The Federal High Court sitting in Lagos has awarded the sum of N5 million against the 2019 Presidential Candidate of the Peoples Democratic Party, Alhaji Atiku Abubakar, and his campaign director, Dr Bukola Saraki, over unauthorized use of the photograph of a Lagos-based trader, Mrs Amuda Adeleke, on their campaign billboard.

Justice Ayokunle Faji, who made the monetary award in a judgment delivered on Monday, said the N5m would be jointly and severally paid by Atiku, Saraki, the PDP and Peter Obi, who was Atiku’s running mate during the election.

In a fundamental rights enforcement suit brought before the court, Adeleke through her lawyer, Kingsley Iheakaram, said the defendants used her photograph on their campaign billboard without seeking her consent.

Adeleke also explained that in December 2018, during the build-up to the 2019 general elections, agents of the Atiku Abubakar Organisation, led by Saraki, came to Oyin Jolayemi Street, Victoria Island, Lagos to campaign and mobilize support for Atiku and his running mate, Obi.

She said Saraki and his team engaged people on the street, including herself.
Adeleke said she saw members of the campaign train taking photographs during the engagement with the crowd and she thought it was merely to preserve the memory of the event.

She was, however, shocked when she began to receive phone calls from those who knew her, calling her attention to her photograph on the PDP campaign billboards in Lagos, Abuja and elsewhere.

“All my friends who saw the campaign billboard said it portrayed me as a woman stricken with poverty who had lost all hope and was prepared to commit suicide,” she said.

The trader said the unauthorised use of her photograph for the PDP presidential campaign caused her embarrassment.

She, therefore, asked the court to award N45m against the defendants for infringing on her fundamental right to privacy as enshrined, in the 1999 Constitution.

Justice Faji gave judgment in her favour and subsequently awarded N5 million only against the defendants.

KANO, Nigeria, April 26 (Reuters) - A sharp rise in deaths in the Nigerian city of Kano was caused by complications from other health conditions and not the new coronavirus, the state government said on Sunday, citing a preliminary assessment, after a local newspaper reported what it called “mysterious” recent deaths.

The Daily Trust newspaper reported on Tuesday the recent deaths of around 150 people in the northern commercial city of Kano, prompting investigations to determine if they were related to the coronavirus pandemic.

The state government acknowledged the deaths but said they were caused by complications from hypertension, diabetes, meningitis and acute malaria and not the COVID-19 pandemic.

“The state government is concerned over what is happening. The ministry of health is already handling the situation. When they are through with the medical investigation, further necessary actions will be taken,” a Kano spokesman said in a statement.

Kano state has become the epicenter of the pandemic in northern Nigeria, with 77 confirmed coronavirus cases and one death. Nigeria has 1,182 cases and a national death toll of 35.

Governor Abdullahi Umar Ganduje has directed Kano’s ministry of health to investigate the “immediate and remote” causes of death, the statement said.

Another local paper reported on Sunday that Kano had shut down private hospitals and diagnostic centers over the high mortality rate, adding most private facilities were not equipped to treat the coronavirus.

A week-long lockdown in Kano, which was extended last week, has limited people’s access to clinics for other ailments, while the state’s coronavirus testing lab was closed after staff became infected with the virus, health officials have said.

Neighbouring Kaduna state said it would extend a quarantine order by another month after the number of cases rose in Kano and Abuja, and banned interstate travel, which it said was a major means of spreading the virus. Donald Trump is warning “China will own the United States” if Joe Biden is elected president.

But Trump himself has taken on debt from China. In 2012, his real estate partner refinanced one of Trump’s most prized New York buildings for almost $1 billion. The debt included $211 million from the state-owned Bank of China — its first loan of this kind in the U.S. — which matures in the middle of what could be Trump’s second term.

Steps from Trump Tower in Manhattan, the 43-story 1290 Avenue of the Americas skyscraper spans an entire city block. Trump owns a 30 percent stake in the property valued at more than $1 billion, making it one of the priciest addresses in his portfolio, according to his financial disclosures.

Trump’s ownership of the building received a smattering of attention before and after his 2016 campaign. But the arrangement with the Bank of China in 2012 has gone largely unnoticed. The questions surrounding Trump’s ties to the Bank of China come as his campaign is claiming that Biden would be a gift to the Communist country and America’s chief economic rival.

After the first version of this article was published, the Bank of China issued a statement Friday evening stating that it sold its debt on the building weeks after the 2012 loan on the property. Vornado Realty Trust owns 70 percent of the building.

