Some health departments require healthcare providers to report the name of your sex and needle-sharing partner(s) if they know that information—even if you refuse to report that information yourself. Some states also have laws that require clinic staff to notify a “third party” if they know that person has a significant risk for exposure to HIV from a patient the staff member knows is infected with HIV. This is called duty to warn. These guidelines do not require that a physician disclose the name of the person who might be putting an individual at risk, although in some instances that identity will be obvious. These guidelines do not justify disclosures about HIV information to insurers, employers, schools, or other institutions. Efforts at contact tracing need not breach medical confidentiality with regard to the HIV positive person. They need only advise people that they may have been exposed to HIV infection. LordReed:Young man you are digressing. Did you not see it is a LAW there, state Laws not even Federal law. What have we been saying all day: the Law does not oblige doctors here to reveal such info. What a wicked woman. To disclose to a partner or not legally depends on where the healthcare professional is practicing. Some countries have something called partner notification while some don't. For those that don't have it, notifying a person could come under duty of care and public interest. |

The fact you think some confidentiality clause justifies the wilful infection of a patient shows the welfare of your patients isn't your first priority. As stated in Opinion E-2.23: If a physician knows that a seropositive individual is endangering a third party, the physician should, within the constraints of the law (1) attempt to persuade the infected patient to cease endangering the third party; (2) if persuasion fails, notify authorities; and (3) if the authorities take no action, notify the endangered third party [16]. As a policy matter, the AMA strongly recommends that all states adopt requirements for confidential HIV reporting to appropriate public health authorities for the purpose of contact tracing and partner notification [17]. The AMA encourages uniform protection of the identity of HIV patients that is consistent with public health departments and vows to continue to address, through the Council on Ethical and Judicial Affairs, the patient confidentiality and ethical issues raised by known HIV-positive patients who refuse to inform their sexual partners or modify their behavior [17]. The AMA also supports legislation on the physician's right to exercise ethical and clinical judgment regarding whether or not to warn unsuspecting and endangered sexual or needle-sharing partners of HIV-infected patients and promulgates the standard that a physician attempt to persuade an HIV-infected patient to cease all activities that endanger unsuspecting others and to inform those whom he or she might have infected. As stated above, if such persuasion fails, the physician is urged to pursue notification through means other than by reliance on the patient, such as by the Public Health Department or by the physician directly [17]. 1 Like |
