 to 18.7 million.

By several metrics, the economy has rebounded at a faster pace than many anticipated. Payrolls at companies increased by several million in May and consumer spending on cars, restaurant meals and more soared last month, exceeding expectations as states loosened restrictions.

But the jobless claims data remain a glaring blemish that shows churn and volatility in a labor market that entered the year in solid shape.

Federal Reserve Chair Jerome Powell underscored this dichotomy to lawmakers Tuesday when he said, “We would expect to see large numbers of people during this period coming back to work during this second period – call it the bounce back or the beginning of the recovery,” Powell said.

“Then we think, and I think most if not all forecasters think, that will leave us well short of where we were in February.”

The former National Chairman of the ruling party All Progressives Congress, APC Adams Oshiomhole who was recently replaced with former Oyo State governor, Senator Abiola Ajimobi, as its acting National Chairman has said unequivocally in an interview on a national TV program that he would henceforth act in line with legal advice.

His words, “What I do next will be based on legal advice, If you ask me what I am doing now, I am resting in obedience to the court order, I am reflecting, and I am consulting with my lawyers.”

“The NWC was never taken to court & there is no judicial pronouncement to the effect that NWC no longer exists. The court has not frozen the constitution of APC.

“I think there are people who are determined to hide under this crisis to perpetuate their own agenda.

“For me, the business of APC will be transacted as a member.”

Recall the Oshiomhole has previous disregard the FCT high court order before the recent appellate court judgment.

Adams Oshiomhole has since ceased to remain the National Chairman of the All Progressive Congress.

The national deputy secretary of the All Progressive Congress (APC) Chief Victor Giadom, has said he has taken over as the acting chairman. The new leadership has however canceled the Edo Governorship Screening exercise.

In his words, while briefing newsmen in Abuja a while ago at the National secretariat, Giadom said due to the court notice on March 16, 2020, that the earlier suspension of comrade Adams Oshiomhole stand, he (Victor Giadom) should act as National Chairman.

Giadom also said a fresh screening for all the aspirants who intend to seek for governorship in Edo and Ondo will be conducted.

George Waddell, an 86-year-old man having tested positive for COVID-19 should consider himself lucky after roughly 85 days in the hospital.

George Waddell finally returned home. Nurses wheeled him out, but he practically stood up on his own.

Waddell said exactly what happened is still a little fuzzy.

“Most of the time that I was in the hospital,I lost my memory,” Waddell said. “90 percent of what happened I don’t remember.”

Waddell was one of the thousands of elderly people who contracted COVID-19. He graciously survived a virus that’s hit the elderly the worst.

Virtually eight out of ten deaths linked to COVID-19 have been in adults over 65.

What led to his recovery is the million dollar question right now.

Waddell is known for being pretty active. Neighbours have seen him hold his cane with one hand and push his lawnmower with the other.

After just a few days at home, he said he’s ready to get back to work, even if he has to move a little slower.

“I feel good breathing,” Waddell said. “I get tired quickly.”

A 5-year-old daughter Demyhia Bates, Monday, has been hit and killed outside her home while playing in the neighbourhood.

The family presently grieve over the ill-fated loss of their 5-year-old daughter who was killed in a hit-and-run outside on Monday night.

Demyhia Bates was playing tag with her older brother when a driver hit her, who briefly got out of the car and then back in and drove off.

The sad mother Vernesha Bates said, “Seeing your daughter, your baby, laying there on the ground … I don’t want to go through this, she broke my heart and left me.”

Bates said the pain is indescribable. Her daughter was just being her young self outside the house and playing while Bates was inside getting ready to make dinner when her life changed forever.

“I see my baby laying right there on the concrete with blood on the side of her head,” Bates said.

The police officers with the St. Louis Metropolitan Police Deportment said the accident happened around 7:30 p.m. Monday near the intersection of Shulte and Park in the Walnut Park West neighborhood.

The 35-yer-old driver was taken into custody Tuesday morning.

“Why didn’t you get out to see if my baby was ok?” Bates said. “I heard she was a mother too and had her baby in the car. Why didn’t she pull over and see if she was ok? … It’s heartbreaking.”