“On November 7, 2012 several financial institutions including the Bank of China participated in a commercial mortgage loan of $950 million to Vornado Realty Trust,” said Peter Reisman, managing director and chief communications officer of Bank of China U.S.A. “Within 22 days, the loan was securitized and sold into the [commercial mortgage-backed securities] market, as is a common practice in the industry. Bank of China has not had any ownership interest in that loan since late November 2012.”

Another public document, however, lists Bank of China as a creditor on 1290 Avenue of the Americas even after the bank said it was no longer involved in the property. Filed in 2017 with the New York City Department of Finance Office of the Register, it lists the Bank of China as a secured party having a financial interest in the building’s fixtures.

The Bank of China could not explain why its name was listed on the 2017 document, describing it as “technical error.” Trepp, a database of securitized mortgages, also listed the Bank of China along with the three other banks, in a description on their site about the financing of the building. The site noted the Bank of China might securitize their portion of the loan, although there were no additional comments.

The bank pointed to another document filed in 2012 in New York City that showed the mortgage on the property had been assigned to a new financial institution as a trustee for the debt, listing Bank of China as an “assignor/old lender.” But it declined to share additional documentation on the loan.

Vornado Realty Trust, the primary investor in the building, did not reply to a request for comment, and the White House and Trump Organization declined to comment for this story.

The 1290 Avenue of the Americas deal was reported previously by several news outlets, including The New York Times in stories about the “maze” of Trump’s finances and a history of how he came to partly own the building.

The bank’s initial financing of the property stands out because Trump and his campaign have repeatedly highlighted the same bank's role in a $1.5 billion deal announced in 2013 by partners of Joe Biden’s son, Hunter Biden. Critics of the Bidens have seized on the fact that the agreement materialized just days after Hunter Biden traveled to China with the then-vice president, who was there on official business.

“Why did the Chinese government's bank want to do business with Hunter Biden while his dad was Vice President,” Trump’s campaign asked on Twitter earlier this month. The issue was also raised in a campaign ad the day before, one in a stream of criticisms about the China deal raised by campaign spokespeople and Trump since last year.

The Trump campaign has steadily increased its focus on trying to portray Biden as weak on China amid rising voter disapproval of China, the source of the coronavirus pandemic. Trump surrogate Corey Lewandowski dubbed him “Beijing Biden” in an online campaign event Wednesday. And during a White House news briefing Saturday, Trump said China will “own” the U.S. if Biden wins.

But Trump’s recent criticisms of China have been muddied by his own mixed messaging as well as by his numerous financial ties to the country. Those connections extend far beyond the Avenue of the Americas loan: Chinese state-owned companies are constructing two luxury Trump developments in United Arab Emirates and Indonesia. The president and his daughter Ivanka Trump, a White House adviser, have been awarded trademarks by China’s government. And his son-in-law, Jared Kushner, has courted Chinese investors in at least one other real estate deal.

“We actually explored all these foreign enterprises and how once he became president he’d be seen differently by foreign leaders who would have leverage over this president because he had investments in their countries and/or financial dealings with business enterprises and financial institutions and investors in their countries,” said Rep. Gerry Connolly (D-Va.), a member of the House Oversight Committee. “He is highly conflicted with respect to China.”

Trump has denied he has any conflicts. But he rejected calls to fully separate from his namesake company, which comprises more than 500 businesses and includes properties in nearly two dozen countries, after he was sworn into office. He still owns his business, though he asked his adult sons to run it. His holdings were placed in a trust designed to hold assets for his benefit from which he can draw money at any time without public knowledge.

The building at 1290 Avenue of the Americas is a particular point of pride for Trump, who mentioned it when he announced his candidacy in 2015.

“I beat China all the time,” Trump said during a speech at the time from Trump Tower, adding, “I own a big chunk of the Bank of America building [in San Francisco] and 1290 Avenue of the Americas that I got from China in a war. Very valuable. I love China.”

Trump continues to own that share of both properties, which are touted under the real estate portfolio section of the Trump Organization's website. He is considered a passive investor who doesn’t control the financing or management of 1290 Avenue of the Americas.

The debt stems from a $950 million refinancing deal in 2012, to which the Bank of China chipped in $211 million. With the loan, Bank of China became the first in the nation to enter the U.S. securitization market, according to a 2013 Wall Street Journal article. Vornado's federal financial disclosures show it and the other owner of 1290 Avenue of the Americas — Trump — are still indebted from the 2012 deal.

