(1) There shall be a Speaker and a Deputy Speaker of a House of Assembly who shall be elected by the members of the House from among themselves. (2) The Speaker or Deputy Speaker of the House of Assembly shall vacate his office - (a) if he ceases to be a member of the House of Assembly otherwise than by reason of the dissolution of the House; (b) When the House first sits after any dissolution of House; or (c) if he is removed from office by a resolution of House of Assembly by the votes of not less than two-third majority of the members of the House. Pesuzok: The injunction was granted PDP after the manufactured division called nPDP was formed. Hence the injunction was long in place before Tambuwal defected. But more seriously if we are a serious country we won't even be entertaining this debate! if Tambuwal was clear on his conviction that he wants APC, the correct thing should have been to resign months ago, force a bye-election and get his sokoto people to re-elect him as APC legislator. At this moment Tambuwal is attempting to swap his peoples mandate from PDP to APC while flouting the constitution and without recourse to his own constituency who elected him under PDP. A dangerous precedent is being set here and this can't just be allowed to stand! Enough is enough! This simply means that in future Nigerians can vote a majority moderate party to NASS and members of this majority party can vote one of their own as leader but by defection we can end up with a fundamentalist leadership in the house! Very dangerous precedent is being set here by Tambuwal!! |

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected; Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored so PDP should get a fresh induction to show that there is really no division in PDP before asking for tambuwal to vacate, not bring forward an old injuction |

What is also obvious here is the whole conniving formation of nPDP is just so that APC and their gang can circumvent section 68 of the constitution. It's amazing how far this so called progressives can go just to circumvent the constitution and prevent needing to go back to the people to vote in a bye-election. It is really scary for Nigerian democracy if these conniving rascals come anywhere near power! |