Some residents of the neighborhood said speeding has been an issue in the area for years. Bates’ boyfriend, Carlos Hill, said drivers ignore caution signs and speed through stoplights.

“This corner right here on Park Lane and Shulte they run it quite often, it’s ridiculous,” Hill said. “They need to put a block up or something if you ask me.”

In an attempt to further support the bereaved family, a GoFundMe account has been set up to help during this difficult time.

A senior American official says China is using Huawei 5G to export its ‘surveillance state’.

The US government has warned South Africa that it is risking the security of its most sensitive information and data by using the 5G telecoms network infrastructure of the Chinese telecoms giant Huawei.

The warning comes as the Donald Trump administration intensifies its efforts to shut Huawei and the other Chinese 5G company ZTE out of international networks.

Under Secretary of State for Economic Growth, Energy and the Environment Keith Krach claimed recently that “the tide is turning” in this global effort against Huawei.

But South Africa seems unlikely to be persuaded as Huawei is growing increasingly integrated into all its main cellphone and data service providers.

Krach repeated America’s warning that Huawei could not be trusted, because, like all Chinese companies, it was bound by law to hand over any information demanded by the Chinese government.

Krach, whose mandate includes ensuring global economic security, outlined in a phone briefing to international journalists how the US government was accelerating its efforts to protect 5G security (in other words, to cut out Huawei).

There is concern that North Korea could turn to provocation to bolster its internal unity and wrest outside concessions as nuclear talks with the United States remain deadlocked. Some observers say North Korea desperately needs sanctions relief in the face of harsh United States-led sanctions and the COVID-19 pandemic.

South Korea’s national security director, Chung Eui-yong, held an emergency video conference with ministers in charge of security and military generals on Sunday morning to discuss the latest situation on the Korean Peninsula and the government’s possible steps, the presidential Blue House said in a statement.

The Unification Ministry, which handles relations with North Korea, later said that both Koreas must strive to abide by all agreements they have reached. The Defense Ministry said separately it closely monitors North Korea’s military and maintains a firm military readiness.

Both ministries said the South Korean government “views the current situation as grave.”

On Saturday night, Kim Yo Jong, the influential sister of North Korean leader Kim Jong Un, warned that Seoul will soon witness “a tragic scene of the useless North-South liaison office (in North Korea) being completely collapsed.” She also said she would leave to North Korea’s military the right to take the next step of retaliation against South Korea.

North Korea earlier suspended communication lines with South Korea and threatened to nullify 2018 agreements that led the Koreas to halt firing exercises, remove some land mines and tear down guard posts in front-line areas.

The North has linked its recent series of threats to Seoul’s failure to prevent activists from launching propaganda leaflets across their border. But some experts say North Korea is deeply frustrated that South Korea hasn’t done enough to revive lucrative joint economic projects as well as over a lack of progress in its nuclear talks with Washington.

The negotiations have made little progress since a second summit between Kim Jong Un and President Donald Trump in early 2019 fell apart because of disputes over how much sanctions should be lifted in return for Kim’s dismantling his main nuclear complex.

Kim later vowed to expand his nuclear arsenal, introduce a new strategic weapon and overcome the United States-led sanctions that he said “stifles” his country’s economy.

He also pushed South Korea to resume the operations of the two big inter-Korean projects — a factory park and a tourism site, both in North Korea — but South Korea was unable to do so due to the sanctions.

Kim’s struggle to address economic woes has likely faced setbacks as the COVID-19 pandemic forced North Korea to close its border with China, its biggest trading partner. North Korea says it hasn’t reported a single outbreak but foreign experts question that claim and warn a pandemic in the North could be dire due to its fragile heath care system.

Some observers say the end of the 2018 deals could allow North Korea to send ships across the disputed sea boundary, float down mines on a border river or take other provocative steps at the border area. The South Korean Defense Ministry statement said the 2018 deals must be maintained to prevent accidental armed clashes and establish peace on the Korean Peninsula.