“While Trump is talking about the former vice president’s son's financial dealings, in Trump’s case, it is the president himself who has a company he still owns and profits from that has financial relationships with the countries that he is supposed to be negotiating with on behalf of the American people,” said Robert Maguire, research director for Citizens for Responsibility and Ethics in Washington.

“There are definitely legitimate questions that are raised by Hunter Biden’s actions,” Maguire said. “They are not even in the same ballpark as the conflict of interest questions raised by President Trump’s continued relationship with his own company.”

The Trump campaign said there is no comparison between Trump’s debt and Biden’s deals.

“There is an obvious difference between Donald Trump working as a successful businessman as a private citizen and Hunter Biden using his name to cash in with a $1.5 billion investment from a state-controlled Chinese bank while his father was vice president,” said Tim Murtaugh, a campaign spokesman.

George Mesires, a lawyer for Hunter Biden, disputes the account of the Trump campaign and conservative critics. He said the private equity deal linked to Hunter Biden’s business partners, called Bohai Harvest RST, was initially capitalized by a group of investors in China. Some had financial links to the bank. And Mesires said they initially invested $4.2 million —not the $1.5 billion that the firm initially boasted was a goal of the deal in a news release.

During the trip to China on Dec. 4, 2013, with his father, Hunter Biden went along to chaperone his own daughter, who was accompanying her grandfather, then vice president, Mesires said. He said Hunter Biden did not conduct business in China but did meet socially during the trip with the Chinese businessman who would become CEO of Bohai Harvest RST, the registration documents for which were submitted to Chinese authorities a month before the Bidens’ China trip.

Hunter Biden was not listed on the company’s documents because he didn’t put the deal together and did not acquire a direct financial stake until October 2017, when he acquired a 10 percent interest after committing $420,000, Mesires said. Hunter Biden announced he was resigning from BHR last year.

Hunter Biden’s involvement in the deal came despite his lack of experience in doing business in China. Similarly, Hunter Biden had no experience in Ukraine or in natural gas, but scored a lucrative gig for an energy company in that country, in which his dad also had business.

“I don't think that there's a lot of things that would have happened in my life if my last name wasn't Biden,” Hunter Biden said in an ABC interview in October in which he reiterated his father’s longstanding denials that Joe Biden had any involvement in his business affairs.

Trump’s criticism of the Ukraine deal led to his impeachment for trying to leverage U.S. aid to Ukraine in return for it opening an investigation into Biden and his son.

"Donald Trump was so desperate not to face the vice president that he got himself impeached," said Biden campaign spokesman Andrew Bates, who declined to comment on Trump's China-focused attacks, but criticized his handling of the coronavirus that emanated in China.

Biden backers have complained that the information about the China trip and Ukraine matter were overhyped by Republican researcher Peter Schweizer in his 2019 book, “Secret Empires: How the American Political Class Hides Corruption and Enriches Family and Friends.” Democrats point out that Schweizer runs a nonprofit that has been funded by a top Trump donor and they say that “Secret Empires” is a replay of his 2015 “Clinton Cash,” a book that fact checkers took some issue with as it was embraced by Trump in an effort to paint Hillary Clinton as corrupt.

Still, Biden’s Democratic opponents in the early days of the crowded primary shopped opposition research about Hunter Biden’s foreign entanglements. They said it was a liability that needed to be litigated before the general election because Trump was sure to use it to “muddy the waters” and draw an equivalence between the families’ foreign dealings.

Charlie Kirk, a Trump ally and head of the Turning Point USA conservative group, said the Trump “campaign is right to highlight what amounts to a major distinction in the two candidates. The president has been tougher on China than any politician in decades, reversing a wrongheaded strategy of China appeasement that Joe Biden helped lead and prolong, and from which his own son likely benefited.”

Trump Organization, Written Out of U.S. Bailout, Taps Europe Aid

(Bloomberg) -- The Trump Organization is seeking U.K. and Irish bailout money to help cover wages for bartenders, bagpipers and other employees furloughed from its European golf properties because of the coronavirus lockdown.

Overseas businesses owned by U.S. President Donald Trump can tap government funds meant to help retain workers. In the U.S., by contrast, they’re specifically written out of the enormous U.S. economic relief package. The result is a potentially stark gap between how workers in different countries may weather the crisis, even within the same global operation.

