The Court of Appeal on Tuesday affirmed the inalienable right of Nigerians and asscociations to hold rallies without police permit. The court upheld the judgment of a Federal High Court which had, in June 2005, declared the Public Order Act, (Cap 382) Laws of the Federation of Nigeria, 1990, which requires Nigerians to obtain police permit before holding public rallies.

The Act makes it mandatory for individuals or groups to apply for and obtain police permit or approval to hold rallies and peaceful assemblies.

In its judgment, the appellate court, presided over by Justice Danladi Mohammad, held that such police approval infringed on the fundamental human rights of individuals and groups provided for in the 1999 Constitution.
“The provision of the Act are unnecessary. We are in a democracy and Nigeria has joined the league of civilised society,‘‘ Justice Olufunmilayo Adekeye, who read the lead judgment said.

The other member of the panel who gave a concurring judgment was Justice O.F. Omoleye.The panel gave the judgment in an appeal by the Federal Government against the decision of the Federal High Court, Abuja.
The high court had, on June 26, 2005, voided the Act while giving judgment in a suit initiated by 12 political parties under the aegis of the Conference of All Nigerian Political Parties.
Justice Anwuri Chikere also issued an order of perpetual injunction restraining the Inspector-General of Police from preventing aggrieved citizens of Nigeria, including the plaintiffs from organising or convening peaceful assemblies, meetings and rallies against unpopular government policies.
According to her, the court held that the provisions of the Public Order Act (Cap382) Laws of the Federation of Nigeria (1990) were in conflict with the provision of Section 40 of the 1999 Constitution.
The CNPP had, on April 2, 2004, written to the Federal Capital Territory Police Commissioner, Mr. Emmanuel Adebayo, for a permit, in line with the provisions of the Public Order Act, (Cap 382) Laws of the Federation of Nigeria, 1990 which requires the issuance of police permit to any group wishing to embark on a rally.
They wrote the letter following a proposed mass rally by the parties in protest against the 2003 general elections.
Section 1 of the Act makes it mandatory for a police permit to be procured before embarking on a rally,After the controversial Kano rally, which was linked, (but not proved) to the death of the former Senate President, Dr. Chuba Okadigbo, the CNPP filed a suit at a Federal High Court in Abuja challenging the constitutionality of the Act.

8The parties, through their lawyer, Mr Femi Falana, filed the suit on February 9, 2004 at the Federal High Court, Abuja, asking the court to restrain the FG from preventing their members and any aggrieved citizens from holding rallies in any part of Nigeria.

They asked the court to declare that the requirement of police permit for the holding of rallies was illegal and unconstitutional.
The parties posed the following questions for the court to answer:Whether police permit or any authority was required for holding rally or procession in any part of the Federal Republic.
Secondly, the parties wanted to know whether the provisions of the Public Order Act which prohibit the holding of rallies or processions without a police permit are not illegal and unconstitutional by virtue of Article 11 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act (Cap 10) Laws of the Federation of Nigeria of Nigeria, 1990.

The parties then urged the court to declare that the provisions of the Act which require police permit or any other authority for the holding of rallies or processions in any part of Nigeria, were illegal and unconstitutional. The court said they contravene section 40 of the 1999 Constitution and Article 7 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement Act.)They sought a declaration that the Inspector-General of Police was not competent under the Public Order Act or under any law whatsoever, to issue or grant permit for the holding of rallies in any part of Nigeria.The writ of summons was taken out on behalf of the parties by Falana.In the affidavit attached to the writ, which was sworn to by Maxi Okwu, the General Secretary of the COPP, the parties stated that the IGP prevented them from staging a peaceful rally on May 29, 2003.He averred that the solidarity rally organised by the All Nigeria Peoples Party in Kano, Kano State, on September 22, 2003, was disrupted by the Police on the grounds that no police permit was obtained.“That in the course of disrupting the rally the police tear gassed the crowd and the ANPP leaders, including, Dr. Chuba Okadigbo who died barely 24 hours later,” Okwu said.Government, in defending the suit, filed no counter-affidavit, as its representatives came to court asking that the entire suit be dismissed.

The high court judge had refused and heard the matter.
She not only answered the two fundamental questions in favour of the political parties, she also granted all the prayers they sought.

The plaintiff political parties in the case included; ANPP, National Conscience Party, Peoples Redemption Party, National Democratic Party, Democratic Alternative, APGA, PAC, Peoples Salvation Party, United Nigeria Peoples Party, MDJ and Community Party of Nigeria.[/quote]

The Governor "MAY" delegate his powers under the Act to the Commissioner of Police of the state or any superior police officer of a rank not below that of a Chief Superintendent of Police as applicable.

