Reps Move To Criminalise Late, Non-payment Of Salaries by Pergrace: 12:26pm On Mar 06, 2013
A new bill before the House of Representatives has proposed stiff penalties for employers of labour in both the public and private sectors who fail to pay or delay the payment of workers’ salaries.

The bill passed second reading on Tuesday, getting the support of the majority of lawmakers at a session presided over by the Speaker, Mr. Aminu Tambuwal.

It also proposes that underpayment of workers’ wages; pension and emolument will attract sanctions.

According to the sponsor of the bill and House Minority Leader, Mr. Femi Gbajabiamila, the penalties will include the loss of 10 to 20 per cent of the value of the delayed salary.

He explained that after a salary delay of one week, the employer would begin to lose percentages of the salary, which would be added to the employee’s pay.

Gbajabiamila said, “Late payment or no payment of salary encourages corruption. People are forced to seek unlawful means to meet their financial and family obligations. It is our responsibility as legislators to protect the welfare of the citizenry. There is no point saying you have a job, yet no pay.

“This bill prescribes a period, beginning from seven days; the employer will pay a percentage in addition to the salary. From 10 per cent, it can rise to 20 per cent, and so on.”

Another member, Mr. Jerry Manwe, blamed the problem of non-payment of salaries on employers’ greed.

He said a practice common in some government agencies was to lodge workers’ salaries in fixed deposit accounts to yield interests for “some greedy officials, who keep telling the suffering workers that there is no money.”

Also backing the bill, Mr. Godfrey Gaiya, observed that employment was a contract between the employer and the employee.

“A labourer deserves his wage,” he said.

An attempt by the House Deputy Majority Leader, Mr. Leo Ogor, to oppose the bill, however, failed.

Ogor claimed that criminalising salary delays or non-payment of salaries could lead to “more problems that the bill intends to solve.”

He argued that some delays could be caused by “cash-flow challenges and not that the employer does not want to pay.”

But, his position on the bill was defeated by a majority voice vote endorsing it

How could that be a valid and what would make a cash flow be a problem to the extent that salaries of those really working and making the company money wont be paid . . .
If the company is not making money, raise money somehow

In case of litigation arising therefrom, a thorough investigative scrutiny needs to be conducted to ascertain the actual cause of action before sanctions can be admoinistered because there are a lot of uncontrollable factors surrounding business administration and management as it relates to maximisation of profits. For instance, a company that doesn't break even cannot pay even if the employer wants to pay...

Very valid arguement.

Any employer of Labour knows that atimes, cashflow challenges affect the payment of salaries. And with the insane interest rates in our banks, borrowing to pay off these salaries will only end up being penny wise, pound foolish for the employer.

I really believe that should this bill sail through as raw as it is, then there will be a lot of problems in the labour market. Folks will lose their jobs faster than they can imagine.

Even in the Public sector, example the Local Governments that atimes dont receive their allocation on time, how are they expected to pay their salaries?!

Before passing laws, these legislators need to make sure that they do their assignments properly. Ogor is very right and his opposition shouldnt be summarily over-looked.

I hope this will surely be approve,I work in a gov't agency,we've not receive pay snce december,though dey've strted payng ,guess wat?dey paid only january,nothng has bn told abt our december salary.God help us

When will this Lawmakers see things in the eye of the entrepreneur? Must everybody be a Civil Servant? Worst still Government itself is underperforming. May be they are looking for something to nail GEJ finally lipsrsealed

the must be something fishy here that this house members are trying to achieve, cos i dnt no when the plight of nigerians suddenly began to get sentiments and concerns from them...probably the r looking at it frm their own point of view, for prompt payment of the salaries and allowances cos i remember they were complaining one certain time abt non payment of ur entitlements. they always stand to gain frm every bill initiated, greedy, selfish people.

Nonsense, who wil sanction GEJ 4 late payment of FG workers. House of Reps beta go find work 2 do. Even in US, there is delayd payment

abeg if (once) it is implemented, will it affect previous salaries been owed because the company i worked for did not pay for six months

Our problem in nigeria is d lack of education. If d law was passed, it won't mean some organizations can't owe, even legally tru by-laws. All they got to do is create a clause in their appointment letter and they can owe up to a month!!

They also need to do a law to protect business people, so when clients, who include government are not paying on time should be penalised.

And when that happens, they will find a way to plug such holes . . . However, a coy owing up to a month is nothing, had a friend that works with AIT that was being owed up to 6 months and yet they expect such person to be at his duty post on a daily basis, how do they expect him to get to work, collect money from Mom and Dad or his wife? It is high time something be done. . . .

a company that can not meet its obligations(working capital and administrative expensis inclusive) as they fall due have no business been in existence. Remember that most of this companies do not recognize excess profit in their books and as such, employees are not given anything in such situations. why should such employees not get paid at the very last day of the month when they dont receive extra benefit if things are rosy
