The national confab has come an gone, leaving behind a report that continues to generate as much heat as the PwC report. grin

Its quite unfortunate that the man who would have been in the best position to implement the report/recommendations lost his re-election bid. sad

The ball is now in the court of Gen. Buhari, the president-elect, who comes from a party that has been against the entire exercise right from the on-set, and Nigerians.

This poll is therefore meant to give the new president an idea of what majority of Nigerians feel about the recommendations of the confab and whether or not he should implement it.

Highlights of the main recommendations are given below with contentious issues put in bold.

1• Two tiers of government – federal and states (as the federating units).

2• 774 LGAs no longer listed in the constitution.


3• No more state sponsorship of
religious pilgrimages

4• All elections will be handled by the Independent National Electoral Commission (INEC)

5• State Independent Electoral
Commissions (SIECs) scraped

6• Three years guaranteed tenure for LG officials

7• State police for states that desire it

8• Regional government for regions that desire it


9• Abuja assumes the status of a state with an elected Mayor

10• Each state to have its own constitution

11• Immunity clause to be removed from the constitution

12• Politicians found guilty of electoral fraud risk 10 years ban.

13• Introduction of electronic voting system after 2015 elections

14• Conclusion of all electoral litigations before swearing-in

15• Loss of seats as a result of indiscriminate defection by governors and legislators.

16• Diaspora voting

17• Establishment of a Diaspora Commission.

18• Creation of 18 additional states

19• Government sponsorship of religious pilgrimages abolished

20• Thirteen Percent derivation principle retained

21• Onshore/Offshore dichotomy remains abolished

22• Mines and Minerals remains on the Exclusive Legislative List but the states where minerals are found would be involved in the exploitation of such minerals.

23• Five percent of Consolidated Revenue Fund to be deployed to the development of solid minerals and other minerals across the country.

24• Land Use Act remains in the protective custody of the Constitution but land owners are to enjoy compensation whenever such lands are to be taken over by the
government.

Buhari can only put pressure on some stuff but I think it's still down to the house to deliberate on these issues. After all they are the "lawmakers".

That said, the confab was just a useless way to spend money since all recommendations still go to the house for further deliberation. It was just multiplication of roles.

Even if the NASS agrees to implement the report, Buhari can still veto it just as Jonathan did to the amended constitution. Never the less, you should click the appropriate button to have your opinion registered. Thanks.

I'm in favor of numbers 1,2,3,6,7,10,11,12,13,14,15,16, and 19.

When the states draft their own constitutions, the federal constitution would have to be amended to delete its relevant provisions regarding the tenure of governors, HOA members, LG chairmen and councillors.
The SIECs should still exist, although some serious reform would be needed for them to be impartial. INEC could be empowered to supervise their activities. Today, most, if not all LG elections are won by candidates of the governor's party. Its really a disgrace.

The use of electronic voting machines will make the voting experience far less tedious, and the collation of results easier. For eg a single unit of Indian EVMs can process 8,000 votes and conclude counting within 2 hours. So its possible to know the winners of elections within hours, as against within 3 days.

On diaspora voting, the logistics would have to be worked out, and a constitutional amendment would be necessary for it to be successful. For those of us in the US, INEC could set up 2-3 registration centers each in northern and southern California, Texas, New York, Georgia, Maryland, Ohio. Ditto for Nigerians in the UK, SA, Germany etc. The cost of setting up overseas reg areas would run into billions of Naira, that's the only drawback.

Mines and minerals should be on the concurrent list. Pursuant to that, the 13% derivation should be increased to 20%. However, the FG may have to lay off around 30-35% of the civil service, and implement the Orosanye panel report in order to adjust to the corresponding revenue shortfall.

I still believe that a president shouldn't have the power to veto constitutional amendment bills. It can make the president a civilian dictator; the FHC ruling giving the president such a power should be appealed to the Court of Appeals by the NASS.

Or if a President has such veto power, the NASS should be able to override it with a 2/3 vote in each house, just as it can be done with other regular bills.

The issue of Vetoing will not surface if the recommendations are generally appealing. Just as you pointed out areas you didn't like, such issues can cause the president to refuse putting the report into effect. Unless he decides to tow the line of selective implementation.

Probably you don't understand my first post and why I call it a waste. Lemme break it down.

1. The NASS are supposed to deliberate on issues and make laws. They get paid billions to do this.

2. The NASS have not solved Nigeria's issues. Current laws are not good. (Meaning NASS is somewhat incompetent)

3. Bring in CONFAB to do NASS work of deliberating on issues. Pay CONFAB billions too, while still paying NASS billions.

4. CONFAB finished work. OK great.

5. CONFAB still has to submit their work to the same NASS to redeliberate upon again before the laws are made.

6. Number 5 above brings us back to Number 1, or should I say Square 1.

So how exactly was the CONFAB billions meaningful.

The CONFAB would have only made sense if the recommendations were passed through a referendum and not the NASS.

20% derivation! Haba! Thats greed na. You want some regions to be more developed than others? 10% derivation will still do wonders in the respective states if the administrators utilize the funds judiciously. Giving a fool more money doesn't mean he/she will spend it more wisely.
