The Constitution of the Federal Republic of Nigeria is a system of rules made to ensure the normal and congruent functionality of the Nigerian government and people. It imposes on all duties just as it provides for all protection. Knowledge of the Constitution is knowledge of the supreme laws that guide our country.
In the Constitution, there are certain laws that are overlooked; maybe because they are too paltry for consideration(which is very false) or those who own a paper copy of the Constitution are more interested in esoteric laws mostly for political reasons. They are laws that affect you and your "minor" and "not-so-important" daily activities. They are laws that should prevent you from doing 7 things you do without knowing they tag you "criminal". These laws make these 7 "normal" activities illegal.(there even could be more) These laws are embeded in section 45(1) and (a) and (b):
"Nothing in subsections 37, 38, 39, 40 and 41 of this Constitution [note that these sections stated your Fundamental Rights] shall invalidate any law that is reasonably justifiable in a democratic society-
(a) in the interest of defence, PUBLIC SAFETY[take note], PUBLIC ORDER, PUBLIC MORALITY[very important] or PUBLIC HEALTH
(b) for the purpose of protecting the RIGHTS and FREEDOM of other persons"

Now what those subsections expatiate is that you have your right to freedom of whatever the Constitution has accorded you, BUT those rights could be derogated from you if your expression of those rights goes against the interest of defence, public safety, public order, public morality, or public health; and if they violate the rights of others.

Now here are 7 "normal" things you do that contravene the supreme laws of this Constitution:

1. Indecent Dressing: it's against the "interest...of public morality"

2. Preaching Noisily in Public (and disturbing people in their sleeps): it's against "interest...of public order". I could tag it "noise polution"

3. Public Display of Affection (PDA): It's against the "interest... of public morality"

4. Burning of Tyres: it's against the "interest...of public safety [and] public health"

5. Obstructing Traffic During Cultural Festivities or Blocking of Streets: it's against the "interest...of public order" and it infringes on the limited right to freedom of movement according to Section 41(1).

6. Violent Masquerading: (flogging people also): it's against the "interest...of public safety...public order[and]public morality". It also infringes on the limited Right to Dignity of the Human Person according to section 34(1) and (a)

7. Smoking in Public Places: it's against the "interest...of public health".
(this list is not comprehensive: you could add more from your understanding of these subsections)

So next time you do these things, just know that you are treading on the same path as that corrupt politician, armed robber or vandal. Accoridng to the Constitution you are all EQUAL violators because you are all equal before the law according to section 16(1) and (a) and section 17(2) and (a).

Op change your tittle as these are not criminal practices(offence) but civil violations and they do not require the offender to loose their total freedom through jail time, but a fine could be involved or a temporary prohibition if something like licences are involved.

op offence is determine by its weight, so ur above mentioned is classified under simply offence. except the offender committed it intentionally in order to affect others badly.

Corrupt politician, arm robber etc is felony offence.

civil violation at times attracts a jail term,which could be 3-6 months,but most often a fine is attached to the penalty,giving the offender a easy way out.

I appreciate your points, but civil violations are also criminal activities. According to the OALD a "violation" could be an "act of breaking or refusing to obey the law"; while "crime" is "activities that involve breaking the law". And when the law is violated by civilians, it could be tagged "civil violations", which could attract a sentence (as would be determined by a court-it may also attract a jail term).

And according to section 35(1) and (a), "Every person shall be entitled to his personal liberty and no person shall be deprived of such liberty save in the following cases and in accordance with a procedure permitted by law-
(a) in execution of the sentence or order of a court in respect of a criminal offence of which he has been found guilty"

That only happens if the offender is a multiple offender with total disregard for the health and safety of the society.............Where the fine and temporary prohibition doesn't work for some individuals then the 3 to 6 month jail term could be applied and that is still subject to fine at the judge's discretion.

In other words; heavier fine could be involved or the judge could decide to put you behind bars to exorcise you of your demons. grin
