Very simple, the constitution says ‘where there is no substantive Chief Judge, the most Senior Judge of the High Court AUTOMATICALLY assumes office as the Acting Chief Judge. At this point its not in the power of the governor to ‘appoint’. It’s within the jurisdiction of the NJC to say who is the Most Senior Judge of the State High Court of Rivers State period…!!! The power of appointment of the substantive CJ lies only in the hand of the Governor based on recommendation from the NJC. At this stage what we should be talking about is who is the most senior judge of the Rivers State High Court. That Judge can perform the duties as the Acting CJ without even the ceremonial oath of office by the governor. The issue in my mind is that since the matter is in court and the court has adjoined to June, NJC's acting on the matter by appointing Daisy Okocha as the Acting Chief Judge in spite of the subsisting Court case may amount to contempt of Court

Please always do some research and little brain storming before you respond in a public discussion.


Okocha is not bothered about the law.

He's bothered about his sister getting to the Chief Judge position.

There's always a way.

If Wike could engineer a Supreme Court judgement that made Amaechi governor without contesting, how will he not know what to do to get himself sworn-in legally by May 29th?

Watch and see.

u sound like a lawyer, but am sure u are trying to amend the constitution by urself.
Pls all wat u stated above is very inconsistent to s. 271(4) of the CFRN, 1999 as amended.
it simply states dat the governor shall "appoint" the most senior high court judge as acting chief judge if d office is vacant.
Do not post things ur not sure of. It is very misleading.

I thought Ameachi's House of Assembly amended the High Court Law to the effect of making the chief registrar an acting chief judge of the state on administrative matters. Except Ameachi wants to approbate and reprobate hence, the chief registrar should swear wike as provided in S(185)2 of the CFRN as amended 2011
No, the House of Assembly amended the High Court Law to the effect that the Chief registrar could assign cases to high court judges where the office of the Chief Judge is vacant. Not all administrative matters. Also, the Chief Registrar is a just a judicial worker, it is only funny if u say that the law says he could be made acting Chief Judge.

The same scenario may play in out in Ekiti, because of the impeachment imbroglio that is going presently there, that if the Governor Fayose taught or have the feelings that the current judge is sympathetic to the Apc lawmakers, the governor may decided to remove the chief judge temporary until after may 29th, 2015.

To every law there is an exception, Ameachi is too toyish to hold Rivers people to ransom. Come May 29, Nyesom Wike will be sworn-in.

Pls give us the route to the exception in this case. We are eager to know.
