by Musa Abdullahi Femi Gbaja Biamila, surname also spelled Gbaja-Biamila and Gbajabiamila is a Nigerian lawyer, All Progressives Congress politician, and Minority Leader of the House of Representatives. According to case file published by Leagle, Inc. a leading provider of copies of primary caselaw from all Federal courts and all State higher courts in America, referred to as Femi Gbaja, he admits violating Rule 1.15(I) of the Georgia Rules of Professional Conduct set forth in Bar Rule 4-102(d). The case reads, “This disciplinary matter is before the Court on Respondent Femi Gbaja’s Petition for Voluntary Discipline, which was filed under Bar Rule 4-227(b)(2) before a formal complaint was issued. In his petition, Gbaja admits violating Rule 1.15(I) of the Georgia Rules of Professional Conduct set forth in Bar Rule 4-102(d). Although a violation of this rule is punishable by disbarment, Gbaja requests the imposition of a 24-month suspension. He agrees, however to accept a suspension of up to 36 months.” It says “Gbaja, who has only been a member of the Bar since 2001, admits that he accepted payment of $25,000 as settlement of a client’s personal injury claims, deposited those funds in his attorney trust account in January 2003, failed to promptly disburse those funds to his client, withdrew those funds for his own use, closed his practice and moved out of the country”. “Gbaja admits violating Rule 1.15(I) of the Georgia Rules of Professional Conduct set forth in Bar Rule 4-102(d). Although a violation of this rule is punishable by disbarment, Gbaja requests the imposition of a 24-month suspension. He agrees, however to accept a suspension of up to 36 months.”. In the Matter of Femi GBAJA, Supreme Court of Georgia, February 26, 2007 cited that, although Gbaja ultimately paid the $25,000 to his client in 2006, he admits his conduct violated Rule 1.15(I) and that, as a result, he is subject to disbarment. “In mitigation of his actions Gbaja asserts that he has cooperated fully with disciplinary authorities, repaid his client, and is extremely remorseful for the consequences of his conduct. Under these circumstances, we conclude that a 36-month suspension is an appropriate sanction. Accordingly, Gbaja hereby is suspended for a period of 36 months. What's the purpose of this thread? I don't think any sane person will call Femi a "speaker-elect". Just like you used Mulikat as precedence, the party is only trying to adopt a candidate that all the APC reps should (not must) vote for, but to avoid the mistake of PDP, instead of the party hierarchy imposing a candidate, it was thrown open to the APC reps (elect). I see it as an event with good intentions. Everybody knows the conclusion of the said "primaries" is not binding! This should even be hailed as a good step towards internal democracy, and should Dogara wish not to abide, he should realize that he risks his party losing out completely, as a PDP candidate, with the help of all PDP, Labour and APGA reps (elect) could emerge as speaker. A lot of APC members were not at the mock elections does that mean they support Dongara? If Femi needs just 26 more to win, if I were Dongara, I will quietly just chill and negotiate for a post as the post of deputy speaker is gone. The thing Barcanista forgets is that there is a number of PDP house of reps members that will want to decamp to the APC and this is a perfect opportunity to show loyalty. You do not play game of "if" in politics with people you know are not decided. Barcanista thinks he is playing with PDP whose internal discipline is hilarious, the APC has a way if dealing with their own people and Femi getting 26 from the PDP/absentee APC reps is not so difficult. Dongara on the other hand has a tough job of trying to sell himself to the PDP. This is not 2011 where the ACN voted against Mulikat because they don't want someone that influential to be in the SW and so they voted Tambuwal. What will be the position of the PDP reps from the SW? What do they gain by voting Dongata? You really believe that will do as their party asks but the APC reps has shown they will vote what they believe will make them relevant 3 Likes |