But it’s still unclear if the North would go ahead with its threat to destroy the liaison office, which was built at a North Korean border town following a 2018 summit between Kim Jong Un and South Korean President Moon Jae-in. Such a move could deepen anti-Pyongyang sentiments make it difficult for the North to restore ties with South Korea when needed.

The Permanent Secretary, Delta State Government House and Protocol, Eddy Ogidi-Gbegbaje is currently embroiled in a case of financial misappropriation running into several millions of naira.

Some Government House sources who pleaded anonymity disclosed that Ogidi-Gbegbaje had raised a memo for the renovation of the VVIP Guest House inside the facility in Asaba, the state capital, to the tune of N43,457,922.83m but only repainted the place and pocketed the rest of the huge sum of money.

A memo with tracking No. GHA.183/TI/150&151 made available, Ogidi-Gbegbaje quoted the sum of N43,457,922.83m for the renovation and electrical maintenance works of the VVIP Guest House.

In the memo, the Permanent Secretary informed Governor Ifeanyi Okowa on the urgent need to renovate the guest house, which sources said was still in good condition as at the time the memo was raised.

“It was a deal that the Permanent Secretary had a vested interest in together with few other Government House officials. I can tell you that nothing like renovation and electrical maintenance was carried out in the guest house.

“It was only mere repainting and as usual, the rest is now history. Ogidi-Gbegbaje is good at raising such memos which is used as conduit to steal public funds,” the source said.

When contacted over the issue, Commissioner for Housing in the state, Festus Ochonogor, claimed that the project was a Government House project. By implication, he knows little or nothing that would warrant his comment.

He said, “It is a Government House project. It is all encompassing. The figures may be striking but the project may be bigger than what it is. You don’t just look at figures.”

Reacting to the alleged scandal, Ogidi-Gbegbaje said, “That’s interesting. Please carry out your investigation properly.”

Facebook’s $19 billion acquired company, WhatsApp, has after a long expectation unveiled its payment feature which will allow users of the messaging app to send and receive money.

The new WhatsApp Payment Feature was, Monday, launched in Brazil, a country with about 120 million users of the app, the second-largest after India which has about 400 million users.

In 2018, WhatsApp first tested the digital payments in India but Brazil’s launch is the first nationwide rollout.

The trial launched in India in 2018 was developed by the National Payments Corporation of India (NPCI) and called WhatsApp Pay.

The new WhatsApp Payment Feature rollout which is expected to be extended across the world is powered by Facebook Pay and it allowed people and small businesses in Brazil to make payments via the app to their contact list.

According to Matt Idema, chief operating officer of WhatsApp; “sending money or making a purchase on WhatsApp is free for people. Businesses will pay a processing fee to receive customer payments, similar to what they may already pay when accepting a credit card transaction.”

For security, messaging app touted for its end-to-end encryption (although there are recently some concerns raised) stated that the payment feature will require a six-digit PIN or fingerprint to authorise transactions.

Idema speaking on the approved banks’ Card for the payment feature in Brazil said; “to start, we will support debit or credit cards from Banco do Brasil, Nubank, and Sicredi on the Visa and Mastercard networks -and we are working with Cielo, the leading payments processor in Brazil. We have built an open model to welcome more partners in the future.”

The company did not give any hint on the country next on its list as concerned with the launch of the payment feature.

More than 20 million Nigerians were reported by The Global State of Digital in its 2019 report to be active WhatsApp users in Nigeria.

Many small scale businesses in Nigeria promote their products on the platform. This is because of its no-cost promo model and ease of distribution.

Bank applications and direct deposits are used by most of these sellers (in Nigeria) to receive payment for orders via WhatsApp at present; except for those ordering via sellers’ websites ― these buyers are more likely to use provided payment gateway.

The fast growth of WhatsApp in Nigeria is due to no other reason than the expensive cost of sending text messages.

The application contains no advert and appears with no model for generating revenue for its company.

In January 2016, Facebook had hinted the monetising strategy employed by the app will change.

The WhatsApp payment feature may be the ultimate response.

Recall his know friend, Hushpuppi was recently arrested and whisked away by the Interpol on the allegation of financial crime in Dubai.

