By Emma Amaize ASABA- FORMER Commissioner of Police, Delta State, Mr. Ikechukwu Aduba, roared from retirement, weekend, describing the recent release of 128 suspected Boko Haram members by the Chief of Army Staff as the “height of illegality.” Aduba told Vanguard, “This is a fundamental breach of the constitution. Under Internal Security Operations, police remain the foremost internal security agency; the suspects ought to have been handed over to the police.” He said, “After screening, the case file ought to be forwarded to the Director of Public Prosecution to determine their culpability before release. Usurpation of police function is sending a wrong signal.” His words, “Amputation of the Nigeria Police Force will not help, if the Federal Government of Nigeria feels the police is weak, then it should strengthen the police by overhauling, weeding and equipping them, including overseas training.” “The military is doing well but should be confined to their role under Internal Security Operations and rule of law. The world is now a global village, those released can sue the government for illegal detention,” he added. The Nigerian Army, last Wednesday, freed 128 suspected Boko Haram members arrested in different locations of Borno State. Kabul – An official said Sunday, a couple accused of adultery was stoned to death by armed militants in northern Afghanistan. “A couple was found guilty of adultery charges during a Taliban court hearing in Qalai Sorkh area of Sozma Qala district,” said Hamid Elmi, head of media relations department in the governor’s office in northern province of Sar-i-Pol. Elmi said that Sozma Qala was a volatile district of the Taliban controlled province, and that the government could not do anything to alter the situation. Taliban extremists practice public executions as part of their legal system in the districts where they have wrested control from the central government. Two weeks ago, a young boy and girl were publicly punished for adultery charges in central province of Ghor. The North is dragging the entire country backward... Nigeria is 55yrs old, the North has ruled for 41years and are still ruling. Yet they remain the poorest , the highest infant mortality rate, the lowest number of children in school, the highest number of unemployed young people and the challenge of insecurity and religious crisis including Boko Haram. Yet some olodos believe our messiah will come from the North. The problem of the North is their mentality. No matter how much money that is pump into the North, no matter how many political office they occupy , it won't change their backwardness . Common sense is not common in the north. |

I have heard this saying several times; "lawyers are liars" . This assertion is often spew by laymen who have little or no knowledge about the law and how it works. Such statement is fallacious in all ramification. If you understand how the law works , you would not make such statement. It's the duty of the court (lawyers) to interpret the law. And interpreting the law here simply means trying to read the mind of the law makers (legislative); to make sure the law solves exactly the problem it was created for , and not otherwise. The way a layman will interpret a piece of law is far different from the way a lawyer does that. A lawyer rationalize outed of emotion whereas a layman is often influence by emotion . This rationalization of a lawyer often appear unnecessarily strained, artificial and dishonest to a layman. To understand more , check out section 359 of the Nigeria Criminal Code and try within yourself to interpret it with the case below. "Any person who attempts to commit the offence of rape is guilty of a felony, and is liable for imprisonment for 14 years, with or without canning." Read the short story below to see how the practice of law works... 1. Mr. John a carpenter , occupies a room in a public (face me I face you) compound. 2. Miss Julia a young sprinter, occupies a room next to john's room. 3. One quite afternoon, john after taking his bath, was walking toward his room when julia's curtain incidentally was blown up by breeze and john sharply took a gaze inside her room. And behold, he saw julia lying naked on her bed sleeping. 4. This was a tempting sight for john, whom had on several occasions woo julia to be his girlfriend but was turned down. 5. John opened the curtain wider to get a clear view. After a while of unsatisfied sensual viewing , he stepped into the room (julia's room), 6. John took off the towel he was tying around his waist and walked stark naked toward the bed where julia was lying. 7. John bend toward julia with his hands already on the bed, at the moment, julia suddenly opened her eyes and behold john naked right in front of her. 8. Julia out of shock, gaped out a loud scream, which attracted other neighbours. 9. John was caught, beaten and taken to the police station where he begged and blame the devil for his act. 10. John was thereafter charged to court by the police for offence of "Attempt to commit rape". Looking at the about story, a layman (like the neighbours) would conclude that John was guilty and indefensible. In the court, John's lawyer presented his defence brief . And argue vehemently that John was innocent. That he never intended or attempted to rape julia. That what he did was only to walk into her room, untied his towel and approached julia, to wake her up and probably beg her gently to have sex with him. That before you will say that a person attempted to commit an offence, the accused must have manifests his intention to commit the act by some overt act. In the case at hand, it would have been an offence of "attempt to commit rape" only if there had be a struggle , at that state it will be clear to all that John intention was to rape julia and not to gentle ask her to have intercourse with him. He based his argument on Section 138(1) of the Evidence Act, which provides that: "If the commission of a crime by a party to any proceeding is directly in issue in any proceeding civil or criminal, it must be proved beyond reasonable doubt". The lawyer concluded his argument by stated that the prosecution had not in anyway prove their case beyond reasonable doubt that John intended or attempted to rape julia. And that the case was simply that of "mistake of intent" and should have never be brought to court in the first place. At the end of the trial, John was declared innocent and the case was discharged. From the above , you can see how the law works. To a layman (neighbours), the terrified scream of julia, the present of john in her room naked and the plead of john that it was the devil that push him to the act was enough evidence to convict him, but to a lawyer that's not enough. The practice of law necessitates a special technique of reasoning ( critical thinking) which is virtually necessary to the effective handling of legal issue. Lawyers are compelled to reconcile incompatibles. Their everyday task is expert practical adjustment. Their life work is based on logic of probability. Realistic recognition of novel circumstances, tentativeness, adaptation, are of the very essence of the lawyer's invaluable technique. They are professional rationalizers. |