Call a spade a spade. Constitutionally, he (Mbu) is to be getting orders from both abuja and Governor of the state ( been the state chief security officer). And where this conflict ( like what we are having in Rivers state now). The CP is required to be someone with the right mindset and intellectual capability to resolve conflict putting before any other consideration, the constitution which guarantees freedom and fairplay.

1) For the purposes of the proper and peaceful conduct of public assemblies, meetings and processions and subject to section 11 of this Act, the Governor of each State is hereby empowered to direct the conduct of all assemblies, meetings and processions on the public roads or places of public resort in the State and prescribe the route by which and the times at which any procession may pass.

(2) Any person who is desirous of convening or collecting any assembly or meeting or of forming any procession in any public road or place of public resort shall, unless such assembly, meeting or procession is permitted by a general licence granted under subsection (3) of this section, first make application for a licence to the Governor not less than 48 hours thereto, and if such Governor is satisfied that the assembly, meeting or procession is not likely to cause a breach of the peace, shall direct any superior police officer to issue a licence, [/b]not less than 24 hours thereto, specifying the name of the licensee and defining the conditions on which the assembly, meeting or procession is permitted to take place; and if he is not so satisfied, he shall convey his refusal in like manner to the applicant within the time herein before stipulated.

3) The Governor may authorise the issue of general licences by any superior police officer mentioned in subsection (4) below setting out the conditions under which and by whom and the place where any particular kind or description of assembly, meeting or procession may be convened, collected or formed.


4) The Governor may delegate his powers under this section-
(a) in relation to the whole State or part thereof, to the Commissioner of Police of the State or any superior police officer of a rank not below that of a Chief Superintendent of Police; and

(b) in relation to any local government area or part thereof, but subject to any delegation made under paragraph (a) above, to any superior police officer or any police officer for the time being acting as the District Police Officer,

and references in this section to the Governor shall be construed accordingly





The police is even empowered to stop any gathering found to deviate from the conditions set in the permit.



In this instance, the gathering of the 13,000 people had no form of permit whatsoever.




6) The decision of the Governor under subsection (5) of this section shall be final and no further appeal shall lie therefrom.

2. [b] police officer of the rank of inspector or above may stop any assembly, meeting or procession for which no licence has been issued or which violates any conditions of the licence issued under section 1 of this Act, and may order any such assembly, meeting or procession which has been prohibited or which violates any such conditions as aforesaid to disperse immediately.

3. Any assembly, meeting or procession which-
(a) takes place without a licence issued under section 1 of this Act; or
(b) violates any condition of any licence granted under section 1 as aforementioned; or
(c) neglects to obey any order given under section 2 of this Act,

shall be deemed to be an unlawful assembly, and all persons taking part in such assembly, meeting or procession, and in the case of an assembly, meeting or procession for which no licence has been issued, all persons taking part in the convening, collecting or directing of the assembly, meeting or procession, shall be guilty of an offence and liable on conviction to a fine of N1,000 or imprisonment for 6 months or to both such fine and imprisonment[/b].

Your post only validates my point, and that is, the ultimate powers for the issuance of permit reside with the Governor of a State. Nothing in the Act suggests that the Police is expressly given the powers to issue a permit without the Governor's consent, in fact, the Police cannot approve the application for a permit on its own.

*The Governor 'MAY' authorize( s 3)
*The Governor 'MAY' delegate his powers (s 4)
*The decision of The Governor under subsection 5 shall be final (s 6)


@Jmaine, have you ever heard of or seen a state government apply for license/permit for a rally, meeting or procession in a place of public resort in the State? The 13,000 newly employed teachers were present there by invitation and under the auspices of the State Government whose primary responsibility is to secure lives and properties, and therefore there was no need for a permit/license. It is like asking the President to seek for permit from the IGP or FGN from the NPF!

Mr Commissioner, what is wrong with people deciding to protest against the President if they so wish, as long as they do it lawfully?? Whether they are Teachers or Youths??


I know that Ameachi and his small Gang can be Noisy CLOWNS ,but nobody should go beyond what is necessary and lawful to deal with them. They will be dealt with lawfully when the time comes.

Am interested in this part of ur post. what do u mean by legal option? Its there a constitutional way states are expected to send posting letters to her new employees? Is it a must such must be followed? if its not, does it mean anyone that receives such by any means different from this legal way is pretty well on his own? kindly shed more light on this legal option please.

Gee, i expressly said the power to issue out permit resides with the governor with the "Active" involvement of the police. Even though the power to override the police in some instance is present.