He has since been moved to the United States for serious quizzing.

However, Mompha has come out harshly on some of the trolls on his page. He cursed them, called them hypocrites who never mind their business, and that ‘thunder’ will fire the hands they use in typing.

The Federal High Court sitting in Benin has renewed its order restraining the All Progressive Congress, APC national chairman, Adam Oshiomhole and Independent National Electoral Commission, INEC from going ahead with the direct primary election in Edo State.

At the resumed hearing, counsel for the Defendants informed the Court that they have filed an appeal at the Court of Appeal, Benin to challenge the order of the court and asked the court to stay further proceedings in the matter.

The counsel for the plaintiffs objected to the request citing a Supreme Court authority on the point, which is to the effect that there must be a positive order of the Appeal Court before such an application can be granted.

Recall last week, the Federal High Court Benin refused an application for an interim injunction by the Godwin Obaseki group to restrain APC from conducting direct primary in Edo State but ordered that parties should maintain the status quo. The matter was adjourned to Thursday this week for hearing of the substantive suit.

The Court further adjourned to give a ruling on the issue.

During the brief break, a drama ensued when a supporting counsel in Adams Oshiomhole’s legal team, named Peter Uwadia threatened to go physical with another lawyer, who is an official of the Edo State Government.

On resumption from the break, the Judge, Justice Umar said he was going to grant a further adjournment to get details of the said appeal, but renewed his earlier order restraining the defendants from taking any further steps on the mode of the APC primary election in Edo, until the final determination of the suit. The matter was adjourned to June 17, 2020, for the continuation of hearing.

The have been various reports of employment termination. This act by some employer(s) of labour has been seen as cruel and insensitive by victims. The COVID-19 pandemic has now made it even worst as a series of employees have had to go through this experience.

This is not exclusive to a country but across the globe. Recently, a Nigerian financial institution, Access Bank announced a mass termination of employees which was greeted with a plublic outcry. The reason is not farfetched. The United States is presently battling with over 40 million out of job crisis.

Dubai Experience
Q: I have been working with a company for three years. In April 2020, I took pregnancy leave. One month later, I received an email from the company management saying that I was being terminated following an unsatisfactory annual performance report. Does the management have the right to terminate my services while I am on pregnancy leave? In case my termination is valid, does it affect my pregnancy leave payment? Do I have the right to request that I be reinstated through the Labour Court? And is a termination letter via email valid?

A: As per the UAE Labour Law, the employer does not have the right to terminate an employee who is on pregnancy leave. Such termination will be considered an arbitrary dismissal. Therefore, the questioner has the right to ask for compensation which is equal to three months’ full salary along with other end-of-service benefits. The termination does not affect the pregnancy leave payment. The questioner has no right to ask the Labour Court to force the employer to reinstate her services. Finally, termination via email is considered valid as per the UAE Labour Law.

Q: I have been working for a private company in Dubai for four years. My contract is certified by the Ministry of Labour. As per my agreement with the company, I am not entitled to work with a new employer in the emirate for two years if I happen to quit. Can I ask the court to reduce this two-year period because it is not reasonable to be without work for two years? The condition of non-competition is part of an external paper and not recorded in the work contract, so is it valid?

A: As per Article 127 of the UAE Labour Law, where work assigned to a worker allows him to become acquainted with the employer’s clients or to have access to his business secrets, the employer may require him to sign an undertaking not to compete with him or participate in any enterprise competing with his own, after the termination of his contract. For such an undertaking to be valid, the worker must be at least 21 Gregorian years of age at the time the agreement is concluded, and the agreement must be confined, in terms of time, place and the nature of the business, to the extent necessary to safeguard the employer’s legitimate interests.

Article 909 of the UAE Civil Transaction Code says when the work entrusted to an employee enables him to have knowledge of the secrets of the employer’s business or to know the clients of the establishment, the parties may agree that the employee will not be entitled, after the termination of the contract, to compete with the employer or participate in a competitive business.

Such an agreement shall not be valid unless it is limited as to time, place and kind of work, to the extent necessary for the protection of the legitimate interests of the employer.

