I thought Ameachi's House of Assembly amended the High Court Law to the effect of making the chief registrar an acting chief judge of the state on administrative matters. Except Ameachi wants to approbate and reprobate hence, the chief registrar should swear wike as provided in S(185)2 of the CFRN as amended 2011

Judas! Judaas! Judas! Judaas! Gaga!

Your refusal to appoint a new CJ proves that you knew all along that Wike will win. Whether you like it or not, Ezenwo must be sworn in. Then u cam return to ghana and continue eating groundnut soup, pounded yam and dry fish. tongue

Very simple, the constitution says ‘where there is no substantive Chief Judge, the most Senior Judge of the High Court AUTOMATICALLY assumes office as the Acting Chief Judge. At this point its not in the power of the governor to ‘appoint’. It’s within the jurisdiction of the NJC to say who is the Most Senior Judge of the State High Court of Rivers State period…!!! The power of appointment of the substantive CJ lies only in the hand of the Governor based on recommendation from the NJC. At this stage what we should be talking about is who is the most senior judge of the Rivers State High Court. That Judge can perform the duties as the Acting CJ without even the ceremonial oath of office by the governor. The issue in my mind is that since the matter is in court and the court has adjoined to June, NJC's acting on the matter by appointing Daisy Okocha as the Acting Chief Judge in spite of the subsisting Court case may amount to contempt of Court

This discuss will be richer if you quote the constitution correctly. Section 271 subsection 4 states, 'If the office of Chief Judge of a State is vacant or if the person holding the office is for any person unable to perform the functions of the office, then until a person has been appointed to and has assumed the functions of that office, or until the person holding the office has resumed those functions, the Governor of the State shall appoint the most senior Judge of the High Court to perform those functions'.

Note that the constitution says, 'the Governor of the State shall appoint the most senior Judge of the High Court to perform those functions'; so your assertion that the Governor does not need to appoint an acting chief judge is wrong!

Whether there is a Chief Judge or not, the tenure of Amaechi ends on May 29.
And the swearing in of Wike starts when? You can only hope the Chief Judge appears before May 29 as this could be a delay tactics to press more issues forward at the tribunal and maybe, Wike might just a one month governor of River-state.

“Well, I hope and believe that reason will prevail and the governor will see it fit to do what is needful to ensure he appoints the appropriate person as stipulated in the constitution as acting Chief Judge so that at least, we can have our new governor sworn-in by the acting Chief Judge so appointed,” Okocha said.

So why hasn't the most Senior Judge of the High Court automatically assumed office?

it does not matter if you have a chief judge or not to swear in wike, by 29th may, that mad man seize to be the governor of the state, you all can see what he has turned the state into? And that is why he is yet to be settled with any position in Abuja at the moment, so far he has lost out of SFG position to Onu, the minister for petroleum to David west, currently he is on the reserved list, they will get him something but not what he wants, why because of all this nonsense playing out in Rivers state.

Ameachi has shown that he can never be trusted with power, and that is going to work against him.

In all seriousness, we should avoid a constitutional crisis in Rivers. Let Wike be sworn in since he can still be removed by the tribunal given the inherent fraud in the gubernatorial election.

Re: Okocha Expresses Fear Over Who Swears In Wike by JW214: 12:30pm On Apr 21, 2015
This is simple. since there is no Chief Judge or Acting CJ, a CHIEF Priest can swear him in.

That is even better, Ogun will be used instead of Bible or Quran. I can bet he will be a good Governor throughout, remember Ogun is fast to act.....