The "May" implies the prerogative of the governor to confer such powers of issuance on any senior officer ranging from a chief Superintendent to the commissioner.

Let me give you a practical term. Amaechi can decide to delegate such powers to any senior officer other than Mbu and Commissioner Mbu wont cough , since the law empowers the Gov to delegate powers to any senior officer of his choice as stated above.

Amaechi has to inform the police of such a large gathering even for his own safety . And that alone constitutes a potential risk with the volatile nature of the state.

The primary responsibility of Gov Amaechi to secure lives and properties rests on the competence and alertness of the security outfits which falls under the jurisdiction of the police. So when Amaechi chose to keep them (The Police) in the dark, whose lives and properties is he protecting ? . .

Honestly I don't understand what Mbu problem is. Agreed u and Amaechi are enemies but stopping legitimate teachers from receiving their posting letters is uncalled for. Will those teachers teach Amaechis children?

Is not informing the police a justifiable reason and excuse to tear gas and disperse the crowd? Informing the police is not the same as Permit. I particularly took you on for supporting Mbu's claim that citizens' or state government must obtain permit before gathering. There wouldn't have been a need to inform the police if the police had any regard for the Governor because they will be working hand in hand. Thankfully, you have admitted that the court pronouncement trumps your argument in favor of Mbu's shenanigans.

In a sane society, what right has Mbu to stop the people from converging in the stadium for whatever reasons? The same stadium is used to organize Pro Jonathan rallies and the same Mbu does nothing about it. Does it mean Amaechi has no right to use any public infrastructure for whatever purpose? I won't be surprised if the retardeen stops Amaechi from using the government house to execute his legitimate functions. angry

Angry Arik Air passengers block Abuja airport runway
Angry passengers yesterday evening Thursday September 26th blocked the runway of the Nnamdi Azikiwe International Airport, Abuja, preventing planes from taking-off or landing.

The passengers, who disembarked from an Arik Air flight, blocked the Abuja runway because the flight they took from Abuja to Calabar was not allowed to land in Calabar around 5.30pm for safety reasons - the runway lightening was poor, forcing the pilot to return the passengers to Abuja.

Don't the Schools have teachers before or what? secondly why should he make all of them come to one place to collect their letters? it means that some of them might have travelled from distant LGAs to collect these letters? It is either Amaechi is not wise enough to know that he should take these letters to their various LGs or he wants to make a show or cause a scene with the crowd. Thirdly, he has been in office for six and half yrs he did not recruit these teachers he is only doing it now to score cheap popularity and increase recurrent expenditure for the coming Administration in the state.


So if I understand you well; not employing workers for the past 6 years has made it illegal or offensive to employ teachers now because he has issue with GEJ? undecided

So, jmaine, are you telling us that Mbu's action was in order? Have you no sense or objectivity or at least some pity for the poor teachers who were teargassed? Was Amaechi there? Do 13,000 people deserve to be treated like criminals just because the CP is acting on orders from Abuja to make Amaechi's life uncomfortable?

That PDP/Aso rock money you are collecting to spread propaganda, promote falsehood & encourage dastardly acts such as this will surely get you in deep trouble one day. It's not a curse, consider it a guarantee, an assurance, a certainty.

I've said it before, all these things are just helping to make Amaechi more popular. I for one never knew the state govt just employed 13,000 teachers! I pray those teachers are bold enough to file a suit against the CP. This should not be taken lightly at all. Even though we know his master in Aso rock will likely save him, at least let him feel some heat. Men wielding power as if they won't leave it or it won't leave them one day.

O Lord, may our enemies continue to be powerless against us and keep making us stronger for every action they take to pull us down. Amen!

Don't the Schools have teachers before or what? secondly why should he make all of them come to one place to collect their letters? it means that some of them might have travelled from distant LGAs to collect these letters? It is either Amaechi is not wise enough to know that he should take these letters to their various LGs or he wants to make a show or cause a scene with the crowd. Thirdly, he has been in office for six and half yrs he did not recruit these teachers he is only doing it now to score cheap popularity and increase recurrent expenditure for the coming Administration in the state.

All those supporting the Governor i have a question?Why was'nt d letters given to the teachers at their local govts or put online for the teachers to printout considering their large number must they go to tthe stadium to collect posting letters!!!!Abeg dis one na heavy politics!!!

Mr Mbu Is Being Given Orders From Above But These Actions Can Proliferate The Hatred For Mr President. Imagine If Gov Amechi Side Of The Story Is True, What Do You Expect Those Unemployed Graduates Who Were About To Witness A Happy Day To Say About Mr President?