In the U.K. and Ireland, where Trump owns three money-losing golf resorts, companies can tap enough government cash to pay most of their workers’ salaries. It’s unclear whether the Trump Organization is paying the balance of the salaries for furloughed workers.

In the U.S., roughly 2,000 employees dismissed from Trump golf courses and hotels will have to line up with millions of others to apply for unemployment payments.

There’s nothing improper about Trump companies seeking the U.K. and Irish funds, which are offered universally to help workers weather the crisis. Even so, social-media blowback has been swift against deep-pocketed owners who could arguably weather the crisis without seeking state handouts. These include Victoria Beckham, the former Spice Girl who reportedly furloughed as many as 30 employees at her money-losing luxury fashion label.

Martin Ford, an elected official in Aberdeenshire, Scotland, where one of the resorts is located, said that a similar standard should be applied to Trump, who’s boasted of his billions.

“The huge tab for this will be borne throughout the whole population through higher taxes,” said Ford, a longtime critic of the Trump resort. “If what he says about his personal wealth is true, Trump doesn’t need the money, and I don’t see why U.K. taxpayers of the future should be helping him out.”

Alan Garten, the Trump Organization’s chief lawyer, didn’t respond to requests for comment. Managers at two of the sites said they had taken measures offered by the government to protect their employees.

Although the Trump family business was explicitly prohibited from benefiting from federal aid authorized in the last few weeks by Congress, its hotel in Washington is seeking separate relief on $3 million of annual rent that it pays to the U.S. General Services Administration for use of a government-owned former post office, the New York Times reported on Tuesday.

Trump’s three resorts in Scotland and Ireland were just gearing up for the golf season before governments ordered businesses to close last month to prevent the spread of the coronavirus. Now they’re among the tens of thousands of companies seeking to tap state relief programs. Companies in the U.K. and Ireland can claim the funds to cover furloughed employees as long as they’ve been paying payroll taxes.

“We’ve laid off the vast majority of our staff,” Joe Russell, the managing director of Trump’s Doonbeg resort on Ireland’s west coast, said in an interview. He declined to say how many had been let go or furloughed under the government’s wage subsidy program. “We are ensuring they’re looked after in terms of the government schemes that are available,” he said.

The Irish wage subsidy program, which has been up and running for several weeks, pays companies to cover 70% of furloughed staff’s weekly take-home pay, subject to a cap, as long as they’re kept on the payroll. For the lowest earners, the government will cover as much as 85% starting next month. A separate Irish program allows individuals who’ve lost work because of the pandemic to claim a weekly payment.

The U.K. formally launched a similar program on Monday to cover 80% of workers’ salaries capped at 2,500 pounds ($3,100), receiving applications from more than 140,000 companies on the first day.

Companies in both countries must apply for the funds on behalf of their employees and are encouraged to make up the difference so workers can get their full salaries.

Russell, the manager at Trump Doonbeg, declined to say whether the resort was topping off the government-funded wages. He said that staff numbers vary according to the season but that during peak times the resort employs about 300 people.

The resort was due to open at the end of March, leaving those scheduled to start in limbo until the government stepped in with additional direct payments to support workers nationally affected by the lockdown, said Rita McInerney, a local business owner who lives nearby.

McInerney said the resort has about 90 year-round employees, some of whom are continuing to work as part of a skeletal maintenance staff. She said she’d heard from locals that the rest who’ve been let go are using the government wage subsidy program.

“If by availing itself of government subsidies it keeps the business employing people here, then of course they should use it,” McInerney said. “The Trump Organization have been very good to local community.”

Trump Turnberry in Scotland is applying to tap the U.K. bailout funds for employees, according to Peter Henderson, a local elected official who lives near the resort and has spoken to workers there.

Like any company, he said, the resort should take advantage of the relief program. “There’s no one playing the course. They followed the rules and closed up shop,” he said.

Ralph Porciani, Turnberry’s manager, didn’t respond to questions for comment.

“Like millions of businesses around the globe, we have been forced by government mandate to temporarily close our hospitality and leisure facilities,” said Sarah Malone, executive vice president of the Trump resort in Aberdeenshire. “We are no different to any other business, including many media companies -- this has nothing to do with Trump and does not benefit the business -- the actions we have taken are solely to protect people and their families who would otherwise be out of work and struggling to survive financially.”

She declined to comment on the resort’s use of government funds to cover wages.

Trump has invested several million dollars over the past decade to buy and revamp the three resorts in Scotland and Ireland, which have continued to lose money, according to their government disclosures. It’s unclear whether Trump has financed the resorts through bank loans or the Trump Organization’s cash flow.