It is wrong to associate the agitation for state of biafra with war. For all I see, Biafran agitators are never asking for war, all they are asking for is freedom. Their agitation is not illegal, it is boldly enshrined under United Nations Declaration on the Rights of Indigenous Peoples which was adopted by the United Nations General Assembly during its 61st session at UN Headquarters in New York City on 13 September 2007, Which Nigeria happened to be a signatory to. The Charter clearly states that indigenous people reserve the right to agitate for their freedom without fear of intimidation. Agitation for freedom does not in anyway signifies calling for senseless war. War can only come when the oppressors tries to militarily suppress the lawful agitation, and that is what the United Nation charter stands to prevent. The 1966 Nigeria declaration of war on the new born biafra state can be justified because as at that time, the UN declaration for the right of indigenous people was not yet in existence. Then, it's was a fight of survival of the fittest. The United Nation was not legally bound to protect any indigenous people seeking for their freedom. Now, the United Nation under the 2007 declaration is under obligation to defend any indigenous people peacefully agitating for their freedom against any intimidation from their oppressors. So any attempt to militarily intimidate or suppress the biafran agitation will be tantamount to a collision between the Nigerian State on one side, and the United Nation and the Indigenous People of Biafra on the other side. You should know that the United Nation had already been notified of the agitation and they are only watching to see how serious the course of the agitation is before they can intervene. For those accusing Nnamdi kanu of instigating violence; Nnamdi kanu might be raining hate speech on radio, but he had never incite killing of any tribe in his hometown. He had never attacked any mosque. Their are many hausas and yorubas in the SE SS, and none had ever been attacked. Am hausa man freely sell suya opposite one of their meeting venue. He had at many times warned his followers never to physically attack or cause injury to any person of another tribe. He is only exercising his right to freedom of expression. Tell me what do you expect him to do, hug and smile with his acclaim oppressors? He is only trying to pass a simple information, which is : " i know you all hate me for leading biafra agitation; but I don't care ; I hate you all too". Nigeria should trade carefully... 1966 isn't 2015. The international world has changed a lot. Nigeria might have silent enemies within and outside africa, who can't wait to see the boastful giant of Africa crumble to the ground. The world is now watching with 4G... Biafra agitators should also trade carefully . They should study and learn from other country who had gotten their freedom on ground of the United Nation Charter for the right of indigenous people. Carry the world along in whatever you do. Keep your agitation peaceful , avoid any senseless physical violence on other innocent individual tribes. |

In britain and America during the slave trade era, it became an insulting word used by the whites to address african slaves . Slave trade had been on in the southern Nigeria even b4 british colonization. Up till today, it's an insult for a white american to call a black america a nigger , becus it's just like calling him a black slave. The use of the word had been abolish and replaced with the name African America |