The employer may not avail himself of such an agreement if he terminates the contract without any cause attributable to the employee; nor can he avail himself of such agreement if he himself has given the employee adequate grounds to terminate the contract.

It is understood from these articles that the worker is committed to not competing with the employer during the validity of the contract, and the source of this commitment is the law, in that he is committed to performing the work for the benefit of the employer and not for himself.

Outside the contract period, the source of the worker’s commitment to non-competition is the agreement and not the law, whether the agreement was stipulated in the work contract or a subsequent agreement.

The court has the right to estimate the conditions of the non-competition agreement as per the case documents and circumstances. But this agreement is conditional. The most important of this is the eligibility of the worker, i.e. reaching 21 years and not to be in absolute agreement in the sense that it is necessary to agree on the type of work that prevents the worker from competing with the employer. The agreement must determine the period of refraining from the competition and its spatial scope to the extent necessary for the protection of the legitimate interests of the employer. Moreover, the employer should not compete with the worker with an exaggerated penal condition with the intent of compelling him to continue to work with him.

The High Court of Dubai in one of its decisions discussed the spatial scope by saying that the contract between the two parties stipulated that the plaintiff may not work in the same field except after two years and the prohibition was not intended for a specific place and region, which means that the prohibition became absolute in the place and was not limited to the place to which the employer’s activity extends. This leads to the consideration that the condition of non-competition is not correct. The prohibition of absolute competition is a complete waste of the freedom of the worker. If the act constituting the competition exceeds the place in which the employer begins his activity, he is not bound by this condition or falls void.

In an account given by some eyewitnesses, another Boko haram attack has taken over a village in Borno. The men attacked the village in armored tanks and trucks filled with guns.

There are about seven people, including the village head, children and women, believed to have been abducted from the Faduma Kolomdi community, described as a nomadic town in northern Borno.

Residents reported that the men gathered the villagers and started shooting in the incident which lasted several hours.

One of the survivors of the callous Boko haram attack told the authorities that the attackers came under the cover of being Islamic teachers.

“They gathered us and said they wanted to deliver a religious sermon to us. They asked us to submit whatever arm we had. Some villagers gave up their guns, bow, and arrows.

“Suddenly, they started shooting at will. Even children and women were not spared, Many were shot at close range,” the man, who was not named, said in the statement.

“We have buried 49 corpses here while another 32 corpses were taken away by families from the villages around us.

“The insurgents abducted seven persons, including our village head. They went away with 400 cattle,” the man added.

The attack involving women and children was carried out by Boko Haram and Islamic State West Africa Province, ISWAP members operating terrorist sleeper cells in communities in the area, Nigeria military spokesman Sagir Musa said in a statement.

A large number of troops have also been sent to the area to bolster the military’s response to the attack, the army said.

“The Nigerian Army is committed to investigating the circumstances of these callous attacks by desperate Boko Haram criminals and the bandits on innocent civilians,” Musa said.

The World Unified Heavyweight Champion, Anthony Joshua has reached an agreement with Tyson Fury on a two-fight deal, says promoter Eddie Hearn.

The two Britain’s rivals have been holding talks over an undisputed world heavyweight title fight and have thrashed out initial terms for two blockbuster fights.

“We’re making great progress, there is still a lot to overcome. We are looking at venues and dates” said Joshua’s promoter, Eddie Hearns.

“We have the Dillian Whyte mandatory which is due before this fight.

“It’s fair to say Joshua and Fury are in agreement regarding the financial terms of the fight.

“We’re in a good place. It’s fair to say that, in principle, both guys have agreed to that fight. Two fights.

“We’ve been talking to Fury’s management team, MTK giving them the assurances from Joshua’s side that all the details on the structure of the deal is approved from our side. And it is from Fury’s side, as well.

“There’s a lot to overcome in the meantime. We’re moving in the right direction. I’m confident that both guys have given their blessing for the fight to go ahead.

“The point of Fury, Joshua and the teams agreeing to the structure of the deal? The first fight could happen next summer. It will be 2021.

Tyson Fury has since taken to official Twitter handle to make submission of his readiness for the bout slated for next year.