His Aberdeen resort lost more than 1 million pounds in 2018, the last year for which results are available. Trump has provided more than 40 million pounds of interest-free loans to the resort, which has never posted a profit, and employed 77 people, according to 2018 filings. He won approval last year for a 150-million-pound plan to expand the resort by building vacation homes.

Trump’s Doonbeg resort in Ireland, which he bought in 2014, lost 1.5 million euros ($1.6 million), in 2018, but revenue increased by 7% to 11.4 million euros, according to filings. His flagship Turnberry resort lost 10.8 million pounds in 2018, the disclosures show. In total, Trump has lent 115 million pounds to Turnberry since he bought the resort in 2014.

Traffickers now use fictitious advertisements online for jobs in international airlines, airports, hotels, public transportations and domestic work to lure people.

On April 2, the International Organisation for Migration rescued 256 persons in the arid northern Niger.

The trafficked persons were abandoned by their traffickers close to the Niger-Libya border, dehydrated and desperately in need of food. A baby was among those rescued, IOM’s Chief of Mission in Niger, Barbara Rijks, said.

All the rescued persons were transported from Dirkou to Agadez, where they were placed in coronavirus quarantine.

Among them were 104 Nigerians, who were Europe-bound despite their intended destination being caught up in the throes of the coronavirus pandemic.

Currently, there are about 2,371 people – mostly Nigerians, Guineans, Cameroonians and Malians – camped in six IOM transit centres in Niger.

A spokesperson for IOM in Nigeria said the UN agency was already in talks on how to facilitate their return to their home countries.

“Niger has accepted to open a corridor and now we are discussing with the countries of origin of all the almost 10,000 stranded migrants so they can open one as well,” Jorge Galindo, as a spokesperson for IOM Mission in Nigeria, told The Guardian on Thursday.

Coronavirus not a problem for traffickers
Rijks said the 250 migrants rescued early in April were abandoned by the traffickers because of restrictions on movement in war-torn Libya due to coronavirus.

The country, however, announced a 10-day lockdown on April 16. Niger, where they were abandoned, has closed its borders due to the pandemic. The World Health Organisation said 657 cases of the virus have been confirmed in the country and 20 fatalities recorded as of April 22.

But despite the border closure, curfews, travel bans and other forms of restriction in place in Niger, traffickers still find a way to smuggle migrants in.

“While the borders are officially closed, we still see migrants arriving in Niger from neighbouring countries that need to complete 14 days of mandatory quarantine,” said Rijks. “This, together with the many other migrants stuck in IOM’s transit centres in Niger, is putting an enormous strain on the limited resources and capacities of the Government of Niger and IOM.”

IOM said it may be difficult to house all the 2731 migrants at the transit centres for long amid worries about the impact it will have on local communities and the migrants themselves.

IOM said it was working with the Nigerien Government and diplomatic missions of the countries of origin of the migrants on the creation of humanitarian corridors so that migrants who have completed the isolation and did not test positive for coronavirus can return home.

Galindo said he was not aware of any feedback from relevant Nigerian agencies – such as the National Emergency Management Agency, Nigerian Immigration Service and the National Commission for Refugees, Migrants and Internally Displaced Persons – that IOM usually interfaces with in such situations.

But the director-general of National Agency for the Prohibition of Trafficking in Persons Dame Julie Okah-Donli told The Guardian that the ministries of Foreign Affairs, Humanitarian Affairs, Health, NAPTIP, NEMA and NCFRMI are working with IOM to bring the Nigerians back.

She said an air corridor is being considered for their return of the lockdown.

“we’ve asked for further disaggregated information on these migrants from the Nigerien authorities,” she said.

Okah-Donli said there are also Nigerians in Mali and “a few other places” that are also being considered.

“One major consideration is that we have to have isolation facilities to accommodate more than 200 persons,” Okah-Donli said.

Changing the mode of recruitment
In a video posted to her Twitter handle on Thursday, Okah-Donli acknowledged that the pandemic has only made human traffickers change means of reaching their victims.

She said traffickers now use fictitious advertisements online for jobs in international airlines, airports, hotels, public transportations and domestic work to lure people.

On Thursday, her agency helped arrest a Lebanese resident who advertised the sale of a Nigerian domestic worker on Facebook.

“Human traffickers have online to ply their ugly trade because of the lockdown occasioned by the COVID-19 pandemic,” Okah-Donli said in the video.
