Let me summarise some [b]FACTS here:

1.) Petitioner to a Divorce is at Liberty to retain the services of ANY LAWYER ..... on any cost-basis (payment per hourly, per sitting, per case , e.t.c ...even in exchange for se*x as some defense Lawyers have been known to start a "clandestine relationship" with their client) ................or not to use a Lawyer at al[/b]l.

2.) if very poor and the Petitioner [b]still needs a Lawyer, s/he can request for a "Government lawyer" (Legal Aid), it is free!

3.) The Divorce proceedings "may" not take Child Maintenance, Access and Custody into consideration, as those issues may be treated separately though most courts take it together for "final settlement" as it is "tidy" that way

4.) A Court has the jurisdiction to "AWARD" ANY AMOUNT TO THE WIFE! Yes, it is at the mercy of the presiding judge!
The Respondent may "Appeal" such award, to higher Courts for "review" (still has to pay until it is varied by higher court) but at the end of the day, The Judge at the highest Court would still determine the final amounts. This is where common-sense on the part of some Judges, fail them. For example, if the man earns 500GBP weekly, is it reasonable to ask him to be paying the ex-wife say 400GBP for Maintenance and Child Support? In America, l know they adhere to a particular "percentage" of the man's income (like 40%) to be paid out but may we ask: Does the man not have to pay his own expenses (housing -since the woman would have used the kids as an "anchor" to hold on to the family home-, food, clothing, socials, transport to work, e.t.c ) from such income?

5.) Some Judges, especially when it involves "Black folks", are known to impose "punitive payments" on the ex-husband as a precursor to sending him to prison for failure to pay when in actual fact, it is not a question of "failure to pay" but an "INABILITY TO PAY" the excessive award.
(Studies will show that "Very high Divorce rate amongst black families (in Western nations only) follow a pattern not unconnected with this "reward for divorce" strategy but that is a discussion for another day).
Such Judges dont give a damn about 'laid down rules' thus, getting a good Lawyer may come into play here.
A Judge is like a TIN-Gowd in his/her Court!

6.) It is not a case of the Court "forcing someone to take money", it is a case of the "maintenance debtor" going to jail if he (husband in 99% of cases) does not pay! . At times, payment is directed to the bank "account" of the court! for transfer to the beneficiary!

If the woman does NOT WANT THE MONEY, she is at Liberty to make "private arrangements" to transfer the money back to the husband, from her own account!

Moreover, women see such payment as a punishment for the husband who may have to struggle all his life, to pay such money just to avoid jail. Some of the men are known to be unable to settle down again, due to such financial burden, suicide and in extreme cases, "familycide" have been known to result from such desperation

7.) As for "parties agreeing to terms", YES both parties can agree to terms BUT these agreement MUST have two elements

a.) The agreement must not be repugnant to "court rules" (trying to break it down here) as in must not be against Family Court rules (exp: we both agree that l relinquish the right to see my children forever! )
b.) Such "agreements" still has to be taken to Court and made "An Order of court" by a Judge ...before the Divorce proceeding is determined by a Judge. After the Judge makes his Order, it superceeds any future "private agreement" except a higher court nullifies the earlier court Order.

Let us also remember that if the woman says "I am collecting nothing for MYSELF, l am only collecting Child Support for the kids",....
Question is: WHO gets that Child Support and who decides "How, When and What" it is spent on?
The woman ofcourse, so indirectly, she gets the money for herself, just a convenient "re-arrangement" of "title of the payment"!

8.) I also think (my own opinion now) that "No One should expect to maintain their previous "particular lifestyle" after a Divorce unless they can pay for it".
The husband as l know, who has to pay close to half of what he earns to his ex-wife definitely CANNOT live the same lifestyle as he used to do when he was married and owning his income, WHY THEN SHOULD THE WOMAN BE EXPECTED TO CONTINUE TO LIVE SUCH "PARTICULAR LIFESTYLE", AFTER DIVORCE, FROM SOMEONE'S ELSE SWEAT? .... Well, that is the "burden of marriage to a Woman" and l see the landscape "changing" rapidly as men get wiser to these "booby-traps" of marriage. Is the man not also entitled to claim that he wants to continue to live that "particular lifestyle" he was used to, before break-up?

Though l detest the "act" of homosexuality (no apologies, that is my opinion) but something tells me that it could be an unintended answer to the problem as "two men" (or two women) marry themselves and adopt children (the key issue) such that none of the two can lay claim to being the wife or husband ... just a union of two adults and none of the two can go to court to claim alimony or automatic right to hodl the children or family properties ...as "women" often do right now!
