I think they are just starting ,but feelers from the camp of accord indicates that they have a very good and water tight case against ajimobi

contributory factor ,yes . But not the main determinant factor,rigging was what eventually won the elections for ajimobi. grin

Election Petition Filed Against Kogi State Senator Dino Melaye Dismissed

The Peoples Democratic Party (PDP) Senatorial candidate, Smart Adeyemi, who alleged that the election was fraught with irregularities, filed the petition. Adeyemi said that the winner-declared by INEC, Senator Dino Melaye, did not win the election.

irregularities, filed the petition. Adeyemi said that the winner-
declared by INEC, Senator Dino Melaye, did not win the election.

“Melaye was declared the winner of the election because of wrong
and/or incorrect computation of lawful votes cast and intentional
omission of collating results of the polling units won by the
petitioners and counting of spoilt ballots in his favour,” Adeyemi
stated in a statement cited by Vanguard.

The petitioner, Smart Adeyemi wanted the tribunal to order INEC to
conduct another election, or declare him, instead, as the winner.
The tribunal however dismissed the petition this morning, citing
lack of merit.

INEC originally announced Dino Melaye winner of the election with
41,120 votes. Smart Adeyemi of the PDP had 38,148 votes.

Election petition tribunal upholds APC ’s Akpatason ’ s election
The Edo State Election Petition Tribunal on Thursday dismissed the petition filled by the state chapter of the Peoples Democratic Party ( PDP ) and its candidate in the Akoko - Edo federal constituency in the 28 March national election , seeking to unseat the declared winner of the election .
PDP and its candidate , Oladele Bankole- Balogun, had filed the petition challenging the victory of the candidate of the All Progressives Congress (APC) , member representing Akoko - Edo Federal Constituency , Peter Akpatason .
The Tribunal threw out petition of the PDP on the ground that it was not properly filed in accordance with the Electoral Act .
Akpatason had through his Counsel, Ken Mozia, challenged the petition of the PDP and its candidate on the ground that the petition of the party was signed for but the person did not indicate his or her name as stipulated in the law .
Akpatason also challenged the composition of the petition where he asked that certain paragraphs seemed to make the document clumsy and be also struck out .
Led in judgement by Justice A . R . Ozoemena , the Tribunal took time to analyse the arguments adduced by Counsels to both parties and faulted the joint petition filed by the Peoples Democratic Party (PDP ) and its candidate Bankole- Balogun , asserting that the failure by the PDP to sign the petition filed before the Tribunal was a clear negation of the Electoral Act . “ As it seems there is no petition before the Tribunal since there was no attempt by the PDP or its agents to sign on behalf of the party . The petition lacks merit and therefore struck out in its entirety, ” Justice Ozoemena declared .
The Tribunal also struk out allegation of manipulation of the election results and violence made by the PDP candidate against some persons in the petition .
While striking those paragraphs from the petition , the Tribunal pointed that “ the offences level against these persons are criminal in nature and such a situation the affected persons are supposed to be joined in the petition because the law says such persons should be joined as necessary parties . In this case they were not joined in this petition and it will be wrong to give judgment when the persons are not given the opportunity to defend themselves, the paragraphs are therefore struck out . ” On the signature by proxy for the petitioner, the Tribunal ruled that the it will not accept signature by proxy as stated explicitly in the Electoral Act .
“ The petition therefore was inappropriately filed and is rendered invalid , ” the Tribunal held .
Counsel to Akpatason and the APC , Ken Mozia ( SAN ) , described the ruling as victory for democracy , noting that “ the panel were meticulous in their judgment . ” Candidate of the PDP in the election , Bankole- Balogun has however said he is considering appealing the judgement of the Tribunal.

Tribunal strikes out 2 APGA cases in Enugu for non-appearance

Enugu - The State and National Assembly Election Petition
Tribunal in Enugu on Wednesday struck out a petition filed by
Anthony Nwafor of All Progressive Grand Alliance Party (APGA)
for non-appearance.
Nwafor was challenging the declaration of Peoples Democratic
Party (PDP) candidate, Chukwuemeka Ujam, by Independent
National Electoral Commission (INEC) as the winner of Nkanu
East/West constituency in the March 28 National Assembly
(NASS) elections.
The Chairman of the tribunal, Justice Michael Edem, ruled that
since the petitioner had failed to appear before it, the petition
should be struck out.

Edem, therefore, awarded the cost of N20 000 in favour of the
respondent.
In another ruling, the tribunal dismissed a petition instituted by
Okwudili Ifeanyi of APGA challenging the declaration of Princess
Stella Ngwu as the winner of Igboetiti/Uzouwani Federal
Constituency election by the INEC.
The petitioner had earlier moved a motion urging the tribunal to
declare him winner of March 28 NASS election.
He prayed the court for an extension of time to enable him sort
out some issues.
Justice Edem, in his ruling, described the request by the petitioner
for extension of time as an `abuse’ of court processes.
He said the petitioner failed to apply for a motion within the
required time of the law.
The chairman, however, dismissed the case without any cost to
the petitioner.

Court Sacks Anambra PDP Rep

Justice Adeniyi Ademola of the Abuja Federal High Court has ordered a member of the House of Representatives from Anambra State, Godwin Idu, to vacate his seat.

Mr. Idu was elected on the platform of the Peoples Democratic Party to represent Onitsha North/South Federal Constituency.
But while delivering judgment in a suit filed by Lynda Chuba-Ikpeazu, challenging Mr. Idu’s election as a PDP candidate for the election, Justice Ademola ordered that the certificate of return
issued to the lawmaker be withdrawn.

