DeepSight:Me I am not a lawyer, I studied architecture at the university, so the only law course I took was Land Law. Having said that, I understand the general principle of law and law making, which is to build a peaceful and stable society, through equity, transparency and natural justice. The goal of the Penal Code does not include these. The Penal Code currently in use today is a law enacted in 30th September 1960 (a day before independence), an offshoot of the Penal Code of the colonial government. Its goal was to keep the general population under check and subservient to the central government. The Penal Code is so voluminous, it has 37 chapters and over 470 sections. Majority of the items of the Penal Code are ambigious, it is only be used to oppress the poor and helpless citizens. There are so many other stupid laws like the criminalisation of juju and criticizing the person of the President or the Governor of a State. Firstcitizen:I laugh in mandarin. This section of the the law is so ambitious its unenforceable. It can only be employed to witch hunt the poor, vulnerable and helpless. What dies "anyone who defames" means? Is this statement; Firstcitizen:Defamatory? What about this one?; Firstcitizen:If we compile all the defamatory published statements by firstcitizen on this site, he will face more than a century in jail. It's akin to the bigamy Law under Section 370 of the Penal Code I attached below. It is unenforceable. Dispute millions of Nigerians having second, third or even fourth wife, nobody has been jailed because of bigamy. The Penal Code was made during the colonial era to serve the interests of the colonialists, has become obsolete and irrelevant. If our legislature are actually interested in doing their jobs instead of pursuing constituency projects and allowances, they should have repealed and replace most of the Penal Code. In addition, I just learnt that the Penal Code only applies in Northern Nigeria, the law that applies in southern Nigeria is the criminal code. Both laws are said to be different.

Remember in a criminal case you have to prove beyond all reasonable doubt. |

In one breath you say Chioma Okoli's post on Facebook was so bad that it ruined the reputation of Erisco's tomato paste and the company, so she needs to be punished. In the same breath you now say more than 60% of Nigerians don't live their lives on social media hence many didn't know about case. So if Erisco feels that many Nigerians are not bothered with social media, why expend so much energy and capital pursuing a harmless Facebook post? You said Erisco has not suffered losses to the extent I elaborated, but the company itself contradicted your claims.

Killing is not an eight letter word. I learn Erisco instituted both criminal and civil case. Also chioma Okoli Haa instituted her own civil case against Erisco. Agadinaagwuofe:Yes, she has lost a lot as you pointed out,but what of Erisco himself and his company, how much have they lost. Can you quantify the loss in monetary terms. Even Erisco, his staff and family would suffer some psychological stress as a result of dragging by the public. The longer this case persists the worse for the image of his company and thus his sales. Remember he invested billions in the tomato product, which he is yet to recoup. |

She does not need to show anyone thar people have died consuming the product, she only needs to show that that she believes that the sugar in the product is capable of killing people. Please not the word believes (or in other words her opinion) The main plank of a crime in criminal law is intent. Did she start out intending to demarket the product? Erisco lawyers must present evidence that the lady deliberately wanted to harm Erisco tomato and the company. They have to present evidence that maybe she is an agent of a rival company, she has a grudge against the company or that she knowingly lied against the company in order to harm then. Where Erisco lawyers made the mistake is filing a criminal case. In a criminal case they would have to prove premeditation and malicious intent for her posts, and beyond all reasonable doubts. If it was a civil case, these conditions need not be met, all Erisco has to prove is that her posts caused grave damage to the company. This is why someone can be found liable for a crime but not criminally. Trump was liable for raping Eugene Carrol but not criminally guilty. Same with O J Simpson and his murdered wife. This case is a no brainer and instituted just to lock the lady up. |

Just Google the term "Samsung factory cause cancer", you will see tones of claimed just because one factory worker died of cancer. It hebooves on the responsible inspection agency to investigate the claims. No one went to Jail for these claims. I no go show mercy to anybody wey accuse me falsely or wan bring me down oh.Then you have no business getting hear public office. People insult governors and even the president all the time, does that warrant arrest and being locked up for months? Unless Erisco can prove that she had malicious intent , it would be impossible to prove a crime. Remember the threshold for a crime is extremely high, you have to prove premeditation and intent beyond all reasonable doubt. Why would the other 2 not run? Remember this is Nigeria where the rich and powerful control the justice system. They know they would be locked up indefinitely without trial. |
Vulcan24:Abuse of judiciary. Rich and powerful people using the courts (corrupt judges for that matter) to oppress ordinary masses. This should have been at worst a civil offence. When someone publishes false statement about a person or product, that is termed libel and its a civil offence. How it escalated into a criminal offence whereby someone was held in prison without bail for over 6 months is gross abuse of the judicial system. It can only happen in Nigeria. |

Because even if he did steal a phone, other fellow students would have stepped in from to prevent him from being brutalised and the school security would have been alerted. |

Is the proposed grazing route even constitutional? I had thought that the land use act and the 1999 constitution gives the ownerships of all land except a few km to the sea to the state governments. The state governments then lease the lands for a period of time, usually 99 years. So who will claim ownership of this grazing route? The federal government or the herdsmen? Nothing stops the northern governors from allocating a grazing route in their respective states, but can a law be imposed on governors to surrender lands for a proposed gracing route? |
