By Nosakhale Akhimien Updated October 26, 2023 A Senior Advocate of Nigeria (SAN), Robert Clarke, says the lawyers of Atiku Abubakar and Peter Obi did not demonstrate professionalism in challenging President Bola Tinubu’s victory in the 2023 election.
“I am not saying they (Atiku, Obi’s lawyers) fumbled the case; what I am saying is that they have not displayed a good sense of legal practice,” the legal luminary said on Thursday’s edition of Channels Television’s Politics Today.
The senior lawyer’s comment comes hours after the Supreme Court upheld the victory of Tinubu in the February 25 presidential election.
The apex court, in its ruling, dismissed the appeals by Atiku, the presidential candidate of the Peoples Democratic Party (PDP); and his Labour Party (LP) counterpart, Obi.
A seven-judge panel dismissed the opposition’s appeals over claims of fraud, electoral law violations, and Tinubu’s ineligibility to run for president.
The apex court thrashed all the grounds of appeal of Atiku and the PDP on qualification, non-compliance with the Electoral Act, the 25% votes in FCT, and electoral malpractices.
Commenting on the ruling of the apex court, Clarke said there was a lack of due diligence in the appeals, pointing out that the legal representation of Atiku and Obi could have been better.
The senior lawyer said he would not even permit a junior member of his chamber to bring such a brief before the Supreme Court.
“Where the law is not allowed to put its heads up in a proceeding, it means that there is another law which prohibits their lawyers to have brought such. They know it, they still decided — either to please their supporters and allow such a matter to come before the Supreme Court,” he said.
“I will not allow any junior in my chambers, even one or two years old to carry such a brief to go and argue in court when I have looked into all the facts and the facts are very clear. There is a limitation of time in election matters. You cannot do certain things.”
Clarke said Obi and Atiku’s lawyers had the chance to present their evidence at a lower court but they did not.
“They had the opportunity as a pre-election matter but they never brought it out. They had the opportunity as a matter within a tribunal’s case but they never brought it. They are now coming and bringing matters that should have been argued in the lower tribunal and the Supreme Court will now be reviewing such evidence as an appellate matter and not as an original jurisdictional matter.”
“I am not blaming the lawyers; that is the last thing I would do, but I am sorry to say that the lawyers, with due respect to them, should have done a better job in this regard.