In his place, the court ordered that the Independent National Electoral Commission, INEC, issue a fresh certificate of return to Mrs. Chuba-Ikpeazu.

Similarly, the court ordered the Speaker of the House of Representatives, Yakubu Dogara, to swear in Mrs. Chuba-Ikpeazu.
Mrs. Chuba-Ikpeazu had filed a pre-election case challenging PDP’s substitution of her name with that of Mr. Idu after the party’s primary election.

The PDP had after submitting the name of the female politician to INEC, made a u-turn and withdrew her from the race in favour of Mr. Idu.

Justice Ademola held that the substitution of Mrs. Ikpeazu name violated the provisions of Sections 31(2) (j) and 50 of the PDP constitution.

Again, the judge held that the action violated Sections 31(1) (2) and 33 of the Electoral Act, 2010 (as Amended) as well as Section222(c) of the Constitution of the Federal Republic of Nigeria and Article 25 (xii) of the Electoral Guidelines for Primary Elections, 2014 of the PDP.

Yobe Tribunal Admits N15m Bribe Exhibits Against REC

The Yobe State Governorship Election Petitions Tribunal
sitting in Abuja on Wednesday admitted as exhibits,
details of two bank accounts of the Resident Electoral
Commissioner of the state, Mr. Abu Zarma, and proof
of lodgements of total amount of N15m into the two
accounts some days to the April 11 governorship poll
in the state.
The exhibits were tendered by the Peoples Democratic
Party and its candidate in the governorship election,
Alhaji Adamu Waziri, who accused Zarma of receiving
the N15m as bribe from the All Progressives Party’s
candidate and winner of the poll, Alhaji Ibrahim
Gaidam.
Waziri and the PDP are, through their joint petition,
challenging the declaration of Gaidam by the
Independent National Electoral Commission as winner
of the poll, which they alleged was marred by
irregularities and corrupt practices.
The respondents to the petition are Gaidam, APC, INEC,
the REC of Yobe State and Assistant Superintendent of
Police, Zakari Deba (Aide-de-Camp to Gaidam).
Gaidam sought re-election in the April 11 poll as a
sitting governor..
The petitioners alleged that the Aide-de-Camp to
Gaidam, Zakari Deba, paid N8m into the Diamond Bank
account of Zarma and N7m into his Zenith Bank
account on the same day.
Both transactions were said to have been carried out
on April 8, 2015 whereas the election held on April 11.
The Justice Mojisola Dada-led tribunal admitted the
exhibits through the officials of Diamond Bank Plc and
Zenith Bank Plc who were subpoenaed to the tribunal
as witnesses.
Among the exhibits tendered and admitted by the
tribunal were documents of Diamond and Zenith banks,
including account statements, photocopies of tellers
used for the lodgements of the funds and account
opening forms, all bearing Zarma’s name.
The respondents’ lawyers did not oppose the tendering
of the exhibits during the Wednesday’s proceedings,
but they said they would reserve their objection to
some of them till the stage of filing their final written
addresses.
Diamond Bank’s employee from Damaturu Branch, Mr.
Bamaji Kukawa, while being led by the petitioners
‘counsel, Mr. Abiodun Owonikoko (SAN), said the bank
statement showed that N8m was paid into Zarma’s
account on April 8 by Deba.
“Before the April 8, 2015 entry, the bank account had
N28,143.60k,” Kukawa said while responding to a
question from Owoniko.
“The depositor was Zakari Deba,” he added while
responding to another question.
The witness said on April 13, the statement of account
showed that N8m was withdrawn from the account in
favour of Saleh & Hanif Company. He said N25,011.45
was left as balance on the account as of the end of the
period covered by the statement.
Also, Head of Operation, Damaturu Branch of Zenith
Bank, Mr. Umar Alkali, while also being led by
Owonoikoko, said Zakari Deba deposited N7m into
Zarma’s account with the bank on April 8.
He added that as of the end of the period covered by
the statement of account, the account was left with the
balance of N1,345,503.38.
Counsel for Gaidam and the APC, during separate
cross-examinations of the witnesses, asked if any of
the bank documents tendered had the office of the
Resident Electoral Commissioner of Yobe State as the
owner of the said bank accounts.
Ali also asked if the photograph of a depositor lodging
money into an account is required to be captured
before carrying out such transaction.
Both the Diamond and Zenith banks employees
answered no to both questions.
Counsel for INEC and the REC, Mr. A. O Mohammed
(SAN), and that of Deba, Titus Asaolu, also asked
questions during the sessions of cross-examination.
The matter had not been adjourned as of the time of
filing this report.

Delta Tribunal Shifts Hearing Till August 20

Proceedings of the Election Petition Tribunal, sitting in Asaba, the capital of Delta State, commenced on Monday, but was adjourned for further hearing till August 20.

The adjournment came after a preliminary objection raised by Counsel to the Peoples Democratic Party (PDP), Mr Alex Iziyon and Counsel to the Independent National Electoral Commission (INEC), Timothy Kehinde, challenging the decision of the All Progressives Congress (APC) to call seven witnesses without providing details of the
witnesses.

In his response, Counsel to the APC told the Tribunal that the motion from the PDP and INEC had just been served on them and that they needed time to respond.

The Chairman of the Tribunal, Justice Nasiru Gunmi, consequently adjourned sitting to enable him hear the motion from the respondent.

The APC and its governorship candidate in the just concluded elections in Delta State had challenged the election victory of Ifeanyi Okowa, filing a petition at the Tribunal.