Dreyxam: Abu Salami, the businessman, who recently called out Nigerian singer, Davido, for failing to fulfill his ₦218 million contract obligation, has further disclosed that he paid a sum of ₦5 million to Larry Gaga, who's also a recording artiste, to meet with the Unavailable lyricist.
In an exclusive interview he had with AfroWorldNews, the Abu Salami Media founder, stated that he agreed to pay Larry Gaga the ₦5 million he requested, as he couldn't secure an agreement with Davido's sister, whom he earlier met.
''I won a contract of $500,000 USD for my company. It was for a football show, which I have been doing for six years. When I was negotiating with the company that came with the funds, part of the promises I made was that I would get Davido on board as our ambassador. They told me I would have to negotiate with Davido myself, which I went ahead to do.
''I contacted his friends, and people close to him to get his attention. I eventually got to his sister, whom I negotiated with at the time. What she wanted then was ₦200 million naira upfront payment, and 35% of my company because they believed I would be making quite a lot of money, which was true. But I didn't have the requested ₦200 million,'' Salami told AfroWorldNews.
''The company that gave me the contract was only going to make part payment first to me, and it was ₦167 million.
''So, I eventually met Larry Gaga, who's a renowned person in the industry as well. Larry Gaga charged me ₦5 million to take me to Davido, which I agreed to. He took me to Davido's place, and the day we met, we spoke and had an agreement. We shook hands, took a picture together as well, and he asked for a deposit to make. I told him yes, and he then asked me to go and make the deposit in the bank with one of his aides by the name, Lati. 40 minutes after meeting Davido, I transferred ₦100 million to him.
''Two days later, I sent the contract to Davido to sign, and he said he was going to share it with his lawyers. So, I waited. I reached out to him a week later to ask about the contract, and he said his lawyers were at it. He further stated that he wasn't going to sign the contract until the money agreed was fully paid. The money to balance him was N76 million. Then we agreed that I would be paying him N15 million on a monthly basis. I was keeping up with the payment for the first two months.
''The third month I asked for his availability to shoot a commercial for the show. But on the first day of the shoot, Davido didn't turn up even after I had rented N8 million worth of equipment. He said he had a flight to catch, so I lost my ₦8 million. I didn't complain, I kept on working with him. When he got back, I reached out and said we were going to set up for the shoot again, and he said fine. David said he couldn't make it to the stadium, and I lost ₦9 million that day. So I called Larry Gaga I couldn't continue to live like that. He promised to talk to him.
''I now decided to shoot bigger stuff this time around, with presenters and big generators at the stadium. Davido called me while I was there that he couldn't make it to the stadium and that I had to come to his house and shoot it in his garden. I protested against it, and he said it's either I do that, or I forget about it, as he was travelling that night. We took all the equipment and ran there, Obviously, they were too big for a garden, we couldn't use them. We lost the money, but we managed to shoot that day.
''After editing it, I called Davido that he needed to come and do sound, and he said, I needed to make another payment. I then told him that I had given him N130 million already, and I couldn't give him more until we had some content to show the sponsors. He now said if I don't have any money to give him he wasn't going to do anything. I begged him for a month and a half to get the sound from Davido.
''I paid another ₦15 million and told Davido we wanted to do a press conference. He then said he didn't know that was part of the package, and I needed to pay another N30 million. To cut a long story short, a day before the press conference, his son died, which stopped the project for six months. When he came back and started doing things, I reached out to him again, and he asked for money to kick off. So, I paid him another ₦15 million.
''We eventually agreed on another day for the press conference, and I have been in his house for three days, making sure he will be available. A day before the press conference, Davido sent me a message that he would not be available because he wanted to take his wife to dinner. At that point, I lost my mind. I went and did the press conference myself, and when I got back, I went to see him, and he was angry that I went ahead, trashing the N10 million I spent on it.''
Salami further revealed that Davido threatened him, and said he would show him that he's bigger than him in the industry.
When asked about Larry Gaga's role in ensuring that Davido fulfilled his obligation of their agreement, Salami stated, ''I can't lie, he tried his best to get Davido to do the right thing. He even spoke with him in my presence, but the person I was dealing with was just who he is.'' Wetin him wan help u sell gaan? |

Dr. Jibril Tafida, has congratulated President Bola Ahmed Tinubu on his well deserved victory at the Supreme Court which upheld the mandate which Nigerians handed over to him at the Presidential polls on February 25, 2023 election.
In a news statement made available to newsmen in Abuja, He described the Supreme Court judgement as a legal foundation for the sustenance of our democratic process and an affirmation of the willful Presidential mandate that millions of Nigerians gave to Asiwaju to lead Nigeria to achieve its full potential.

THE recent disagreement between the National Universities Commission and the National Board for Technical Education over a ‘top-up’ programme to convert Higher National Diploma obtained in polytechnics, to bachelor’s degree offered by universities, is an absurdity. President Bola Tinubu, and the Minister of Education, Tahir Mamman, should intervene quickly and stamp out the blather.
Both agencies have argued over jurisdiction to award degrees, and over attempts to “convert” HND to one. The NBTE is reportedly seeking collaboration with foreign universities to create “an alternative to the post-graduate diploma” for HND graduates as an entry route for those intending a career in the academics.
The NUC insists that the NBTE lacks such powers. Besides, it declared, “Both the NUC Establishment Law and its Operational Law: Education (National Minimum Standards and Establishment of Institutions) Act vest in the Commission the powers to superintend and regulate university education in Nigeria, lay down minimum academic standards in the nation’s universities and other degree-awarding institutions, and accredit their programmes.”
But the NBTE countered, “Only the FME (ministry’s) Division of Evaluation and Accreditation has the power to assess the foreign degrees (not NUC) after the students have graduated.”
Mamman should step in.
HND and bachelor’s degrees are not the same though they have similarities. Both are valuable. Claims of superiority or inferiority are also misplaced. Trade certificates, professional craftsmanship qualifications and polytechnic education originated to drive industrialisation by combining practical and technical training with academic grounding to provide skilled technicians for factories, mechanised farms, and offices, and social services infrastructure.
In the 1960s up to the 1980s when Nigeria’s industrialisation was about taking off – with textiles, vehicle assembly plants, beverages and steel rolling mills, and electronics assemblies among others sprouting – polytechnic graduates were in demand. Today, with the rollback of manufacturing, they struggle for relevance.
The misguided ‘top-up’ reflects the lack of a viable and functional national developmental plan tied to the country’s educational structure.
The real issues remain. The salary entry-point disparity between HND and degree holders in the public service provokes accusations of discrimination. In 2021, the National Assembly intervened, passing a bill to abolish the dichotomy, but the then president, Muhammadu Buhari, withheld assent.
A certificate cannot be “topped up.” There are already prescribed and effective routes for HND holders to upgrade their skills through the postgraduate programmes in the universities.
A caveat: universities, local or foreign, are free to prescribe their own entry qualifications for degrees. National jurisdictions exercise accreditation rights.
The NBTE needs to reinvigorate the importance of the technical education and to engage government to drive the much-needed industrialisation in the country.
Government should revitalise the mining, and industrial sectors. It should push for mechanised farming and ICT by creating an enabling investment environment, and investing in infrastructure. This will rejuvenate polytechnic education.
The OECD said major world economies have transitioned from, and outsourced manufacturing, and more than 70 per cent of their GDP now comes from services, thus reducing the need for polytechnics. Many UK polytechnics have been restructured to universities utilising the Further and Higher Education Act 1992. They did not “convert,” or “top up” HND to degrees!
Polytechnics are still important. Experts explain that the HND programme comprises practical work experience and academic studies for hands-on skills. The bachelor’s degree focuses on quantitative skills in the classroom with lab-based courses. Polytechnic education was introduced in Nigeria to drive the mechanisation and industrialisation through the training of technical manpower, it must not be erased. Nigeria will likely still industrialise.
The “top-up” plan is ridiculous; it should be dropped immediately.

The Enugu State High Court, Thursday, ruled that the proscription of the Indigenous People of Biafra, IPOB, by the Southeast Governors’ Forum in 2017 amounted to administrative abuse, hence null and void.
Mazi Nnamdi Kanu, the IPOB leader, had approached the court to seek the voidance of the prescription based on the fact that IPOB is a registered organisation, and composed of members who are exercising their right of association.
The suit was instituted by Kanu’s special counsel, Barr Aloy Ejimakor.
Among the reliefs sought are the de-listment of IPOB as a terrorist organisation in line with the provisions of the African Charter and the Constitution of the Federal Republic of Nigeria.
Other reliefs sought by Kanu include a declaration that self-determination is a right, public apologies in three national dailies and N25 billion damages, as well as restraining the government from proceeding with criminal proceedings against him.
Justice A.O. Onovo, while delivering the judgement, agreed with the applicant that the African Charter binds on Nigerian courts, hence self-determination is not a crime.
On monetary damages, the court granted N8.billion in damages to Kanu. It however declined jurisdiction in stopping the criminal trial of Kanu on grounds that it is before the Supreme Court.
Ejimakor commended the court for being the last hope of the coming man. In his words, “We are grateful that justice has prevailed over this matter since 2017.
“The court has reaffirmed the hopes of the common man in the judiciary. You have saved thousands of lives.”

id911: Fellow Obidients, we have come to the end of the road as far as seeking justice in the 2023 Presidential case is concerned! We fought a good fight. We believe our candidate, HE Peter Gregory Obi, was the best among the three protagonists. However, President Bola Ahmed Tinubu had the most votes. The Supreme Court has unanimously affirmed his election.
After the 2023 general elections, I personally widthrew from commenting frequently in the politics section which I've been consistent for a few years for personal reasons. I will always support Obi unless a better person/candidate shows up in the future. My objective is for us to have a better society for us and our children.
After the end of Military rule in 1999, I supported President Obasanjo, Yar'dua, was indifferent to Goodluck Jonathan. I never supported Muhammadu Buhari throughout his eight years reign and I can never support him even if he were to be there for life. I kicked against most of his policies because I strongly believe he's grossly incompetent.
In the case of President Bola Tinubu, I won't be against him or his policies. I will rather wish him and his team the best in piloting the affairs of our country the right way. I will try my best to educate and admonish all the people in all our social media platforms and offline to see reasons why President Tinubu must be supported to succeed.
